Terms of Use - VESTO

1. Acceptance of Terms

By downloading, installing, or using the Vesto mobile application ("App", "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you") and the operator of Vesto ("we", "us", "our").

2. Description of the Service

Vesto is an AI-powered mobile application that generates professional studio-quality headshots from selfies you provide. The Service includes:

• AI headshot generation across multiple style categories (professional, creative, sports, lifestyle, and more)

• An AI retouch feature allowing you to edit generated images using natural language instructions

• A personal gallery to browse, download, and manage your generated headshots

• Subscription plans and credit packs to access generation features

3. Eligibility

You must be at least 13 years old to use Vesto (16 years old if you reside in the European Union). By using the App, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian.

We reserve the right to terminate accounts of users who misrepresent their age.

4. Account Registration

To access the full features of Vesto, you must create an account using a valid email address. You are responsible for:

• Providing accurate and complete registration information

• Maintaining the confidentiality of your login credentials

• All activities that occur under your account

• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

5. User Content and Photo Uploads

5.1 Your Selfies

To use the headshot generation feature, you must upload between 5 and 10 photos of yourself ("Input Photos"). By uploading photos, you:

• Confirm that you own or have the right to use those photos

• Confirm that the photos depict only yourself (no third parties without their consent)

• Grant us a limited, non-exclusive license to process those photos solely for the purpose of generating your headshots

5.2 Generated Headshots

Headshots generated by the AI ("Generated Content") are made available to you for personal and commercial use. You retain ownership of the Generated Content produced under your account.

5.3 Prohibited Content

You must not upload photos that:

• Depict minors in any context

• Are sexually explicit or pornographic

• Depict another person without their consent

• Contain hate symbols, graphic violence, or otherwise illegal content

We reserve the right to remove any content that violates these restrictions without notice.

6. Subscriptions and Purchases

6.1 Plans

Vesto offers subscription plans and one-time credit packs, which provide headshot generation credits. Available options include weekly and monthly subscriptions, as well as one-time credit packs with no expiry date.

6.2 Billing

All purchases are processed through the Apple App Store or Google Play Store. By making a purchase, you agree to the payment terms of the applicable platform. We do not store or have access to your payment card information.

6.3 Subscriptions and Auto-Renewal

Subscription plans automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your device's App Store or Play Store account settings.

6.4 Refund Policy

All purchases are final and non-refundable, except as required by applicable law or as provided by Apple or Google's own refund policies. Unused credits do not carry over beyond the subscription period and are not reimbursable.

6.5 Price Changes

We reserve the right to modify pricing at any time. We will notify you in advance of any price changes affecting your active subscription. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.

7. Data Retention and Image Deletion

Generated headshots are automatically and permanently deleted from our servers 30 days after the date of generation. We strongly recommend downloading your images before this deadline. We are not responsible for any loss of content that has passed the retention period.

Input selfies are retained on our servers while your account is active and deleted upon account deletion.

8. Intellectual Property

8.1 Our Property

The Vesto name, logo, interface, underlying technology, and all associated intellectual property are owned by us and protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.

8.2 AI-Generated Content

While you retain rights to your Generated Content, we make no claim that all AI-generated output is entirely original or free from similarity to other outputs. We do not guarantee the uniqueness of any generated image.

9. Acceptable Use

You agree not to use Vesto to:

• Impersonate another person or create misleading representations of a real individual

• Generate content intended to deceive, defraud, or defame others

• Circumvent or attempt to circumvent any technical restriction or security measure

• Access the Service through automated means (bots, scrapers, scripts) without our written permission

• Violate any applicable local, national, or international law or regulation

• Resell or redistribute access to the Service without our authorization

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or available at all times

• AI-generated headshots will meet your expectations or professional standards

• The Service will be free from viruses or other harmful components

To the fullest extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or reputational harm, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vesto and its officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Third-Party Services

The App integrates with third-party services including Supabase, RevenueCat, and Sentry. Your interactions with these services are governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party service.

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if continued use poses a risk to other users or to the integrity of the Service.

You may delete your account at any time through the App settings. Upon account deletion, your data will be handled as described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or by email. The "Last updated" date at the top of this document reflects the most recent revision. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France.

If you are a consumer located in the European Union, you may also benefit from mandatory consumer protection provisions of the law of your country of residence.
