The worst state crime of all is invasion of another country but International Law as enshrined in the UN Charter only permits this in certain circumstances (and then only after serious negotiations):

(1) if there is UN permission;

(2) if the invading country has been invaded;

(3) if the invading country has been invited to invade by the government.

UN permission does not excuse war crimes – thus, for example, the UN permitted:

(e) partition of Palestine in 1948 that led to massive and continuing ethnic cleansing of Indigenous Palestinians who represented 98% of the population in 1870 and 70% of the population in 1947. Today in 2015 the genocidally racist Israelis have ignored numerous subsequent UN decisions; ethnically cleansed 90% of Palestine by military takeover, “Jews-only” highways, the obscene Apartheid Wall and related barriers, village, farm and home destruction, and by illegal settlements; ensured that of 12 million Palestinians, 6 million are forbidden to step foot in their own country, 4.3 million exist without human rights as prisoners without charge or trial in the blockaded Gaza Concentration Camp (1.8 million) or in West Bank Bantustan ghettoes (2.5 million), and only 1.7 million Palestinians Israelis (14% of Palestinians and 28% of Palestinian subjects of Apartheid Israel) are permitted to vote for the government ruling all of Palestine, albeit as Third Class citizens under Nazi-style Apartheid laws. The annual per capita GDP is $2,900 for Occupied Palestine, 13 times lower than for Apartheid Israel ($38,000) that continues to steal land, steal water and impose a Nazi-style Apartheid regime on Occupied Palestinians of whom it kills 1,000 violently each year and kills 4,000 non-violently each year through imposed deprivation. Half the Palestinians are children and most of those in the blockaded Gaza Concentration Camp are badly traumatized by repeated Israeli Gaza Massacres involving shelling, rocketing or bombing from IDF tanks, ships or planes.

“State crime” or “state terrorism” by a national government involves:

(a) war criminal invasion of other countries with attendant gross human rights abuses of which the most egregious are deaths from violence or avoidable deaths from violently-imposed deprivation (e.g. Muslim deaths totalling 5 million from violence and 27 million from imposed deprivation in 20 significantly or substantially Muslim countries invaded by the US Alliance the 21st century Zionist-backed US War on Muslims; see Gideon Polya, “Paris Atrocity Context: 27 Million Muslim Avoidable Deaths From Imposed Deprivation In 20 Countries Violated By US Alliance Since 9-11”, Countercurrents, 22 November, 2015: http://www.countercurrents.org/polya221115.htm ) ;

(b) subjugation of it its own people involving human rights abuse and active killing through violence (as in civil wars), and passive killing through imposed deprivation (e.g. 30 million Chinese dead from deprivation in the Great Leap Forward and an estimated 350 million Indian avoidable deaths from deprivation since Independence and about 4 million Indian currently dying thus each year; Gideon Polya, “Body Count. (c) inflicting such atrocities on its own people or other peoples by variously exciting non-state terrorism (e.g. exciting Sunni insurgency and thence ISIS through the horrendous invasion of Iraq and Iraqi Genocide by the US Alliance), permitting or supporting non-state terrorism (state-sponsored non-state terrorism e.g. support for jihadi or other insurgents in Syria by various members of the US Alliance, most notoriously Turkey and Saudi Arabia) or indeed by covertly or overtly encouraging state terrorism by another national government (e.g. the US secretly permitting the Japanese attack on Pearl Harbor that precipitated US entry into WW2 , US training and backing government torturers and death squads in Latin America, and US green-lighting the Iraqi invasion of Kuwait);

(d) passively inflicting harm on others by depraved indifference to corporate terrorism (e.g. carbon terrorism and climate terrorism) and actively inflicting harm on others by neoliberal, corporatist, anti-Humanity, anti-Biosphere, and pro-pollution state policies,\. Thus each year about 0.5 million people die from climate change (with 10 billion to die thus this century in a worsening climate genocide if man-made climate change is not requisitely addressed) , 7 million die from air pollution, and 17 million people die from deprivation on Spaceship Earth with with variously ecocidal, speciescidal, ethnocidal, genocidal, omnicidal, terracidal, neoliberal, war criminal and climate criminal governments and corporations in charge of the flight deck - hence the largely self-explanatory terms climate terrorism (terrorism via climate change), carbon terrorism (terrorism via carbon fuel burning), corporate terrorism (terrorism via deadly corporate activity), ecoterrorism (terrorism via ecosystem destruction), ethnoterrorism (ethnicity-based terrorism), bioterrorism (terrorism via biological agents or via deadly changes to the biosphere) , and xenoterrorism (terrorism via dangerous biological or chemical agents);

(e) nuclear terrorism is an existential threat to humanity - while poverty kills 17 million people each year, and unaddressed man-made climate change may wipe out all but 0.5 billion people this century , nuclear war and consequent nuclear winter may almost completely wipe out Humanity and much of the Biosphere.

