This User Service Agreement ("Agreement" or "Terms") is a legally binding agreement between you ("you," "your," or "User") and MOON TEMPLE LIMITED ("Company," "we," "us," or "our") governing your access to and use of the mobile application AI Couple : Video Generator (the "App"), together with any related services, features, content, and technologies provided through the App.
Please read this Agreement carefully before using the App.
By downloading, accessing, installing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by this Agreement and our Privacy Policy.
If you do not agree to this Agreement, you must not access or use the App.
You must be at least 16 years old, or the minimum age required to independently use the App under the laws applicable in your country or region, whichever is higher.
The App is not intended for children under the age of 13.
If you are under the age of legal majority in your jurisdiction, you may use the App only where permitted by applicable law and with the involvement, consent, and supervision of your parent or legal guardian where required.
By using the App, you represent and warrant that:
You satisfy the applicable minimum age requirement;
You have the legal capacity to enter into this Agreement, or have obtained any legally required parental or guardian consent;
Your use of the App complies with applicable laws and regulations;
You will not use the App for unlawful, fraudulent, abusive, or deceptive purposes;
Information and content you provide or upload may lawfully be processed by us for the purposes described in this Agreement and our Privacy Policy.
AI Couple : Video Generator is an AI-powered creative application that allows users to upload permitted photographs or other visual content and generate AI-created or AI-modified videos.
Depending on the features available at a particular time, generated videos may depict people:
Hugging;
Kissing;
Dancing;
Holding hands;
Interacting;
Expressing emotions;
Appearing together in fictional scenarios;
Performing movements or actions that did not actually occur.
The App is intended as a creative and entertainment tool.
AI-generated results do not necessarily represent real events, real relationships, real communications, or actual behavior.
We may add, modify, suspend, or discontinue features from time to time.
Videos generated through the App are created or modified using artificial intelligence.
AI-generated content may look realistic even when the depicted event, action, interaction, statement, relationship, or circumstance never occurred.
Accordingly, an AI-generated video must not automatically be regarded as:
An authentic photograph or video recording;
Documentary evidence;
Evidence of an actual event;
Evidence that a person performed a particular action;
Evidence that two people actually met or interacted;
Evidence of a romantic or personal relationship;
Evidence of consent;
Evidence of a person's statements, beliefs, intentions, or conduct;
An official communication;
An endorsement or authorization;
A reliable representation of reality.
Users must independently determine whether content is fictional, synthetic, manipulated, or authentic before relying on or distributing it.
Generative AI systems are probabilistic and may produce unexpected results.
Generated content may contain:
Visual distortions;
Facial inconsistencies;
Unnatural movements;
Anatomical errors;
Incorrect expressions;
Unexpected interactions;
Incorrect backgrounds;
Inaccurate representations of the uploaded image;
Other artifacts or unintended results.
We do not guarantee that generated content will accurately reproduce any person, event, movement, expression, relationship, or circumstance.
The App may also generate results that differ from the user's expectations.
You acknowledge and accept these inherent characteristics of generative AI technology.
The App may generate videos in which two or more people appear to have romantic, emotional, social, or physical interactions.
Such generated content does not establish that:
The depicted individuals are romantically involved;
The depicted individuals have met;
The depicted individuals consented to the depicted interaction;
The depicted individuals actually performed the depicted action;
The depicted event actually occurred;
The depicted individuals endorse or approve the content.
Users must not intentionally represent fictional AI-generated interactions as authentic evidence of a person's real-world conduct or relationship where doing so would mislead, deceive, defame, harass, or otherwise harm another person.
The App may allow users to upload photographs, images, prompts, and other content ("User Content").
You remain responsible for User Content that you submit to the App.
By submitting User Content, you represent and warrant that:
You own the content or have sufficient legal rights to use it;
You have obtained any permission or authorization required to use images depicting other individuals;
Your submission and intended use comply with applicable laws;
Your submission does not unlawfully invade another person's privacy;
Your submission does not infringe intellectual property or other rights;
Your submission does not contain prohibited or unlawful material.
