Privacy Policy for BGov

We respect your privacy and are committed to protecting your personal information/data. This Privacy Policy explains how LabPH, Inc., a corporation registered under the laws of the Republic of the Philippines, with Securities and Exchange Commission Registration No. CS201617940, through the BGov application (the “BGov App” or the “App”), part of the LifeCert digital ID system processes, e.g., collects, uses, shares, protects and disposes, your information. We follow the Data Privacy Act of 2012, its Implementing Rules and Regulations, and the guidelines of the National Privacy Commission (the “NPC”).
1. What Personal Data We Collect
The information we collect from the you may either be Personal Information and/or Sensitive Personal Information, as defined in the Data Privacy Act of 2012:
Personal Information refers to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.
Sensitive Personal Information refers to personal information:
About an individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations;
About an individual’s health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings;
Issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and
(4) Specifically established by an executive order or an act of Congress to be kept classified.
When you use the BGov App, we may collect, among others, the following data:
Identity Information
Your full name, birthdate, place of birth, sex, civil status, nationality, and ID numbers (e.g., PhilSys, Passport, Driver’s License, etc.)
Contact Information
Your home address, mobile number, and email address.
Biometric Information (if enabled and with consent)
Such as your facial photo or fingerprint, used only for secure ID verification.
Government Records
Details from documents you submit, such as barangay certificates, health records, or social service records.
Activity Data
When and how you use the app, such as login time, services accessed, and feedback submitted.
2. Why We Collect Your Data
We collect and process your personal data to:
Create and manage your digital ID profile
Allow you to access public services online and in person
Help government ministries verify your identity
Enable e-government transactions like requesting documents or claiming benefits
Improve the design and delivery of public services in BARMM
3. How we collect and use your Data
If you decide to register and create a BGov account, we will have to collect, process, and share various types of information from you. We will only collect personal information from you when you give your express consent. The information we obtained from you will only be kept and used for the purposes to which they are intended. We collect your Data through the following means:
When you register in the App;
When you upload or provide us information or documents in order to validate your identity;
When you provide us information through text messages, email, or phone calls with our authorized representatives, if necessary;
When you grant us permission using your device to collect information from you; or
When you reach out to us through the App or through our official contact information.
4. How We Protect Your Data
We treat with utmost integrity and confidentiality all information we collect from you. We use multiple layers of protection to keep your data safe:
We strictly use encryption to secure your information during storage and transmission
We implement access controls to make sure only trained, authorized staff can view your data
We undergo regular audits and system checks to prevent and detect any misuse or breaches
5. Who We May Share Your Data With
We will never sell or share your personal data to third parties, except in circumstances where you have given your consent or under circumstances provided by present law and regulations. All information obtained from you will be held with the utmost confidentiality. However, your data may be shared with the following as part of business operations and in the provision of our products and services:
BARMM government ministries and LGUs that require your data to deliver public services (e.g., health, education, social welfare, etc.)
National government agencies, relevant law enforcement agencies, and courts, if needed for identity validation (e.g., PSA, MILG, etc.), if required by law or in order to protect the rights and ensure the safety of our users.
Authorized technology and security partners that help us manage and secure the system (under strict confidentiality agreements) to protect against any possible threat of fraud and abuse.
Other companies whom you have given consent to share your information.
6. How long do we keep and how we delete your personal information
Pursuant to the Data Privacy Act of 2012, the personal information we obtained from you will be retained only for as long as necessary for the fulfillment of the purposes for which the data was obtained or for the establishment, exercise or defense of legal claims, or for legitimate business purposes, or as provided by law.
Once the purpose to which your personal data has been obtained or unless storage is required by law, we will erase and destroy your personal information from our data processing system securely to prevent it from being further used and disclosed.
7. Your Rights as a Citizen
Under the law, you have the right to:
be informed whether personal data pertaining to you shall be, are being, or have been processed (Right to be informed)
object to the processing of your personal data where such processing is based on consent or legitimate interest (Right to object)
access information on the processing of your personal data shall be subject to the following guidelines prescribed by law (Right to access)
dispute the inaccuracy or error in your personal data and have the us correct the same within a reasonable period of time. (Right to rectify)
request for the suspension, withdrawal, blocking, removal, or destruction of your personal data from our filing system, in both live and back-up systems (Right to erasure or blocking)
obtain from the us a copy of your personal data and/or have the same transmitted from us to another Company, in an electronic or structured format that is commonly used and allows further use by you as the data subject (Right to data portability)
be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal data, taking into account any violation of your rights and freedoms as data subject (Right to damages)
file a complaint with the NPC if you believe your rights are violated or that you are affected by a privacy violation or data breach (Right to file a complaint)

9. Updates to This Policy
We may update this Privacy Policy to reflect changes in our services or to comply with legal requirements. When we do, we will notify you through the App or through our website.