“Non-state terrorism” or “terrorism” are loaded terms variously applied to various intranational or international situations:

(a) intranational insurgency for a political cause and/or ethnic independence against a persecuting national government, a foreign occupier or a foreign-backed national government (e.g. the French Resistance in WW2; one man’s freedom fighter is another man’s terrorist and typically “terrorists” in the Western perception are people the US Government does not like at the time e.g. US-opposed jihadi terrorists versus US-backed insurgents in Syria);

(b) international, ideology-cemented actions (e.g. jihadi terrorists responding to European occupation or domination of Muslim countries);

(c) intranational actions against soft civilian targets in support of particular political, nationalist or ideological causes (e.g. anti-imperialism, pro-ethnic independence or anti-abortion atrocities ); and

(d) state-sponsored non-state terrorism involving overt or covert state support for terrorism in categories (a)- (c) (e.g. US support for Al Qaeda, the Taliban and the mujaheddin in Russian-occupied Afghanistan, and different members of the US Alliance – the US, UK, France, Australia, Turkey, Qatar, Saudi Arabia, Apartheid Israel, and Jordan - variously supporting anti-Government insurgents in Syria from the Free Syrian Army to ISIS);

(e) false flag terrorist operations (e.g. US-run bombing of Catholic churches in Ecuador so that socialists would be blamed; US Alliance Gladio atrocities in post-war Europe that were blamed on communists; and numerous science, engineering, architecture, medical , aviation, military and intelligence experts conclude that the US Government was responsible for the 9-11 atrocity; see “Experts: US did 9-11”: https://sites.google.com/site/expertsusdid911/ );

(f) each year about 0.5 million people die from climate change (with 10 billion to die thus this century in a worsening climate genocide if man-made climate change is not requisitely addressed) , 7 million die from air pollution, and 17 million people die from deprivation on Spaceship Earth with with variously ecocidal, speciescidal, ethnocidal, genocidal, omnicidal, terracidal, neoliberal, war criminal and climate criminal governments and corporations in charge of the flight deck - hence the largely self-explanatory terms climate terrorism (terrorism via climate change), carbon terrorism (terrorism via carbon fuel burning), corporate terrorism (terrorism via deadly corporate activity), ecoterrorism (terrorism via ecosystem destruction), ethnoterrorism (ethnicity-based terrorism), bioterrorism (terrorism via biological agents or via deadly changes to the biosphere) , and xenoterrorism (terrorism via dangerous biological or chemical agents).

While the evil of non-state terrorism has been largely successfully countered in Western countries by top-down state action involving education, high technology intelligence, intranational and international intelligence sharing, and skilled counter-terrorism forces, countering the vastly more deadly evil of state terrorism or state crime requires peaceful, bottom-up action by billions of ordinary people world-wide:

(a) to expose and oppose state terrorism by informing everyone they can;

(b) to demand rigorous and universal state respect for the UN Charter, International Law, the Universal Declaration of Human Rights, the Geneva Convention, the UN Genocide Convention, the Rights of the Child Convention and indeed all UN human rights conventions;

(c) to urge and apply the peaceful approach of Boycotts, Divestment and Sanctions (BDS) against all people, politicians, parties, companies, corporations and countries involved or complicit in state terrorism, including war crimes and state sponsorship of non-state terrorism.

State crimes can be described in terms of human rights abuse, torture, killing, holocaust, genocide, refugees, violent deaths and avoidable deaths (avoidable mortality, excess deaths, excess mortality, premature deaths, untimely deaths, deaths that should not have happened)from imposed deprivation.

State crimes can also include the depraved indifference of governments of prosperous countries to preventable deaths - deaths that could be substantially prevented by applying more fiscal resources to, for example, education, preventive medicine and health services. Thus 1.7 million Americans die preventably each year and 85,000 Australians die preventable annually, despite the reality that the US and Australia are among the richest countries per capita in the world.

In this context, “holocaust” means the death of large numbers of people whereas “genocide” is defined by Article 2 of the UN Genocide Convention thus: “In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnic, racial or religious group, as such: a) Killing members of the group; b) Causing serious bodily or mental harm to members of the group; c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; d) Imposing measures intended to prevent births within the group; e) Forcibly transferring children of the group to another group” . Article 3 states that “The following acts shall be punishable: (a) Genocide; (b) Conspiracy to commit genocide; (c) Direct and public incitement to commit genocide; (d) Attempt to commit genocide; (e) Complicity in genocide”; Article 4 states that “Persons committing genocide or any of the other acts enumerated in Article 3 shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals” ( UN Convention on the prevention and punishment of the crime of genocide, UN: http://www.hrweb.org/legal/genocide.html ).

“Intent to destroy ” is rarely established by explicit statement by the perpetrators (who typically do not want to boast about committing genocide) but is typically established by resolute, remorseless conduct.

