With the recent passage of HB 22-1278, the Colorado Department of Public Health and Environment (CDPHE) will be coordinating with the future Behavioral Health Administration (BHA) to ensure a seamless transition of Behavioral Health Entity licensing oversight from CDPHE's authority, to the authority of the BHA. As per HB 23-1236, that authority will begin as of January 1, 2024. Any new initial BHE licenses, or BHE license renewals, will be issued through the BHA as of that date. CDPHE will maintain authority over CDPHE-issued BHE licenses until such time the license is renewed with the BHA.

The Licensing and Designation Database and Electronic Records System, or “LADDERS,” completed an update on November 15, 2023, that allows initial applications to be submitted in alignment with the recently adopted BHA Provider Rules.
All agencies that qualify as a Behavioral Health Entity (BHE) will be required to complete an initial application for a BHE license under the Behavioral Health Administration (BHA)’s purview during the 2024 calendar year. This includes agencies that are currently licensed as BHEs by the Colorado Department of Public Health and Environment (CDPHE).
