These Terms of Service (“Agreement”, “Terms”, or “TOS”) govern your access to and use of the Simple Alarm Clock – Smart Wake mobile application and related services (“Service”) provided by Sandip Radadiya (“Company”, “we”, “our”, or “us”).
By using or accessing the Service, you agree to be bound by these Terms. If you do not agree, you may not use or access the Service.
You confirm that you are at least 13 years old, and if you are between 13 and 18 years old, your parent or legal guardian has reviewed and agreed to these Terms and the accompanying Privacy Policy, and gives you permission to use the App.
Service: The Simple Alarm Clock – Smart Wake app and any related features, content, and updates provided by the Company.
User: Any individual who downloads, installs, or uses the Service.
Account: A profile (if any) created by the user to access specific app features.
Subscription / In-App Purchases: Optional paid features available within the app for enhanced functionality or ad removal.
You agree to use the Service only for lawful, personal, and non-commercial purposes.
You must comply with all applicable local, national, and international laws while using the app.
Certain features (such as alarm sounds, smart wake functions, or personalized themes) may require an internet connection, notification permissions, or system-level access. You are responsible for any data charges or fees incurred from your internet or network provider.
Our Service does not generally require account creation. However, if you choose to sign up for premium services or synchronize data through supported third-party services (e.g., Apple ID, Google), you are responsible for safeguarding your login credentials and for all activities under your account.
We reserve the right to suspend or terminate accounts that are inactive, misused, or violate these Terms.
The app offers auto-renewable subscriptions that unlock additional premium features and remove ads:
Weekly Subscription – $2 per week
Monthly Subscription – $4 per month
Yearly Subscription – $24 per year
Subscription Terms:
Payment will be charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
The renewal cost will be charged to your Apple ID account within 24 hours prior to the end of the current period.
You can manage or cancel your subscriptions anytime by going to your Apple ID Account Settings.
Any unused portion of a free trial period will be forfeited once you purchase a subscription.
Prices and availability of premium features are subject to change without prior notice.
All payments and billing are processed through Apple’s App Store and are subject to Apple’s terms and conditions.
By purchasing a subscription, you agree to these Terms, our Privacy Policy, and Apple’s EULA.
By using the Service, you agree to follow these guidelines:
Use the app only for lawful and intended purposes.
Do not modify, reverse-engineer, copy, or distribute any part of the Service.
Do not upload, share, or transmit any harmful, offensive, or inappropriate content.
Do not use automated systems (e.g., bots, scripts) to interact with the Service.
Do not attempt to disrupt or compromise the Service’s operation, integrity, or security.
We reserve the right to terminate access for users who violate these conditions.
We respect your privacy and handle your data according to our Privacy Policy.
We comply with applicable data protection laws, including GDPR and CCPA, where relevant.
While we take reasonable measures to secure your data, no system can guarantee 100% protection from unauthorized access. You agree to use the Service at your own risk.

Your use of these third-party services is governed by their respective terms and privacy policies.
We are not responsible for the content, functionality, or data handling practices of third parties.
All content, design, graphics, code, and features within the Service are owned by or licensed to Sandip Radadiya and are protected under applicable copyright, trademark, and intellectual property laws.
You are not permitted to copy, modify, reproduce, distribute, or create derivative works of any part of the Service without written permission from the Company.
To the fullest extent permitted by law, Sandip Radadiya and associated partners shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:
Your access to or use of (or inability to use) the Service,
Any unauthorized access to or alteration of your data,
Any errors, bugs, or security vulnerabilities within the Service, or
Third-party actions, advertisements, or linked content.
In any event, our total liability shall not exceed the amount paid by you (if any) for accessing premium features within the preceding 12 months.
The Service is provided on an “as is” and “as available” basis without any warranties, express or implied.
We make no guarantees that:
The Service will operate without interruptions or errors;
The Service will meet your expectations or be compatible with all devices;
Any defects will be corrected promptly.
You acknowledge that you use the app voluntarily and at your own discretion.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including but not limited to:
Violation of these Terms,
Misuse or abuse of app functionality,
Technical, operational, or security reasons.
Upon termination, your rights to use the Service will immediately cease. No refund will be provided for previously purchased subscriptions or features.
We may modify or update these Terms at any time. When we do, we will update the “Last Updated” date above.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the new Terms.
These Terms shall be governed and construed in accordance with the laws of India, without regard to conflict of law principles.
In case of disputes, you agree to first contact us directly for resolution.
Any unresolved disputes will be subject to the exclusive jurisdiction of the courts in Gujarat, India.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of our rights. Any waiver must be in writing and signed by us.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sandip Radadiya regarding the use of Simple Alarm Clock – Smart Wake, and supersede all prior agreements.