If an image contains another identifiable individual, you are responsible for determining whether you have the legal right or authorization necessary to process that person's likeness.
This applies even where the person is:
Your spouse;
Your romantic partner;
Your former partner;
A family member;
A friend;
A public figure;
A celebrity;
A coworker;
Any other identifiable individual.
Possessing a photograph does not automatically grant you the right to use another person's likeness for AI-generated media.
You must not use the App to create content that unlawfully exploits another person's identity, likeness, privacy, reputation, or other legally protected interests.
We maintain a strict child-safety policy.
Users must not use the App to generate, upload, process, or distribute content involving minors that is:
Sexual;
Sexually suggestive;
Erotic;
Pornographic;
Exploitative;
Abusive;
Degrading;
Intended to sexualize a minor;
Intended to create a sexualized or intimate deepfake of a minor;
Otherwise unlawful or harmful to a minor.
Users must not attempt to circumvent these restrictions through prompts, images, edits, transformations, or other methods.
We may immediately restrict or terminate access where we reasonably believe that the App is being misused in relation to child exploitation or other serious violations.
Where required or permitted by applicable law, we may preserve relevant information and report suspected illegal activity to appropriate authorities or organizations.
The App must not be used to generate:
Pornographic content;
Explicit sexual activity;
Sexually explicit videos;
Sexualized depictions of minors;
Non-consensual intimate imagery;
Sexualized deepfakes of real individuals;
Content intended to sexually humiliate or exploit another person.
Users must not use the App to create intimate or sexualized content depicting another identifiable individual without that person's legally required consent.
The App may technically be capable of producing highly realistic synthetic media.
Users must not use the App to create or distribute synthetic media for:
Fraud;
Deception;
Identity theft;
Impersonation;
Extortion;
Blackmail;
Harassment;
Defamation;
False evidence;
Manipulation of legal proceedings;
Misleading commercial activities;
Misleading political or election-related communications;
Harm to another person's reputation;
Other unlawful purposes.
Users must not knowingly present AI-generated media as authentic media where doing so is unlawful or materially misleading.
The App does not grant users any right to exploit the likeness, name, image, voice, identity, or reputation of a public figure or celebrity.
Users are responsible for complying with applicable laws governing publicity rights, personality rights, defamation, consumer protection, advertising, endorsement, and other applicable legal requirements.
Users must not create content falsely suggesting that a public figure or celebrity:
Endorses the App;
Endorses a product or service;
Participated in an event;
Engaged in a relationship;
Made a statement;
Approved or authorized the generated content.
AI-generated or manipulated content may be subject to disclosure, labeling, watermarking, or other transparency requirements under applicable laws and regulations.
This may include laws governing synthetic media, deepfakes, consumer protection, political communications, or AI-generated content.
Where applicable law requires disclosure that content was generated or manipulated using AI, users are responsible for providing the required disclosure when publishing or distributing the content.
Users must not intentionally remove, disable, obscure, or circumvent AI-generated-content labels, watermarks, metadata, or other transparency mechanisms where prohibited by law or by our policies.
The Company provides an AI generation service; it does not control how users subsequently use or distribute generated content.
You are solely responsible for your decision to:
Save generated content;
Send it to another person;
Post it online;
Publish it on social media;
Use it commercially;
Include it in advertising;
Use it in communications;
Provide it to third parties.
Before distributing generated content, you should consider whether the content could:
Mislead another person;
Violate someone's privacy;
Violate publicity or likeness rights;
Defame another person;
Infringe intellectual property rights;
Violate applicable AI transparency laws;
Violate the policies of the platform on which you publish it.
You agree not to:
Use the App to violate applicable laws, regulations, court orders, or legal obligations.
Use the App to harass, threaten, stalk, intimidate, exploit, humiliate, or harm another person.
Use the App for fraud, scams, impersonation, identity theft, social engineering, extortion, or other deceptive conduct.
Use the App to intentionally infringe copyright, trademark, publicity, privacy, or other intellectual property or proprietary rights.
