• The war is entirely over. The Nazis and Japanese lost.

• Many former Nazi leaders have been captured. Many of these men ordered the attempted extermination of the Jewish people.

• You are leading a tribunal in the German city of Nuremberg, attempting to prosecute these Nazis.

• Their defense is that they broke no law, rather they were being obedient to German law, doing that which they were ordered to do.

• All agree that nulla poena sine lege (no one can be punished unless they broke a law) The Nazis wished to be told what law they broke? Without that, they cannot be labeled "criminals."
