1. Seller agree to transfer to Buyer one (1) Labrador Retriever puppy AKC registration number _____________________________
___________________, Sired by _________________________________________________, and whelped
by______________________________________________________. “Puppy” is used in this agreement to include a male or female at any age.
AKC definition 'LIMITED REGISTRATION' means that the dog is registered. But no litters produced by the dog are eligible for registration. Dogs with Limited Registration may not be entered in breed competition at Dog Shows but may compete in all other AKC events.
Registration papers will be marked with Limited Registration. (If the pup is to be neutered/spayed it will not affect anything).
2. The description of the puppy is as follows: Sex: FE - MALE Color YELLOW or BLACK
3. The Buyer agrees to pay seller the purchase price of $ 4000.00
Deposit $500.00 (non-refundable deposit to hold dog) Check payable to Diane E. Jezewski
Balance $ 3500.00 due when pup is picked up.
4. The puppy has been vaccinated for distemper-hepatitis, parvovirus. The date of such vaccination to be supplied to the Buyer at the time of sale.
5. The puppy has been wormed when necessary.
6. The puppy shall be veterinarian checked prior to purchase, and known to be healthy. IF Buyer can show proof that a veterinarian has deemed a puppy unhealthy within one (1) week of purchase, the pup can be returned and purchase price will be refunded (this is the only time the purchase price refund is offered). Transportation charges are the responsibility of the Purchaser.
THE SELLER REPRESENTS AND WARRANTS THE FOLLOWING TO THE ORIGINAL PURCHASER. THAT THE PUPPY IS FREE OF HEREDITY DEFECTS OF THE HIP AND ELBOW, TO SUCH EXTENT AS TO BE ACCEPTABLE BY OFA, if submitted. TO BE COVERED BY WARRANTY, IT IS REQUIRED THAT THE PUP BE GIVEN GLUCOSAMINE AND CHONDROITIN, VITIAMAN C DAILY UNTIL THE AGE OF TWO. IF YOU KEEP THEM ON THE PURINA PRO PLAN 30/20 ALL STAGES SALMON AND RICE FORMULA YOU DO NOT HAVE TO GIVE THEM THE GLUCOSAMINE AND CONDROITIN IT IS IN THE FOOD. THE VITAMIN C IS STILL REQUIRED.
THE MUST ALSO HAVE AN X-RAY OF THE HIP AND ELBOW AT THE AGE OF10 MONTHS (NO LATER THAN EIGHTTEEN MONTHS), THE RESULTS PROVIDED TO SELLER. THE SELLER WILL ONLY BE RESPONSIBLE TO REPLACE ONE PUPPY. SELLER CANNOT WARRANT THE FOLLOWING IF THE PUP IS OVERWEIGHT AND /OR IMPROPER NUTRITION, EXCESS EXERCISE, ACCIDENT OR INJURY HAS OCCURRED TO THE PUPPY THAT WOULD OR COULD POSSIBLY CHANGE RESULTS OF SAME. PROVIDED ALL THE ABOVE HAS BEEN ESTABLISHED THE WARRANTY IS UNTIL TWENTY-FIVE MONTHS OF AGE.
It is known that there is no absolute guarantee that a breeding program, even of OFA parents can be fully certain that no problems will develop, since we use a phenotype test for a gene problem. If such a heredity problem of the hip/elbow is diagnosed (with nothing else being the cause) a like quality puppy shall be given to the buyer out of the next available litter upon RETURN of the puppy with a heredity defect of Hip/elbow. The buyer MUST give notice of the defect in writing to the seller from an authorized veterinarian (it is not necessary to submit to OFA the veterinarian should be able to give you an opinion, or if they suspect a problem, my vet can confirm if a problem exists) within one (1) month of finding out about the defect to obtain a replacement. Dog must be registered to the original Purchaser at the time of diagnosis. Veterinarian records of the pup must be supplied from time of purchase that includes any/all injuries, weight at periodic checkups, and shot records. The pup must be otherwise well and uninjured, with veterinarian certification that this pup has not been seriously injured or diseased prior to the examination for hereditary defect of the Hips/Elbows. The original testing must be done by 10 to 18 months of age for hip and elbows and results provided to seller. IF not provided within one month of the exam no warranty exists. Buyer must pay any/all shipping costs.
THE BUYER AGREES AND WARRANTS AS FOLLOWS:
The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy/dog parasite free and up to date with minimal vaccines, proper nutrition, which consists of a good quality professional feed given at regular intervals, and fresh water available at all times. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision. The Breeder will microchip the puppy/dog before placing the animal with the buyer. The micro-chip will be registered with AKC’s Reunite program to the breeder and buyer, in order to facilitate his/her return if lost or stolen.
· A health record from the Breeder’s veterinarian was provided. Additionally, a record of all shots and/or worming was provided by the Breeder. The Buyer agrees to take this dog to a licensed veterinarian of their choice within 1 week for a physical examination. Should puppy/dog be determined to be in ill health, upon a signed written diagnosis from said licensed veterinarian, the dog may be returned at purchaser’s expense for refund. The Breeder assumes absolutely no responsibility for fees associated with caring for or returning the puppy/dog. No other guarantees are given.
· This dog is being placed as a “PET” with companion/limited AKC registration. The Buyer agrees NOT to use this animal for breeding and agrees to neuter after 24mo of age by their veterinarian. · If at any time the Buyer can no longer retain possession of this dog, the Breeder is to be notified and given first option of resuming full ownership of dog in order for the Breeder/Seller to locate this dog a new home. Refunds, if any, will be at the discretion of the Breeder. The Breeder will assume the responsibility of rehoming the dog. The dog will be returned with all AKC Registration and medical records. The Breeder reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this dog be sold, leased, traded or given away, to a research laboratory, rescue, animal shelter, similar facility or anyone with the intent to breed this puppy.
· The Buyer agrees to contact the Breeder immediately if any questions or concerns arise about the dog, such as housing, diet, surgeries, medical or health. The buyer agrees to keep the Breeder informed of any unusual medical treatment before it occurs. This provides the Breeder with an opportunity to research or follow-up on puppies and gives us important feedback and information on the health of our dogs for future generations. Buyer agrees to not use Comfortis (Spinosad), Simparica, Bravecto or Trifexis or ANY oral flea/tick products on the puppy, nor vaccinate for Leptospirosis prior to 12mo of age.
· Buyer will notify Breeder in the event of a change of personal contact information (address, phone, email, etc.). Buyer further agrees to notify DNR Labradors of any changes to Alternate Contacts. Should your dog become lost and attempts to contact you are unsuccessful via microchip information, the breeder is contacted. Providing your (and alternate contacts) address information enables us to contact you in the event that we are contacted about your dog. The microchip will list the breeder as an alternate contact permanently.
· That the individual AKC puppy and microchip registration forms will be completed by the breeder and forwarded to the buyer directly from the AKC. Buyer will provide to the breeder a name for the puppy, and the breeder will complete and submit all required paperwork to the AKC for processing. The preceding paragraphs contain conditions established by the Breeder to ensure the well-being of the puppy/dog. The Buyer’s agreements will continue for the duration of the dog’s life and the Breeder will have the right to enforce the agreements. Any and all attorney related and/or court related fees associated with a breach of this contract will become the responsibility of the Buyer/Purchaser, should the contract need to be enforced legally in court of law. Any legal litigation will be held in the Breeder’s County/State of residence.
By signing the agreement below the purchaser and the breeder agree to the terms of this agreement.
No other conditions, guarantees, or obligations concerning the sale of this puppy applies (this is also a UCC waiver) The agreement may be modified or amended only in writing and signed by all the parties.
