By accessing and viewing the site www.teamgeomax.com and its pages and subpages (hereafter "website"), the visitor agrees to all terms set herein and any terms that may be added without any notice.

The content of this website is owned by Geomax and Geomax reserves the right to change or delete the content as it deems fit at any time without any notice to anyone whatsoever. Visitors may use this information at their own discretion and risk. Geomax, its employees, partners, suppliers and dealers or its associates and affiliates are not liable for any consequences arising out of the use or consumption of this content.

Terms and Conditions of Sale of items listed

The sale of Citizen Band Radios and accessories (“ Products”) and services by Groupe President Electronics India Pvt Ltd (“GPE India”), Geomax and its agents is subject to these terms and conditions (“Agreement”) regardless of other or additional terms or conditions that conflict with or contradict this Agreement in any purchase order, document, or other communication.

PRICES

Prices are subject to change at any time. Prices are in Rupees (INR) and an additional amount for GST as applicable from time to time, for shipping charges and any other tax will be to the account of the Customer. Customer is responsible for any Additional Fees such as Octroi, State taxes, Insurance etc. No discount will be granted for early payment. TERMS OF PAYMENT

Payment of total invoice amount is due before delivery per domestic wire transfer in concordance with the Proforma or as otherwise advised. Geomax’s bank charges will be borne by Geomax and the customer’s bank charges will have to be borne by the Customer.

DELIVERY AND TITLE

Unless otherwise specified by Geomax, all deliveries are Ex Geomax’s warehouse. When goods are transported, the risk (of accidental loss, destruction or deterioration) shall pass to the Customer as soon as Geomax has delivered the goods to the carrier chosen by us. Geomax is not liable for delays in delivery. A delayed delivery of any part of an order does not entitle Customer to cancel other deliveries. Until all monies due from the Customer to Geomax on any account have been received by Geomax, no title to the Product shall pass to the Customer and Geomax India has a right of lien on the Product.

PRODUCT RETURN

Customer must notify Geomax in writing of any damage to the outer packaging or the Products, shortage, or other visual defect within 3 days after receipt of the shipment; otherwise, Customer is deemed to have accepted the Products and may not revoke acceptance. Customer must return the products to Geomax freight prepaid in original manufacturer’s shipping cartons or equivalent, along with acceptable proof of purchase, within the warranty period.

GENERAL WARRANTY CONDITIONS

In order to be valid, the warranty certificate must be returned to Geomax within a delay of ten days after the purchase date. The warranty applies to defects and hidden manufacturing defects. It includes only the replacement of admittedly defective spare parts and related labour. Any damage, direct or indirect, caused to another device, by an eventual defectiveness of the sold item, is excluded from the present warranty. Warranty provided by the manufacturer will be passed on to the customer as is including all the terms and conditions of the manufacturer.

The warranty comes into effect from the invoice date. Any defective product requiring a repair under warranty must absolutely be returned to our New Delhi Warehouse. The item is returned at customer's risk.

EXCLUSIONS (ARE NOT COVERED)

- The non respect of the installation and use specification (including but not limited to inversion of polarities, microphone, overvoltage, bad connections, final output power transistors (SWR), antennas used with too high power).

- Transceivers which have been modified.

- Defects due to interventions made by third parties not approved by Manufacturer and/or applicable rules and laws.

- Damages caused by shocks and wear in unsuitable road, weather, environment and other conditions.

- The warranty application is excluded in case of modification done by the user of the sold item and also in case of a bad maintenance.

REPAIRS AND SPARE PARTS

A quotation will be done when the warranty clauses cannot be applied. For any refused quotation or not repaired item sent back, an amount of 500 INR (plus GST) and the shipping costs will be invoiced. The invoices of repairs and spare parts must be paid in advance (min. amount without GST 1000 INR + incurred transport costs)

NO LIABILITY FOR CONSEQUENTIAL DAMAGES

The entire liability of GPE India, Geomax and its distributors and suppliers (including its and theirs directors, officers, employees and agents) are set forth above. In no event shall GPE India, geomax and its distributors and suppliers (including its and theirs directors, officers, employees and agents) be liable for any damages, including but not limited to, any special, direct, indirect, incidental, exemplary, punitive or consequential damages, expenses, lost profits, lost savings, business interruption, inability to use the Products. The Customer acknowledges that the applicable purchase price reflects this allocation of risk. There may be some state/jurisdiction that does not allow the exclusion or limitation of liability for consequential or Incidental damages and the above limitation may not apply.

USES OF PRODUCTS

Customer shall comply with the manufacturer’s Product specifications. Products are not authorized for use in critical safety. GPE India or Geomax is not responsible for the content of informations that are communicated though the network. If Customer fails to comply with the manufacturer’s specifications, Customer acknowledges that such use or non-compliance is at Customer’s sole risk.

PRODUCT INFORMATION

Geomax recommends Customer validate any Product Information before using or acting on such information. All Product information is subject to change without notice. GPE India or Geomax is not responsible for typographical or other errors or commissions in Product information

APPLICABLE LAW AND JUDICIAL FORUM

The laws of India shall apply to all legal relationships and transactions established by this agreement. These Terms and Conditions of Sale shall be settled under the provisions of the Indian Arbitration and Conciliation Act, 1966.The judicial forum for both parties is our principal place of business (registered office). English shall be the language for arbitration proceedings.

OTHER TERMS

- Prices include the hardware only. Installation, Consultation and Project Management charges are extra and must be pre agreed. We provide manuals/ instructions will all items sold. All prices are exclusive of GST unless specifically indicated.

- 100% advance payment is required. Items shall be shipped immediately after receipt of payment within reasonable handling time. For items not in stock, a booking amount of 50% is required. Lead times shall be advised at the time of booking. 100% refund on order cancellations where we are not able to provide the items within a reasonable time.

- Applicable GST shall be charged at current prevailing rate. GST is subject to change and applied as per government regulations.

- Shipping charges at actuals shall apply. Bundling your purchase can be cost effective in terms of shipping. All items shall be shipped from Gurgaon, Haryana or New Delhi, India.

- Please retain original invoice and warranty card as it is needed for warranty purposes. Warranty shall only be provided to the original purchase against production of original receipt and warranty card.

- The Radios and associated equipment is sold for the personal use of the purchaser and the seller is not liable for any incidents or effects arising out of the use of this equipment. The user is responsible for following the local law and rules as may be amended from time to time and is liable for all consequences arising out of the use of such equipment.

- All items are sold on a non returnable basis.

- Hardware sold must not be modified. Any modifications made shall make the warranty null and void and the user is liable for all consequences arising out of such modification.
