These Terms of Service (the “Agreement”) are entered into between you (the “User”) and MOON TEMPLE LIMITED (the “Company”, “we”, or “us”), and govern your access to and use of the mobile application VifunAI: AI Video Generator (the “App”) and related services.
Before using the App, please read this Agreement carefully.
If you do not agree to any part of this Agreement, you must immediately stop using the App.
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1.1 You must meet the minimum age requirement under the laws of your jurisdiction (generally at least 13 years old).
1.2 If you are under the age of majority in your jurisdiction, you must use the App under the supervision and with the consent of a parent or legal guardian.
1.3 You represent and warrant that:
You have the legal capacity to enter into and perform this Agreement;
Your use of the App complies with all applicable laws and regulations;
You will not use the App for any unlawful or infringing activities.
2.1 The App provides AI-powered video generation services based on user-submitted images.
2.2 The App is a tool-based platform, and the Company does not control the specific use of user-generated content.
2.3 You acknowledge and agree that:
AI-generated content is probabilistic and may be unpredictable;
Outputs may be inaccurate, incomplete, or not meet expectations;
The service does not constitute professional advice or guarantees of any kind.
3.1 All images, materials, and data uploaded by you (“User Content”) remain owned by you or the rightful owner.
3.2 You represent and warrant that:
You have obtained all necessary rights and permissions (including portrait and copyright rights);
Your content does not infringe any third-party rights;
Your content complies with applicable laws and public order.
3.3 You shall bear full responsibility for your User Content.
If any claims, damages, or penalties arise, you agree to indemnify and hold the Company harmless.
To provide the App’s functionality, we may process your User Content.
Your data is used solely for:
Providing AI video generation services
Ensuring service stability and security
Product improvement through non-identifiable analytics
Data may be transmitted securely using encryption
Processing is primarily automated
We implement reasonable safeguards to protect data
We do not use your uploaded content to train or improve AI models unless we obtain your explicit and separate consent.
To deliver the service, your data may be processed by third-party AI providers.
We will:
Take reasonable measures to ensure their data protection standards
Require processing only as necessary
However, third-party services are governed by their own terms.
Data is retained only as long as necessary for service purposes
Data will be deleted or anonymized thereafter
You have the right to:
Request deletion of your data
Stop using the service to terminate processing
Subject to applicable law, you may have the right to:
Access your data
Request deletion
Restrict processing
5.1 Content generated through the App constitutes “Synthetic Media.”
5.2 You must not generate or distribute:
Impersonation of real individuals or public figures
Fabricated news or events
Content that may mislead others into believing it is real
Use of another person’s image without authorization
Content that harms reputation or personal rights
Sexual or inappropriate content involving minors
Deepfake content involving minors
Fraud or deception
Identity misuse
Any unlawful activity
5.3 When sharing AI-generated content, you should take reasonable steps to avoid misleading others (e.g., labeling as “AI-generated”).
6.1 We reserve the right to:
Remove violating content
Suspend or terminate access
Ban user accounts
6.2 Where required, we may:
Report violations to authorities
Cooperate with law enforcement
You retain ownership of your content but grant us a:
Non-exclusive
Worldwide
Royalty-free license
solely for the purpose of providing the service.
Subject to your compliance with this Agreement and applicable laws:
You may use generated content
Provided such use does not infringe third-party rights
You agree not to:
Reverse engineer or attempt to extract source code
Abuse the system through automation or bulk generation
Develop competing services
Interfere with system integrity or security
9.1 Certain features may require payment.
9.2 Subscriptions renew automatically unless canceled in advance.
9.3 Billing and refunds are governed by the applicable app store policies.
Certain features of the App are offered on a subscription basis (“Subscription”). The App currently provides the following subscription options:

Yearly Subscription
By purchasing a Subscription, you agree to the following terms:
Payment: Subscription fees will be charged to your Apple App Store account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, based on the selected subscription plan (weekly or yearly).
Manage Subscriptions: You can manage or cancel your Subscription at any time by going to your Apple ID account settings after purchase.
No Free Trial: The App does not provide a free trial for subscriptions.
Credits Reset: Any credits, points, or usage quotas included as part of a Subscription are valid only during the current subscription period. Unused credits will expire and be reset to zero upon the expiration or renewal of the subscription cycle, and will not roll over to subsequent periods unless otherwise stated.
Purchased Credits: Credits purchased separately outside of a Subscription are permanent, non-expiring, and will remain available in your account unless otherwise required by applicable law or due to violations of this Agreement.
Cancellation: Deleting the App does not cancel your Subscription. You must cancel through your Apple account settings.
Refund Policy: All purchases are final and non-refundable, except as required by applicable law or as determined by Apple’s refund policies.
You agree to indemnify and hold harmless the Company from any losses, including but not limited to:
Legal fees
Damages
Regulatory penalties
arising from your violation of this Agreement or applicable laws.
To the maximum extent permitted by law, the Company shall not be liable for:
Indirect or consequential damages
Loss of profits
Data loss
Total liability shall not exceed the amount paid by you in the past six (6) months.
12.1 You are responsible for complying with laws related to:
Data protection
Artificial intelligence
Content regulation
12.2 Mandatory local laws shall prevail where applicable.
12.3 If any provision is held invalid, the remaining provisions remain in effect.
We may update this Agreement due to legal, regulatory, or operational reasons.
Updated terms will be posted within the App. Continued use constitutes acceptance.
