Welcome to AeroHunter. These Terms and Conditions ("Terms") govern your access to and use of the AeroHunter mobile application (the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the Service.
1. Definitions
For the purposes of these Terms:
Application refers to the AeroHunter mobile application provided by the Company.
Application Store means Apple App Store, Google Play Store, or any other authorized digital distribution platform through which the Application is downloaded.
Company, We, Us, or Our refers to SWIFTFOLIO LIMITED, 306 Victoria House, Victoria, Mahé, Seychelles.
Device means any compatible smartphone, tablet, computer, or other electronic device capable of accessing the Service.
Service refers to the AeroHunter Application and all features made available through it.
You or User means any individual or legal entity using the Service.
2. Eligibility
You must be at least 18 years of age to use the Service.
By using AeroHunter, you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms.
3. Use of the Service
AeroHunter is provided solely for lawful personal use.
You agree not to:
use the Service for any unlawful or fraudulent activity;
interfere with or disrupt the normal operation of the Application;
attempt to gain unauthorized access to any part of the Service;
reverse engineer, modify, or exploit the Application except where permitted by applicable law.
You remain solely responsible for all activities performed through your use of the Service.
4. Third-Party Services
The Application may display or provide access to third-party websites, services, or content for your convenience.
These third-party services operate independently from AeroHunter. We do not control, endorse, or assume responsibility for their content, availability, privacy practices, or terms of use.
Your interactions with any third-party service are governed exclusively by that provider's own policies.
5. Intellectual Property
All intellectual property rights relating to the Application, including its design, software, trademarks, logos, graphics, and content, remain the exclusive property of the Company or its licensors.
These Terms do not grant you ownership of any intellectual property associated with the Service.
6. Suspension and Termination
We reserve the right to suspend or terminate access to the Service at any time if we reasonably believe that:
these Terms have been violated;
the Service is being misused;
continued access could affect the security, integrity, or operation of the Application.
Termination does not limit any rights or remedies available to the Company under applicable law.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, the Company disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, non-infringement, and uninterrupted operation.
We do not guarantee that:
the Service will always be available;
the Service will operate without interruption or error;
defects will be corrected immediately;
the Service will meet every user's expectations or intended purposes.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability arising from or relating to the Service shall not exceed:
the total amount you paid through the Application during the twelve (12) months preceding the claim; or
USD 100, if no purchase has been made.
Under no circumstances shall the Company be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, loss of data, or other intangible losses arising from your use of the Service.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
9. Privacy
Your use of AeroHunter is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.
By using the Service, you acknowledge that you have reviewed our Privacy Policy.
10. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Seychelles, without regard to conflict of law principles.
11. Dispute Resolution
If a dispute arises regarding the Service, both parties agree to first attempt to resolve the matter through good-faith communication before pursuing any formal legal proceedings.
If an amicable resolution cannot be reached, disputes shall be resolved in accordance with the applicable laws of Seychelles.
12. International Users
Users located outside Seychelles are responsible for ensuring that their use of the Service complies with all applicable local laws and regulations.
If you reside in the European Union, you retain any mandatory consumer rights granted under applicable EU legislation.
13. Export Compliance
You represent that you are not located in a country subject to applicable trade sanctions or export restrictions and are not listed on any governmental prohibited or restricted party list.
14. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal obligations, or business operations.
When significant changes are made, we will make reasonable efforts to notify users through the Application or other appropriate means before the updated Terms become effective.
Your continued use of the Service after any updates become effective constitutes your acceptance of the revised Terms.
