AlbumCurl — Terms of Use

1. Acceptance of Terms

By downloading, installing, or using AlbumCurl ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

AlbumCurl is a photo album creation app that allows you to:

• Create and organize photo albums with themes and frames

• View albums with realistic page-curl animation

• Edit photos with frames, filters, and captions

• Export albums as images, PDF, video, or ZIP backup

• Sync albums across devices via iCloud (Premium)

3. User Accounts

AlbumCurl does not require user accounts, registration, or login. The App functions entirely without any account creation.

4. Your Content

• You retain all rights to your photos, albums, and content created within the App

• We do not claim any ownership or license over your content

• Your content is stored locally on your device and is not accessible to us

• You are solely responsible for the content you add to the App

5. Subscriptions & In-App Purchases

5.1 Free Tier

The free version includes:

• Up to 5 albums

• Up to 10 photos per album

• 3 themes, basic frames

• Share pages as images

5.2 Premium Plans

5.3 Subscription Terms

• Payment is charged to your Apple ID account at confirmation of purchase

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage and cancel subscriptions in your device's Settings → Apple ID → Subscriptions

• No refunds are provided for unused portions of a subscription period

• All billing is handled by Apple. We do not process payments directly

5.4 Price Changes

• Prices are in USD and may vary by region based on Apple's pricing tiers

• We reserve the right to change subscription prices with notice

• Price changes for existing subscribers will follow Apple's price change policies

5.5 Lifetime Purchase

• The Lifetime purchase is a one-time, non-consumable in-app purchase

• It grants permanent access to all current and future Premium features

• It does not expire and does not require renewal

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose

• Attempt to reverse engineer, decompile, or disassemble the App

• Distribute, sublicense, or sell the App or any part of it

• Use the App to infringe on intellectual property rights of others

• Attempt to circumvent subscription or purchase requirements

7. Intellectual Property

• AlbumCurl, its design, code, themes, frames, and all original content are the intellectual property of the developer

• Album themes, frame designs, and UI elements are protected by copyright

• SF Symbols used in the App are provided by Apple and subject to Apple's licensing terms

• You may not copy, reproduce, or distribute the App's design elements

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

We do not warrant that:

• The App will be uninterrupted or error-free

• Defects will be corrected

• The App is free of viruses or harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of data, photos, or albums

• Any damages arising from use or inability to use the App

• Any damages resulting from unauthorized access to your data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Data Loss

• While we take reasonable measures to ensure data integrity, we are not responsible for data loss

• We strongly recommend using the ZIP Backup export feature to back up important albums

• iCloud Sync is provided as a convenience and is subject to Apple's iCloud terms and availability

• You are solely responsible for maintaining backups of your content

11. Third-Party Services

• The App integrates with Apple's iCloud (CloudKit) for optional sync

• The App uses Apple's StoreKit for in-app purchases

• These services are governed by Apple's Terms of Service and Privacy Policy

• We are not responsible for the availability or performance of Apple's services

12. Termination

• You may stop using the App at any time by deleting it from your device

• We reserve the right to modify or discontinue the App at any time

• Active subscriptions can be cancelled through Apple's subscription management

13. Changes to Terms

We may update these Terms of Use from time to time. Changes will be reflected in the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the developer's jurisdiction, without regard to conflict of law provisions.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of AlbumCurl.
