These Terms of Use and End User License Agreement ("Terms" or "EULA") govern your access to and use of AnimalBlast (the "Game" or "Licensed Application"), provided by ZemoLabs ("ZemoLabs," "we," "us," or "our").
By downloading, installing, accessing, purchasing content through, or using the Game, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, do not download, install, access, or use the Game.
These Terms are concluded between you and ZemoLabs only, and not with Apple Inc. ("Apple").
ZemoLabs, and not Apple, is solely responsible for the Game and its content, subject to these Terms and applicable law.
Your use of the Game through Apple platforms is also subject to the applicable Apple Media Services Terms and Conditions and App Store Usage Rules.
Subject to these Terms and applicable App Store rules, ZemoLabs grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, access, and use AnimalBlast for your personal, non-commercial entertainment.
For versions obtained through Apple's App Store, this license is limited to use of the Game on Apple-branded products that you own or control and as permitted by Apple's applicable Usage Rules, including any permitted use through Family Sharing or similar Apple services.
All rights not expressly granted to you are reserved by ZemoLabs and its licensors.
You agree to use the Game only for lawful purposes.
You must not:
Interfere with, disrupt, damage, or impair the operation of the Game or its services.
Attempt to gain unauthorized access to accounts, servers, networks, systems, or data.
Use cheats, bots, scripts, automation, exploits, modified software, or other methods designed to obtain an unfair advantage.
Reverse engineer, decompile, disassemble, modify, or attempt to derive the source code of the Game except to the extent expressly permitted by applicable law.
Copy, distribute, sublicense, sell, rent, or otherwise commercially exploit the Game except where expressly authorized by ZemoLabs.
Use the Game to violate the rights of ZemoLabs, another user, or any third party.
Use the Game in violation of any applicable laws or regulations.
We may restrict or terminate access to the Game where we reasonably determine that these Terms have been materially violated.
AnimalBlast may offer optional digital content, virtual currency, virtual items, features, subscriptions, or other in-app purchases.
Purchases made through Apple's App Store are processed by Apple and are subject to Apple's applicable payment and App Store terms.
Prices and other applicable purchase information will be displayed to you before you confirm a transaction.
Except as otherwise required by applicable law, virtual currency and virtual items:
Are licensed to you rather than sold.
Have no real-world cash value.
Cannot be exchanged for cash.
Cannot normally be transferred between users.
May only be used within the Game.
May be modified, replaced, limited, or discontinued as permitted by applicable law.
Where eligible, previously purchased content may be restored using the Game's Restore Purchases functionality or Apple's applicable purchase-restoration mechanisms.
AnimalBlast may offer auto-renewable subscriptions that provide access to premium features, content, virtual benefits, or other functionality for the applicable subscription period.
The subscription duration, price, included benefits, and any introductory offer or free-trial information will be displayed to you before you confirm your purchase.
When you purchase an auto-renewable subscription through Apple's App Store:
Payment is processed through your Apple Account.
Your subscription automatically renews for the applicable subscription period unless you cancel the subscription.
Renewal charges are processed by Apple according to the subscription terms displayed at the time of purchase and Apple's applicable policies.
You can view, manage, or cancel your subscription through your Apple Account subscription settings.
Cancellation stops future renewals but does not ordinarily provide a refund for the remaining portion of an existing subscription period, except where required by applicable law or provided under Apple's applicable refund policies.
If a free trial or introductory offer is provided, the subscription may convert to a paid subscription at the end of that offer unless it is cancelled in accordance with Apple's subscription rules.
Deleting or uninstalling AnimalBlast does not automatically cancel an active subscription. Subscriptions should be managed through your Apple Account.
Any refund request for a purchase processed through Apple is subject to Apple's applicable refund policies and procedures.
ZemoLabs, and not Apple, is responsible for providing maintenance and support services for AnimalBlast to the extent required under applicable law or otherwise provided by ZemoLabs.
You acknowledge that Apple has no obligation to furnish maintenance or support services with respect to the Game.
For support relating to AnimalBlast, you may contact ZemoLabs using the contact information provided at the end of these Terms.
We may periodically update the Game to add, remove, modify, improve, or correct features, functionality, content, balancing, virtual items, technical systems, or security measures.
We may also modify, suspend, restrict, or discontinue portions of the Game or its online services where reasonably necessary.
