Interpretation and Definitions
Interpretation
Words with capitalized initial letters have meanings defined under the conditions below. The following definitions apply regardless of singular or plural usage.
Definitions
For the purposes of these Terms and Conditions:
Application: the software program provided by the Developer and downloaded by You on any electronic device.
Application Store: digital distribution service by Apple Inc. (App Store) or Google Inc. (Google Play Store).
Content: any content posted, uploaded, or made available by You, including text and images.
Device: any device accessing the Service (e.g., smartphone, tablet).
Feedback: suggestions or feedback provided by You regarding the Service.
In-app Purchase: purchases made through the Application.
Orders: requests made by You to purchase Goods.
Service: refers to the Application.
Subscriptions: paid access to parts of the Service.
Promotions: contests or offers provided via the Service.
Terms and Conditions / Terms: the entire agreement governing use of the Service.
Third-party Social Media Service: external services or content integrated with the Service.
You: the individual or entity accessing or using the Service.
Developer: the individual who owns and provides this Application, also referred to as "I", "Me", or "My".
Acknowledgment
By using the Service, You agree to these Terms. If You disagree with any part, you must not use the Service. You affirm that You are over 18 years old. Use of the Service also requires acceptance of the Privacy Policy.
Termination
I may suspend or terminate access without notice for violation of these Terms. Upon termination, access to the Service ceases immediately.
In-app Purchases
In-app Purchases are non-transferable and non-refundable unless required by law. Faulty purchases will be assessed and may be repaired or refunded via the Application Store.
Subscriptions
Subscription Period: Billed in advance on a recurring basis.
Renewal: Auto-renews unless canceled before period ends.
Cancellation: Manage via Account settings or Application Store.
Billing: Accurate billing information must be provided. App Store handles In-app billing.
Fee Changes: I may change fees with prior notice.
Refunds: Governed by Apple’s policies. Contact Apple for refund requests.
Refund Request Processing
I may share data with Apple including usage time, account status, and purchase details when processing refunds.
Intellectual Property
Service content and features are the property of the Developer. Unauthorized use is prohibited.
Links to Third-Party Sites
I am not responsible for third-party content, services, or privacy policies. Use them at your own risk.
Limitation of Liability
Liability is limited to the amount paid through the Service or $100. I am not liable for indirect, incidental, or consequential damages unless required by law.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided without warranties. I do not guarantee uninterrupted or error-free operation.
Governing Law
This agreement is governed by the laws of the Country, excluding conflict of law rules.
Dispute Resolution
Try to resolve issues informally by contacting Me before pursuing legal action.
EU Users
EU consumers retain rights under applicable consumer laws.
Legal Compliance
You confirm You are not under U.S. embargo or on restricted party lists.
Severability and Waiver
If any provision is invalid, the rest remain effective. Waivers of rights must be in writing.
Translations
The original English version of these Terms controls in disputes.
Changes to Terms
I may update Terms at any time. Continued use of the Service constitutes acceptance of changes.
Feedback Assignment
You grant the Developer a perpetual, royalty-free license to use your Feedback to improve the Service.