“Destruction” can involve generation of refugees and deaths by violence or through avoidable deaths from violently-imposed deprivation. Thus Articles 55 and 56 of the Geneva Convention Relative to the Protection of Civilians in Time of War unequivocally demand that an Occupier must provide its conquered Subjects with life sustaining food and medical requisites “to the fullest extent of the means available to it”:

“Article 55

To the fullest extent of the means available to it the Occupying Power has the duty of ensuring the food and medical supplies of the population; it should, in particular, bring in the necessary foodstuffs, medical stores and other articles if the resources of the occupied territory are inadequate.

The Occupying Power may not requisition foodstuffs, articles or medical supplies available in the occupied territory, except for use by the occupation forces and administration personnel, and then only if the requirements of the civilian population have been taken into account. Subject to the provisions of other international Conventions, the Occupying Power shall make arrangements to ensure that fair value is paid for any requisitioned goods.

The Protecting Power shall, at any time, be at liberty to verify the state of the food and medical supplies in occupied territories, except where temporary restrictions are made necessary by imperative military requirements.

Article 56

To the fullest extent of the means available to it, the Occupying Power has the duty of ensuring and maintaining, with the cooperation of national and local authorities, the medical and hospital establishments and services, public health and hygiene in the occupied territory, with particular reference to the adoption and application of the prophylactic and preventive measures necessary to combat the spread of contagious diseases and epidemics. Medical personnel of all categories shall be allowed to carry out their duties.

If new hospitals are set up in occupied territory and if the competent organs of the occupied State are not operating there, the occupying authorities shall, if necessary, grant them the recognition provided for in Article 18. In similar circumstances, the occupying authorities shall also grant recognition to hospital personnel and transport vehicles under the provisions of Articles 20 and 21.

In adopting measures of health and hygiene and in their implementation, the Occupying Power shall take into consideration the moral and ethical susceptibilities of the population of the occupied territory” (see “Geneva Convention Relative to the Protection of Civilians in Time of War”: http://www.refworld.org/docid/3ae6b36d2.html ) .

Avoidable deaths (avoidable mortality, excess deaths, excess mortality, premature deaths, untimely deaths, deaths that should not have happened) is the difference between the observed deaths in a country and the deaths expected for a peaceful, decently governed country with the same demographics (i.e. the same birth rate and age distribution; about 4 per 1,000 of population per year for peaceful but impoverished high birth rate countries). Thus, for example, in 2015 GDP per capita is abut $6,000 for both Cuba and China and about $15,000 for both Iraq and Libya but while there are zero (0) annual avoidable deaths in Cuba and China, annual avoidable deaths in war-devastated Iraq (population 36.4 million) and Syria (population 6.3 million) currently total 47,000 and 14,000, respectively (see Gideon Polya, “Body Count. Thus, by way of example, the post-9-11 avoidable deaths in the 20 countries violated by the West in the post-9-11 War on Terror total 34.0 million. However we can re-assess this data by considering the Muslim percentage of the population in these 20 countries and can estimate that post-9-11 Muslim avoidable deaths in these 20 US Alliance-violated countries total 26.8 million, noting that, as discussed above, it is likely that most of the violent Muslim deaths in the Zionist-promoted US War on Terror are not included in this estimate. About half the victims of this Neocon American and Zionist Imperialist (NAZI)-prosecuted Muslim Holocaust and Muslim Genocide are children. Muslim refugees generated now total about 42 million, the breakdown being 12 million Syrians, 7 million Palestinians, 6 million Sudanese, 6 million Iraqis, 3 million Afghans, 2 million Pakistanis, 2 million Myanmar Rohingyas, 2 million Somalis and 2 million more from Eritrea, the Central African Republic and Yemen. The greatest crime of Muslim-origin non-state terrorists derives from the awful reality that their awful crimes against civilians, while limited in death toll, are used as excuses for vastly more deadly attacks on the Muslim world by the US Alliance. Thus while Muslim-origin non-state terrorists have killed about 2,000 Westerners in the last half century (this excluding 4,000 Zionist invaders killed by Palestinians since 1920 and 3,000 Westerners killed in the US Government's 9-11 false flag operation), about 32 million Muslims have been killed by violence or imposed deprivation in the 20 significantly or substantially Muslim countries invaded by the US Alliance in the 21st century Zionist-promoted US War on Muslims. Indeed Muslim-origin non-state terrorism can be seen as the greatest international asset of genocidally destructive US imperialism, this Elephant in the Room reality making sense of well-documented support of the US or US Alliance countries for such terrorism. .

While the terms “holocaust”, “genocide” and “Geneva Convention observance” are precisely defined, the terminology and shocking underlying substance of most of the chapter headings (see below) are overwhelmingly ignored by Western Mainstream politicians, academics and journalists in a process of ongoing holocaust ignoring and genocide ignoring that is far, far worse than repugnant holocaust denial and genocide denial because the latter at least permit refutation and public debate.
