8-1C-1: RATES AND CONNECTION FEES:
The rates, penalty fee for delinquency in payment, connection fee, reservoir fee, inspection fee, returned check fee, turnon and turnoff fee, and other charges incidental to connection and service from the municipal water system, shall be fixed from time to time by resolution or ordinance enacted by the governing body. The governing body may from time to time promulgate rules for levying, billing, guaranteeing and collection charges for water services and all other rules necessary for the management and control of the water system. Rates for services furnished shall be uniform with respect to each class or classes of service established or that may hereafter be established. The current rates for connection onto the water system and the monthly rates are as follows: (Ord. 2007-07, 6-20-2007)
A. Within City Limits:
1. Minimum Monthly Rate; Single-Family Dwelling: The minimum monthly rates for a base of twenty thousand (20,000) gallons of culinary water for a single-family dwelling shall be set as follows:
2. Minimum Monthly Rate; Multiple-Family Dwelling: The minimum monthly rate of twenty nine dollars fifty cents ($29.50) per month per housing unit, for a multiple-family dwelling;
3. Base Limit Allotted: Each housing unit will be allotted a base limit of twenty thousand (20,000) gallons of water per month;
4. Overage Charges: For all water used in excess of twenty thousand (20,000) gallons per month, the monthly overage charges shall be as follows:
20,001 to 50,000 gallons
50,001+ gallons
$0.60 per 1,000 gallons
0.80 per 1,000 gallons
5. Hookup Fees:
For any hookup fee in excess of a 2 inch meter, the city council will set a hookup fee when the need arises.
B. Outside City Limits:
1. A minimum monthly rate for a base of twenty thousand (20,000) gallons of culinary water for a single-family dwelling shall be set as follows:
2. A minimum monthly rate of fifty nine dollars ($59.00) per month per housing unit, for a multiple-family dwelling;
3. Each housing unit will be allotted a base limit of twenty thousand (20,000) gallons of water per month;
4. For all water used in excess of twenty thousand (20,000) gallons per month, the monthly overage charges shall be as follows:
20,001 to 50,000 gallons
50,001+ gallons
$1.20 per 1,000 gallons
1.60 per 1,000 gallons
5. The city has no intent of allowing additional hookups onto the culinary water system in the future outside the city limits. However, if the city council should determine there is a need in the future, the hookup fee will be determined at that time. (Ord. 2010-02, 7-7-2010, eff. 8-1-2010)
8-1C-2: FEES FOR TURNING WATER ON AND/OR OFF:
Any time city personnel is requested to turn water on and/or off or make a meter reading, there will be no charge, providing the request is made through the city office with a minimum of twenty four (24) hours' advance notice. Any time city personnel is requested to turn water on and/or off or make a meter reading, without twenty four (24) hours' advance notice, there will be a twenty five dollar ($25.00) charge added to their utility account. 8-1C-3: SPECIAL RATES:
The governing body may from time to time fix by agreement, resolution or ordinance a special rate or rates and conditions for users using exceptionally large amounts of water service or making use of the water system under exceptional circumstances, upon such terms and conditions as they may deem proper. 8-1C-4: BOARD OF EQUALIZATION TO HEAR COMPLAINTS, CORRECTIONS:
The governing body is constituted a board of equalization of water rates to hear complaints and make corrections of any assessments deemed to be illegal, unequal or unjust. They may, if they see fit, rebate all or any part of the water bill of any indigent person. (1991 Code § 13.08.090, as amended)
8-1C-5: USE WITHOUT PAYMENT PROHIBITED:
It is unlawful for any person by himself, family, servants or agents to utilize the municipal water or sewer system without paying therefor, as provided in this chapter, or without authority, to open any fire hydrant, stopcock, valve or other fixtures attached to the system of water supply, unless it is done pursuant to proper approval, application, agreement or resolution. It is unlawful to injure, deface or impair any part or appurtenance of the water or sewer systems, or to cast anything into any reservoir or tank belonging to the water system. Violation of this section shall be a class C misdemeanor and, upon conviction, subject to penalty as provided in section 1-4-1 of this code. (1991 Code § 13.08.100, as amended; amd. 2009 Code)
8-1C-6: DELINQUENCY; DISCONTINUANCE OF SERVICE:
A. Statement Of Charges: The city recorder or water superintendent shall furnish to each user, or mail to, or leave at his place of residence or usual place of business, a written or printed statement stating thereon the amount of water service charges (and charges for other services may also be included) assessed against him once each month or at such other regular interval as the governing body shall direct.
B. Failure To Pay By Due Date: If the user fails to pay, within twenty five (25) days of the due date, which due date is specified to be twenty five (25) days from the billing date as indicated on the billing form, the charges due for municipal utility services received by user or entity as indicated on the statement furnished by the city, the city treasurer, city recorder or city manager shall give the user or entity notice in writing of intent to disconnect (or turn off) water service to the premises of the user. Unless the amount due is paid in full within fifteen (15) days of the date of the shutoff notice, the water service to the user will be shut off until such time as the amount owed the city has been paid in full, including, but not limited to, all delinquencies, shutoff fees, turnon fees and any applicable deposits imposed, or until any failure to conform to this chapter, or resolutions issued thereunder is eliminated.
C. Interest Penalty: Any utility account becoming delinquent, and with an account balance remaining due in excess of sixty (60) days from the date of billing, shall be subject to an interest penalty of one and one-half percent (11/2%) per month (18 percent APR) on the unpaid or delinquent arrears balance for utility services provided by the city, from the sixty first day until paid.
D. Disconnect Of Service; Charges: If the water service is thereafter disconnected for failure to make payment, then before the water service to the premises shall again be provided, all delinquent water charges must have been paid to the city treasurer or arrangements made for their payment in a manner satisfactory to the city. In the event water is turned off for nonpayment of water charges, then before the water service to the premises shall again be provided, the user shall pay, in addition to all delinquent water charges, a water turnoff fee of one hundred dollars ($100.00) and water turnon fee of one hundred dollars ($100.00), such fee being subject to change by the governing body from time to time by resolution or ordinance. Furthermore, in addition to such payments and penalties, a delinquent user may be required to file a new application and may further be required to file a utility deposit with the city. The city recorder is authorized and empowered to enforce the payment of all delinquent water charges by an action at law in the name of the city. (1991 Code § 13.08.110, as amended)
