These terms and conditions apply to the 120 FPS Tool - GFX Config mobile application for Android devices, together with any related services (collectively, the "Application"). The developer/operator of the Application is hereby referred to as the "Service Provider".
By downloading, installing, or using the Application, you agree to be bound by these Terms and Conditions. You should read them carefully before using the Application.
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on your mobile device solely for personal, non-commercial purposes.
You may not:
Reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except and only to the extent expressly permitted by applicable law.
Attempt to extract the source code, modify binary assets, or translate the Application into other languages without prior written consent.
Rent, lease, lend, sell, redistribute, or sublicense the Application.
The Service Provider retains all right, title, and interest in and to the Application, including all software, source code, UI/UX designs, graphics, icons, trademarks, service marks, logos, and trade names (the "Intellectual Property").
Nothing in these Terms grants you any right to use the Service Provider's branding, logos, or trademarks for any purpose. You agree not to remove, obscure, or alter any copyright, trademark, or other proprietary notices contained in or on the Application.
The Application functions strictly as a device resource optimizer (RAM management, background process regulation, cache monitoring, and real-time performance display).
Fair Play Compliance: The Application does NOT hack, modify third-party game files, bypass in-game anti-cheat mechanisms, alter server-side data, or provide unfair advantages in online games.
Hardware Limitations: The ability to achieve and maintain high frame rates (such as 90 FPS, 120 FPS, or 144 FPS) depends entirely on your device’s physical hardware specifications (GPU capabilities, thermal architecture, and screen refresh rate panel). The Service Provider does not guarantee that every device will reach or sustain maximum frame rates.
Third-Party Trademarks: All game titles, logos, brand names, and related intellectual property referenced within the Application belong strictly to their respective owners. Any mention of third-party games is solely for identification and compatibility purposes.
Rooting / Jailbreaking: The Service Provider strongly advises against rooting your device. Removing system-level restrictions may cause the Application to malfunction, trigger false positives in third-party security systems, or compromise device security. The Service Provider accepts no liability for device instability caused by root modifications.
Internet Connection & Data Usage: Certain features (such as latency testing, performance data sync, or ad delivery) require an active internet connection. You are solely responsible for any carrier data charges or roaming fees incurred while using the Application.
Thermal Management: Running resource-intensive games at high refresh rates increases battery consumption and generates heat. It is your responsibility to monitor your device's operating temperature.
The Application integrates trusted third-party SDKs to provide core functionalities, crash analytics, and ad delivery:

These third-party providers handle technical data in accordance with their respective privacy policies.
To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Data loss or temporary device slowdowns.
Account penalties or suspensions imposed by third-party game publishers due to the misuse of overlay features or system tools.
Battery wear or hardware overheating resulting from extended intensive device usage.
In all cases, the Service Provider's total aggregate liability for any claims arising under these Terms shall not exceed the amount paid by you (if any) to the Service Provider for the Application in the 12 months preceding the claim, or the minimum amount required by applicable law.
In compliance with Regulation (EU) 2022/2065 (Digital Services Act):
Single Point of Contact: You may contact the Service Provider directly regarding inquiries, feedback, or notices of unlawful content via email at support@novaflarestudio.us.
Notice and Action: If you believe any content or feature within the Application violates applicable law, you may submit a notice to our contact email. All inquiries will be processed promptly and diligently.
Out-of-Court Dispute Settlement: Users within the European Union have the right to select an accredited out-of-court dispute settlement body to resolve disputes related to service restrictions or moderation actions.
The Service Provider reserves the right to update, modify, or discontinue the Application at any time without prior notice. You are encouraged to install all available updates to ensure optimal performance and compatibility.
The Service Provider may terminate your access to the Application immediately if you breach these Terms. Upon termination, all licenses granted to you will end, and you must remove the Application from your device.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in full force and effect. These Terms constitute the complete agreement between you and the Service Provider regarding the Application.
The Service Provider may update these Terms and Conditions periodically. Any updates will be posted directly on this page. Continued use of the Application after changes are published constitutes your acceptance of the revised Terms.
