Alternative Dispute Resolution Since the Roman Law to the Present Day

The subject of the comming conference relates to non-judical dispute resolution in civil and commercial matters. Alternative forms of resolution of conflicts that exclude the state jurisdiction have been known in the world since the antiquity. They let to solve disputes faster and cheaper than in the traditional judical way.
Already in Roman law was being sought to economize the civil procedure by introducing such instruments as missio in bona or interdictal procedure. In the classical period the arbitration clause was dogmatically described and Justinian gave him the power of state judgments. Also in the ius commune of medieval Europe similar solutions can be found. The arbitration developed anew in the modern era with the development of international trade. Today, alternative dispute resolution, particularly arbitration and mediation, experience a renaissance. This is undoubtedly a research area in which both Roman and civil lawyers find their place.
This year's conference was intended to depict the richness of the European legal culture in the field of alternative dispute resolutions in civil and economic matters considering a historical-comparative point of view.
The Polish-Spanish Conference on the European Legal Tradition has been held since 2010. Till 2014 it was organized by the University of Castellon (Spain) and the Faculty of Law and Administration of the University of Warmia and Mazury in Olsztyn as the Polish-Spanish Conference on Roman Law. Its participants met alternately in Castellon or Olsztyn. 2015 the Faculty of Law and Social Sciences of the University of Social Sciences and Humanities in Warsaw joined the organizing circle.
The organizers plan a participation of 25 researchers in the conference.
