Ref. C&R Art VII, Section 2: “Section 2. Review by Architectural Control Committee. No building, fence, wall or other structure following the sale of all Lots within Turnberry shall be commenced, erected or maintained upon any Lot, nor shall any exterior addition to or change or alteration therein be made until the plans and specifications showing the nature, kind, shape, height, material and location of the same shall have been submitted to and approved in writing as to the harmony of external design and location in relation to surrounding structures and topograph(y) to the Architectural Control Committee. In the event that the Architectural Control Committee shall fail to approve or disapprove such design and location within forty-five (45) days after said plans and specifications have been submitted to the Architectural Control Committee, or in any event, if now suit to enforce the provision of this Sections shall have been commenced within ninety (90) days after the completion of any addition, alteration or change then said approval would not be required and the provisions of this Section shall be deemed to have been met. The Architectural Control Committee shall have no authority or jurisdiction over the initial development work of the Developer or Developer’s designee or successor in any Phase of Turnberry Residential Development.”