Attempt to bypass, disable, defeat, or circumvent technical safeguards, content restrictions, moderation systems, generation limits, or security mechanisms.
Use bots, automated scripts, scraping systems, bulk-generation tools, or other automated methods to access or abuse the App without our authorization.
Decompile, disassemble, reverse engineer, extract source code, extract models, algorithms, prompts, system instructions, or other protected technology from the App, except to the extent such restriction is prohibited by applicable law.
Use the App or its underlying technology to develop, train, benchmark, or operate a competing product or service, except where such restriction is prohibited by applicable law.
We may use automated systems, human review, or other reasonable measures to detect prohibited content or abusive behavior.
To protect users, comply with applicable laws, and maintain the security of the App, we reserve the right to:
Reject generation requests;
Prevent certain content from being generated;
Delete or restrict content;
Limit generation capabilities;
Temporarily suspend accounts or access;
Permanently terminate access;
Preserve relevant information where legally necessary;
Cooperate with law enforcement;
Report suspected illegal activity where required or appropriate.
We do not guarantee that automated moderation systems will detect every prohibited use or content.
You retain your ownership rights in User Content to the extent you have such rights.
To provide the App, you grant the Company a limited, non-exclusive, worldwide, royalty-free license to host, transmit, reproduce, process, modify, and technically transform your User Content solely as reasonably necessary to:
Provide the requested AI generation service;
Process generation requests;
Deliver generated results;
Maintain and secure the service;
Prevent abuse;
Comply with applicable law;
Resolve technical problems.
This license does not grant the Company a general right to commercially exploit your personal photographs outside the purposes described in this Agreement and our Privacy Policy.
AI-generated content may be subject to different intellectual property laws in different jurisdictions.
To the extent the Company owns or is legally capable of assigning any rights in a generated output, and provided that you comply with this Agreement, the Company grants or assigns such rights to you to the extent legally permissible.
However:
The Company does not guarantee that an AI-generated output qualifies for copyright protection;
The Company does not guarantee that you will obtain exclusive intellectual property rights in every output;
Third parties may have rights in source materials, recognizable individuals, trademarks, or other elements appearing in an output;
Similar or substantially similar outputs may be generated for other users;
Your use of an output remains subject to applicable law and third-party rights.
You are responsible for determining whether your intended use of generated content is lawful.
The App may use third-party AI models, APIs, cloud infrastructure, content moderation services, analytics providers, and other third-party technologies.
Current or potential AI service providers may include:
BytePlus
Kling AI
Third-party services may process User Content and related technical information to provide the requested generation service.
The operation of third-party services may be governed by their own terms, policies, and technical limitations.
Your use of the App may therefore involve the processing of information by third-party service providers.
Where applicable, you should review the relevant third-party terms and privacy policies.
The Company does not control the independent operation of third-party services and cannot guarantee the availability, accuracy, security, or uninterrupted operation of third-party services.
AI technologies and third-party services may change rapidly.
We may:
Add or remove AI models;
Change AI service providers;
Modify generation quality;
Modify generation speed;
Modify generation limits;
Modify available templates;
Modify supported image formats;
Modify or discontinue certain features.
We do not guarantee that a particular AI model, provider, template, or feature will remain available indefinitely.
Certain features, templates, generation credits, or other functionality may require payment.
Payments made through the App may be processed through Google Play Billing.
Available subscription plans may include weekly, monthly, annual, or other plans displayed in the App.
Subscription pricing, billing periods, renewal terms, and applicable taxes will be presented through the applicable purchase interface.
Unless otherwise stated during purchase, subscriptions automatically renew at the end of each billing period.
You may cancel an active subscription through the applicable Google Play subscription management interface.
Cancellation generally prevents future renewal but does not necessarily provide a refund for the current billing period.
Refunds are subject to applicable law and the policies and procedures of the applicable payment platform.
Where a subscription includes generation credits, points, or usage quotas, such benefits may be subject to the terms displayed at the time of purchase.
Unless otherwise expressly stated:
Subscription credits are intended for use during the applicable subscription period;
Unused subscription credits may expire at the end of the applicable subscription period;
Subscription credits may not roll over to a subsequent billing period;
Credits may be reset when a subscription renews.
