FOR ANDERSON CORP—Conduit LLC PRODUCTS
1. LIMITED WARRANTY:
ANDERSON CORP—Conduit LLC (“ANDERSON”) warrants that its proprietary HDPE conduit products (“Products”) are manufactured in accordance with applicable industry standards and specifications and are free from defects in materials and workmanship for a period of fifty (50) years when buried below ground and twenty five (25) years if exposed above ground from the date of delivery.
This limited warranty does not cover defects or failures caused by:
• Improper installation or misalignment.
• Use in unsuitable applications or environments, or with incompatible materials.
• Exposure to aggressive chemicals, excessive heat or freezing conditions.
• Mechanical damage, vibration, or pressure shocks.
• UV degradation due to prolonged exposure without protective measures.
• Failure to comply with ANDERSON’s installation and usage instructions.
• Violations of local codes or applicable regulations.
• Damage resulting from third-party negligence or acts beyond ANDERSON’s control.
This limited warranty applies only to Products manufactured by ANDERSON and does not extend to any third-party materials or products.
ANDERSON DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
2. LIMITATION OF LIABILITY:
The sole and exclusive remedy for breach of this limited warranty shall be, at ANDERSON’s discretion:
(1) Replacement of the defective Product with the same type and size at the original point of delivery, or
(2) A credit or refund equal to the original purchase price of the defective Product.
ANDERSON shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
lost profits, loss of business, removal and reinstallation costs, or damage to other property.
3. CLAIMS:
All warranty claims must be made in writing within ten (10) days of discovering the defect. Claims involving visible defects must be submitted within thirty (30) days of receipt.
To be valid, a warranty claim must include:
• Proof of purchase and delivery date.
• A detailed description of the alleged defect.
• Written authorization from ANDERSON for product return.
• An opportunity for ANDERSON to inspect the defective Product.
• Return of sample materials, if requested, following ANDERSON’s instructions.
4. GENERAL TERMS:
This limited warranty may only be modified in writing by an authorized officer of ANDERSON CORP—Conduit LLC.
If any provision of this warranty is deemed unenforceable, the remaining provisions shall remain in full force and effect.
This warranty is governed by the laws of the State of Nevada, without regard to its conflicts of law principles. All disputes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, or, at ANDERSON’s discretion, by binding arbitration under the rules of the American Arbitration Association.
ANDERSON reserves the right to modify or revise this warranty at any time without notice.
