RELEVANT CIRCUIT COURT DISCOVERY INFORMATION/EXAMPLES
GENERAL RULES
Rule 2-401. General provisions governing discovery. Most relevant section: "Parties may obtain discovery by one or more of the following methods: (1) depositions upon oral examination or written questions, (2) written interrogatories, (3) production or inspection of documents or other tangible things or permission to enter upon land or other property, (4) mental or physical examinations, and (5) requests for admission of facts and genuineness of documents."
Rule 2-402. Scope of discovery. Basically, a party may obtain the "identity and location of persons having knowledge of any discoverable matter, if the matter sought is relevant to the subject matter involved in the action, whether it relates to [any] claim or [any] defense[.]"
TYPES OF DISCOVERY / RULES
Rule 2-411. Deposition -- Right to take. Any party may force any person to answer questions under oath, typically in front of a court reporter.
Rule 2-421. Interrogatories to parties. Any party may force any other party to answer up to 30 written questions (*This is the ONLY discovery tool available in District Court, but the limit is 15 written questions).
Rule 2-422. Discovery of documents, electronically stored information, and property. Any party may force any other party to provide copies (or, at the very least, ACCESS to originals) of any documents or property.
Rule 2-423. Mental or physical examination of persons. This may only be used when the mental or physical condition or characteristic of a party or of a person in the custody or under the legal control of a party is in controversy.
Rule 2-424. Admission of facts and genuineness of documents. Intended to be used to identify and simplify disputed issues, but is also used to expedite the discovery process as anything not denied within 30 days may be deemed admitted (though courts rarely enforce that part of the rule).
