  Effective January 1, 2022:

UPDATED POSTERS for Wage &
Hour, Paid Sick Leave and Updated Vacation Pay Rule

from the CDLE Division of Labor Standards & Statistics

Colorado employers must post and provide to employees the newly published 2022 COMPS Order #38 and Colorado Paid Sick Leave & Whistleblower posters in accordance with Colorado law.

The Division has also published an update to Colorado Wage Protection Rule 2.17 to clarify the definition of “vacation pay” under Colorado law. Rule 2.17.1 now states that “‘Vacation pay’ is pay for leave, regardless of its label, that is usable at the employee’s discretion . . ., rather than leave usable only upon occurrence of a qualifying event (for example, a medical need, caretaking requirement, bereavement, or holiday).”  As a reminder, the Colorado Wage Act requires that all earned, unused vacation pay must be paid to employees upon separation of employment.

For more information regarding labor law posting requirements and vacation pay, please refer to the Division’s website or call 303-318-8441 to speak with a Compliance Investigator.
