Ways we protect the Ouachita River
EPA's National Pollutant Discharge Elimination System
Stormwater runoff is generated from rain events that flow over land or impervious surfaces, such as paved streets, parking lots, and building rooftops, and does not soak into the ground. The runoff picks up pollutants like trash, chemicals, oils, and dirt/sediment that can harm our rivers, streams, lakes, and coastal waters. To protect these resources, communities, construction companies, industries, and others, use stormwater controls, known as best management practices (BMPs). These BMPs filter out pollutants and/or prevent pollution by controlling it at its source.
One of the ways we protect the Ouachita River and its tributaries is the EPA's National Pollutant Discharge Elimination System (NPDES) program. The NPDES stormwater program regulates stormwater discharges from three potential sources: municipal storm sewer systems (MS4s), construction activities, and industrial activities. Operators of these sources might be required to obtain an NPDES permit before they can discharge stormwater. This permitting mechanism is designed to prevent stormwater runoff from washing harmful pollutants into local surface waters.
Population growth and the development of urban/urbanized areas are major contributors to the amount of pollutants in the runoff as well as the volume and rate of runoff from impervious surfaces. Together, they can cause changes in hydrology and water quality that result in habitat modification and loss, increased flooding, decreased aquatic biological diversity, and increased sedimentation and erosion.
The benefits of effective stormwater runoff management can include:
protection of wetlands and aquatic ecosystems,
improved quality of receiving waterbodies,
conservation of water resources,
protection of public health, and
flood control.
Emergency Planning and Community Right-to-Know Act (EPCRA)
The Emergency Planning and Community Right-to-Know Act (EPCRA) was passed in 1986 in response to concerns regarding the environmental and safety hazards posed by the storage and handling of toxic chemicals. These concerns were triggered by the 1984 disaster in Bhopal, India, caused by an accidental release of methylisocyanate. The release killed or severely injured more than 2000 people.
To reduce the likelihood of such a disaster in the United States, Congress imposed requirements for federal, state and local governments, tribes, and industry. These requirements covered emergency planning and "Community Right-to-Know" reporting on hazardous and toxic chemicals. The Community Right-to-Know provisions help increase the public's knowledge and access to information on chemicals at individual facilities, their uses, and releases into the environment. States and communities, working with facilities, can use the information to improve chemical safety and protect public health and the environment.
Section 2018 of the America’s Water Infrastructure Act, enacted on October 23, 2018, amended the emergency release notification and the hazardous chemical inventory reporting requirements of the Emergency Planning and Community Right-to-Know Act (EPCRA). This new legislation requires state and tribal emergency response commissions to notify the applicable State agency (i.e., the drinking water primacy agency) of any reportable releases and provide community water systems with hazardous chemical inventory data. These requirements went into effect immediately upon signing the law.
