One of the reasons the Articles of Confederation didn't work was that they did not setup a system of justice. Article three of the Constitution set up a third branch of the United States government, the judicial branch. The Judicial branch includes all the federal courts. The most important is the Supreme Court. It has the power to decide if Congress or the President have acted according to the Constitution.