No subscription credits will be issued solely because a subscription enters a payment grace period, account hold, or similar temporary payment status, unless otherwise required by applicable law or expressly stated in the App.
Where the App allows users to purchase credits separately from a subscription, such credits may remain available for future use according to the terms displayed at the time of purchase.
Unless otherwise stated:
Purchased credits do not expire solely because a subscription ends;
Purchased credits may be subject to technical or legal limitations;
Purchased credits are not cash;
Purchased credits cannot be redeemed for cash;
Purchased credits are not transferable between users.
Nothing in this section limits mandatory refund rights under applicable law.
Payments and refunds may be subject to the policies of Google Play and applicable law.
Where a digital generation service has already commenced or credits have already been consumed, a refund may not be available except where required by applicable law or the applicable payment provider's rules.
Nothing in this Agreement excludes or limits mandatory statutory consumer rights.
Users must not intentionally abuse payment disputes, chargebacks, refund mechanisms, or other payment systems to obtain services or credits without paying for them.
If we reasonably determine that a payment dispute or chargeback involves fraud, unauthorized use, or deliberate abuse, we may take reasonable measures permitted by law, including:
Reversing or disabling unused credits;
Restricting access to paid features;
Suspending the relevant account or service access;
Investigating the transaction;
Taking appropriate legal or contractual action.
We will not restrict legally protected consumer rights or legitimate payment disputes.
To the maximum extent permitted by applicable law, the App and its services are provided on an "AS IS" and "AS AVAILABLE" basis.
We do not guarantee that:
The App will always be available;
The App will be uninterrupted or error-free;
AI generation will always succeed;
Generated content will meet your expectations;
Generated content will be accurate or complete;
A particular AI model or feature will remain available;
Third-party services will remain available;
Generated content will be legally suitable for your intended purpose.
You acknowledge that the use of generative AI involves inherent risks.
These risks may include:
Unexpected or inaccurate outputs;
Unintended resemblance to real people;
Incorrect representations;
Generation of content that may be mistaken for authentic media;
Output that may unintentionally resemble third-party content;
AI hallucinations or artifacts;
Technical failures;
Changes in third-party AI models;
Content moderation errors.
You agree to exercise reasonable judgment before relying on or distributing AI-generated content.
The App does not independently verify:
The identity of individuals appearing in uploaded images;
Whether a depicted individual consented to the upload;
Whether a generated interaction actually occurred;
Whether individuals have a real-world relationship;
Whether a generated event is authentic;
Whether the user has obtained all necessary rights.
The Company is not responsible for a user's failure to obtain appropriate permission or authorization before uploading or distributing content, except to the extent liability cannot legally be excluded.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MOON TEMPLE LIMITED and its officers, directors, employees, contractors, service providers, and partners from claims, losses, liabilities, damages, costs, and reasonable legal expenses arising out of or relating to:
Your violation of this Agreement;
Your unlawful use of the App;
Your User Content;
Your infringement of another person's rights;
Your unauthorized use of a person's likeness;
Your violation of privacy, publicity, copyright, trademark, or other rights;
Your misuse of AI-generated content;
Your fraudulent, deceptive, abusive, or unlawful conduct;
Your distribution or publication of generated content.
This indemnification obligation does not apply to the extent that a claim is caused by the Company's own unlawful conduct or where applicable law prohibits such indemnification.
To the maximum extent permitted by applicable law, MOON TEMPLE LIMITED shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including:
Loss of profits;
Loss of revenue;
Loss of business opportunities;
Loss of goodwill;
Loss of data;
Business interruption;
Reputational losses;
Damages arising from a user's distribution or misuse of AI-generated content.
To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the App or this Agreement shall not exceed the greater of:
The amount you paid to us for the App or applicable services during the six months immediately preceding the event giving rise to the claim; or
USD $100, where you have not made any payment during that period.
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited under applicable law.
The App is a creative technology service.
