In 1962, shortly after leaving school and supporting himself with a series of clerical jobs, Ward formed a beat band Cliff Ward and the Cruisers, which won the 1963 Midland Band of the Year contest in Birmingham.[2] The band was popular in Birmingham and also in demand at American Army bases in France. It was during this time abroad that Ward wrote "Home Thoughts from Abroad" (a song that would later appear on his second solo album and also as the B-side of "Gaye"). In the mid-1960s and after several member changes, the group was renamed Martin Raynor and The Secrets, with Ward in the role of the elusive Raynor. The fictitious name was soon dropped and the band continued on as Raynor's Secrets and as Simon's Secrets, and went on to tour around Britain and France, achieving moderate success. Along the way, six singles were recorded by the group (ten of the songs penned by Ward himself), though these made little impact.[4]

In his spare time, he continued songwriting and recorded his first solo album Singer Songwriter, released in 1972 on Dandelion Records (a label formed by the disc jockey John Peel) just before it went into liquidation.[4] As a result, the album received little media coverage and went largely unnoticed. Signing a new recording contract with Charisma Records, Ward went on to have a hit with the single "Gaye".[4] It sold over a million copies worldwide and reached number 8 in the UK Singles Chart in July 1973.[1]

In July 1973, following the success of "Gaye", Ward's second album Home Thoughts achieved healthy sales and reached number 40 in the UK Albums Chart.[1] At this point, he gave up the teaching profession to concentrate on music full-time. He made a rare public appearance in July, performing "Gaye" on Top of the Pops.[5] According to Allmusic, the song "Wherewithal" from the Home Thoughts album is "infectious and lyrically excellent" and it was surprising that it failed to chart.[4] In January 1974, Ward entered the UK singles chart again at number 37 with "Scullery",[1] a track from his third album Mantle Pieces.[6]

On Monday, Sheeran even played songs by him and others to show what is widely recognized as a common building block in popular music -- the four chord progression.

In fact, it sounds so much like the Marvin Gaye song that Robin Thicke and the other guys behind Blurred Lines have launched a preemptive strike: They filed a lawsuit against Marvin Gaye's family. Thicke and the other plaintiffs don't want money; they want the court to rule that "Blurred Lines" does not infringe on "Got to Give It Up."

At question was whether Sheeran's 2014 hit "Thinking Out Loud" cribbed from the 1973 classic. Jurors decided that Sheeran, 32, independently created his song and was not liable for copyright infringement.

Gaye's record label, Tamla, was an imprint of Motown Records, and as such Gaye's work was guided and supervised by legendary Motown founder Berry Gordy. Gaye's early music, like that of many Motown artists, was innovative and increasingly sensual but hardly political.

"What's Going On?" originated with Ronaldo "Obie" Benson, a member of the Motown group the Four Tops, who penned an early version after witnessing police violence against anti-Vietnam War protesters in Berkeley, California. Benson took the song to Gaye, whose brother had recently returned from the war and whose cousin had died in it, and Gaye made it his own. The song's lyrics both implicitly references the violent rifts in American society ("Mother, mother/ there's too many of you crying") and explicitly questions the war ("We don't need to escalate ... war is not the answer/ for only love can conquer hate"). These lyrics made it ripe for controversy, enough that Gordy discouraged Gaye from recording the song, saying "Don't be ridiculous. That's taking things too far."

Ultimately, Gaye went on a recording strike to force Gordy to release "What's Going On?" Not many artists had the gumption or the clout to stand up to Gordy, and as such the single's release foreshadowed his future disagreements with Gordy and eventual split with Motown. The single reached number 2 on the Billboard Hot 100 chart and would go on to be named the fourth-greatest song of all time by Rolling Stone. The album What's Going On, released the following May, was a concept album that further explored Gaye's opposition to the war as well as other sensitive topics like poverty and drug use. The song "Mercy Mercy Me (The Ecology)" is one of the earliest examples of environmentalist messaging in mainstream pop music. Critics continue to rate the album and its title track among the most influential recordings in modern musical history.

Hi Joe, I think the fact that this was a jury trial decision where all the jurors would have heard both tracks is relevant, even if they were told to stick to the paperwork. I am strongly of the opinion that a generic groove cannot be copyright protected, HOWEVER, the original here is a completely unique track and it is impossible to think of any another song that Blurred Lines has strayed too close to, thus suggesting that it trades off the original. The settlement at 50% is the same as would be standard for a sample, a fact which was explained to the jury, who obviously felt there was a substantial similarity between the footprints of the two works, and exceptionally I believe this is the right result. While it gives rise to a concern about a flood of such cases, I do not believe it will inevitably lead to that, as this is a very exceptional example. e24fc04721