We do not guarantee that every feature, service, virtual item, level, online function, or other component of the Game will remain available indefinitely.
Nothing in this section limits any rights you may have under applicable consumer law.
AnimalBlast and all intellectual property associated with it, including its software, source code, designs, artwork, graphics, characters, animations, audio, music, text, gameplay elements, user interfaces, logos, trademarks, and other content, are owned by or licensed to ZemoLabs and are protected by applicable intellectual-property laws.
Except for the limited license expressly granted under these Terms, no ownership rights or intellectual-property rights are transferred to you.
If a third party claims that the Game or your possession or use of the Game infringes that third party's intellectual-property rights, ZemoLabs, and not Apple, will be responsible for the investigation, defense, settlement, and discharge of such intellectual-property infringement claim to the extent required by applicable law.
The Game may use or provide access to third-party services, software, platforms, payment processors, analytics providers, authentication systems, cloud infrastructure, advertising services, purchase-management providers, or other external services.
These may include Apple and other service providers.
Your use of third-party services may be subject to separate terms, conditions, and privacy policies provided by those third parties.
You agree to comply with all applicable third-party terms when using the Game.
ZemoLabs is not responsible for third-party services to the extent permitted by applicable law.
Your use of AnimalBlast may involve the processing of information as described in the AnimalBlast Privacy Policy.
Please review the Privacy Policy to understand what information may be collected, how it is used, and your applicable rights.
Third-party services integrated into the Game may process information according to their own privacy policies.
To the maximum extent permitted by applicable law, AnimalBlast and its services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, except for warranties that cannot lawfully be excluded.
ZemoLabs does not warrant that the Game will always be uninterrupted, error-free, secure, or available.
If the Game fails to conform to any applicable warranty and you obtained the Game through Apple's App Store, you may notify Apple, and where applicable Apple may refund the purchase price paid for the Licensed Application.
To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to AnimalBlast.
Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty will be the responsibility of ZemoLabs to the extent required by applicable law.
Nothing in these Terms excludes or restricts any mandatory consumer rights available to you under applicable law.
You acknowledge that ZemoLabs, and not Apple, is responsible for addressing claims relating to AnimalBlast or your possession or use of AnimalBlast, including, where applicable:
Product liability claims.
Claims that the Game fails to conform to applicable legal or regulatory requirements.
Claims arising under consumer-protection, privacy, or similar laws.
Nothing in these Terms limits ZemoLabs' liability beyond what is permitted under applicable law.
To the maximum extent permitted by applicable law, ZemoLabs will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from or relating to your use of or inability to use the Game.
These limitations do not apply where liability cannot legally be excluded or limited, including any mandatory rights available under applicable consumer-protection laws.
By using AnimalBlast, you represent and warrant that:
You are not located in a country or territory that is subject to a United States Government embargo or that has been designated by the United States Government as a country supporting terrorism; and
You are not listed on any United States Government list of prohibited or restricted parties.
You are also responsible for complying with all laws and regulations applicable to your use of the Game.
These Terms remain effective while you use AnimalBlast.
You may terminate your use of the Game at any time by discontinuing use and uninstalling the Game.
ZemoLabs may suspend or terminate your access to the Game if you materially violate these Terms, engage in fraudulent or unlawful activity, interfere with the operation of the Game, or where suspension or termination is otherwise permitted by applicable law.
Termination does not automatically cancel an active subscription. Subscriptions purchased through Apple must be managed or cancelled through your Apple Account subscription settings.
If you download or use AnimalBlast through Apple's App Store, you acknowledge and agree that:
These Terms are between you and ZemoLabs, not Apple.
ZemoLabs, not Apple, is responsible for AnimalBlast and its content.
Apple has no obligation to provide maintenance or support services for AnimalBlast.
ZemoLabs is responsible for addressing applicable claims relating to AnimalBlast, including product liability, legal or regulatory compliance, consumer-protection, privacy, and intellectual-property claims, to the extent required by applicable law.
Your use of AnimalBlast must comply with Apple's applicable App Store and Apple Media Services terms.
Apple and its subsidiaries are third-party beneficiaries of these Terms.
You and ZemoLabs acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.
Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

ZemoLabs may update these Terms from time to time to reflect changes to the Game, applicable laws, regulatory requirements, or business practices. When these Terms are updated, the revised version will be made available with an updated effective date.
Your continued use of the Game after the revised Terms become effective constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.