Nothing generated through the App constitutes:
Legal advice;
Financial advice;
Medical advice;
Professional advice;
Evidence of a real-world event;
A professional determination of identity or authenticity.
Users should obtain appropriate professional advice where necessary.
We may suspend, restrict, or terminate your access to the App where we reasonably believe that:
You violated this Agreement;
You violated applicable law;
You engaged in fraudulent or abusive conduct;
You submitted prohibited content;
You attempted to circumvent safety systems;
Your use creates a security or legal risk;
Your use may harm other users or the service.
Where appropriate and legally required, we may provide notice or an opportunity to appeal.
Certain provisions of this Agreement that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, disclaimers, liability, indemnification, dispute resolution, and applicable law.
If you believe that content generated through the App violates your legal rights or our policies, you may contact us.
Reports may concern:
Privacy violations;
Unauthorized use of likeness;
Non-consensual intimate imagery;
Child safety concerns;
Copyright infringement;
Trademark infringement;
Defamation;
Harassment;
Illegal content.
We may investigate reports and take appropriate action where warranted.
If you believe that content accessible through the App infringes your copyright, please contact us with sufficient information to allow us to evaluate the complaint.
Where applicable law requires a specific notice-and-takedown procedure, we may follow the legally applicable procedure.
Nothing in this section limits any rights or remedies available under applicable copyright law.
Your use of the App is also subject to our Privacy Policy.
Our Privacy Policy explains how we collect, process, store, disclose, and protect information, including uploaded images, technical information, and information associated with AI generation.
The Privacy Policy forms part of this Agreement.
We may update this Agreement from time to time.
Changes may be necessary due to:
Changes in applicable law;
Changes in AI technology;
Changes to the App;
Changes in third-party services;
Changes in payment systems;
Security or compliance requirements.
When appropriate, we may provide notice of material changes through the App or other reasonable means.
The updated Agreement will become effective on the date specified in the updated version, subject to applicable law.
The App may be distributed through third-party platforms, including Google Play.
Your use of the App may also be subject to the applicable terms and policies of those platforms.
If there is a conflict between this Agreement and mandatory terms imposed by a platform or applicable law, the mandatory terms will control to the extent of the conflict.
This Agreement shall be governed by the laws applicable to MOON TEMPLE LIMITED and the applicable jurisdiction, except to the extent that mandatory consumer protection or other laws in your place of residence provide otherwise.
Before initiating formal proceedings, the parties should attempt in good faith to resolve disputes through direct communication.
If a dispute cannot be resolved informally, it may be submitted to a court or other dispute-resolution forum having jurisdiction under applicable law.
Nothing in this Agreement is intended to deprive consumers of mandatory rights to bring claims before courts or authorities that have jurisdiction under applicable law.
Where legally permissible, disputes may be resolved through individual arbitration rather than class or representative proceedings. However, this provision does not apply where such waiver or arbitration requirement is prohibited or unenforceable under applicable law.
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any provision of this Agreement does not constitute a waiver of our right to enforce that provision later.
This Agreement, together with the Privacy Policy and any additional terms expressly presented within the App, constitutes the entire agreement between you and MOON TEMPLE LIMITED concerning your use of the App, except where additional terms are expressly applicable to specific features or services.

AI-generated videos are synthetic media. They may depict people performing actions, expressing emotions, interacting, or appearing in situations that never actually occurred.
The existence of an AI-generated video does not prove that the depicted event, relationship, interaction, statement, or behavior is real.
You are responsible for ensuring that:
You have the necessary rights and permissions to use uploaded images;
You do not use the App to create prohibited or unlawful content;
You do not misuse another person's likeness or identity;
You do not create or distribute deceptive deepfakes;
You do not generate prohibited content involving minors;
You do not use generated content for fraud, harassment, defamation, impersonation, or other unlawful purposes;
You comply with applicable AI transparency and disclosure requirements when distributing generated content;
You comply with the rules of third-party platforms where you publish generated content.
The Company provides the technology as a creative tool and does not authorize or encourage unlawful, deceptive, abusive, or harmful use of AI-generated media.
