PUPPY PURCHASE AGREEMENT

1. Seller agree to transfer to Buyer one (1) Labrador Retriever puppy AKC registration number _____________________________

___________________, Sired by _________________________________________________, and whelped 

by______________________________________________________. “Puppy” is used in this agreement to include a male or female at any age.

     AKC definition 'LIMITED REGISTRATION' means that the dog is registered But no litters produced by the dog are eligible for registration.    Dogs with Limited Registration may not be entered in breed competition at Dog Shows but may compete in all other AKC events.    The litter owner may later apply to change this designation and have the dog given Full Registration privileges but a fee and special application are required for this change.”

     Registration papers will be marked with Limited Registration.      (If the pup is to be neutered/spayed it will not affect anything).    Limited registration will only be removed from the papers if prior knowledge of the intention of use for breeding is known to the seller.    The OFA Certification of Hips/Elbows (copies provided to breeder),  the CERF eye certification ( copies of current and previous year provided to breeder),   Cardiac OFA certification (copy provided to breeder),  temperament testing has been completed, and only if the result warrants removal of the Limited Registration.   This limited registration helps the seller to maintain our reputation of only the best animals being used for breeding.

2. The description of the puppy is as follows: Sex: FE - MALE Color YELLOW or BLACK

3. The Buyer agrees to pay seller the purchase price of $2000.00

Deposit $300.00 (non-refundable deposit to hold dog) Check payable to Diane E. Jezewski

Balance $ 1700.00 due when pup is picked up.

4. The puppy has been vaccinated for distemper-hepatitis, parvovirus. The date of such vaccination to be supplied to the Buyer at the time of sale.

5. The puppy has been wormed when necessary.

6. The puppy shall be veterinarian checked prior to purchase, and known to be healthy. IF Buyer can show proof that a veterinarian has deemed a puppy unhealthy within one (1) week of purchase, the pup can be returned and purchase price will be refunded (this is the only time the purchase price refund is offered). Transportation charges are the responsibility of the Purchaser.

         THE SELLER REPRESENTS AND WARRANTS THE FOLLOWING TO THE ORIGINAL PURCHASER.   THAT THE PUPPY IS FREE OF HEREDITY DEFECTS OF THE HIP AND ELBOW,  TO SUCH EXTENT AS TO BE ACCEPTABLE BY OFA, if submitted.   TO BE COVERED BY WARRANTY,  IT IS REQUIRED THAT THE PUP BE GIVEN GLUCOSAMINE AND CHONDROITIN,  VITIAMAN  C  DAILY UNTIL THE AGE OF TWO.    MUST ALSO HAVE AN X-RAY OF THE HIP AND ELBOW AT THE AGE OF SIX MONTHS (NO LATER THAN EIGHT MONTHS), THE RESULTS PROVIDED TO SELLER.    THE SELLER WILL ONLY BE RESPONSIBLE TO REPLACE ONE PUPPY.      SELLER CANNOT WARRANT THE FOLLOWING IF THE PUP IS OVERWEIGHT AND /OR IMPROPER NUTRITION,  EXCESS EXERCISE,  ACCIDENT OR INJURY HAS OCCURRED TO THE PUPPY THAT WOULD OR COULD POSSIBLY CHANGE RESULTS OF SAME.    PROVIDED ALL THE ABOVE HAS BEEN ESTABLISHED THE WARRANTY IS UNTIL TWENTY-FIVE MONTHS OF AGE. 

            It is known that there is no absolute guarantee that a breeding program, even of OFA parents can be fully certain that no problems will develop, since we use a phenotype test for a gene problem. If such a heredity problem of the hip/elbow is diagnosed (with nothing else being the cause) a like quality puppy shall be given to the buyer out of the next available litter upon RETURN of the puppy with a heredity defect of Hip/elbow. The buyer MUST give notice of the defect in writing to the seller from an authorized veterinarian (it is not necessary to submit to OFA the veterinarian should be able to give you an opinion, or if they suspect a problem, my vet can confirm if a problem exists) within one (1) month of finding out about the defect to obtain a replacement. Dog must be registered to the original Purchaser at the time of diagnosis. Veterinarian records of the pup must be supplied from time of purchase that includes any/all injuries, weight at periodic checkups, and shot records. The pup must be otherwise well and uninjured, with veterinarian certification that this pup has not been seriously injured or diseased prior to the examination for hereditary defect of the Hips/Elbows. The original testing must be done by 6 to 8 months of age for hip and elbows and results provided to seller. IF not provided within one month of the exam which should be done at the 6 to 8 month period no warranty exists.      Buyer must pay any/all shipping costs.

THE BUYER AGREES AND WARRANTS AS FOLLOWS:

A. Puppy purchased will be named with the DNR as a prefix.    Example DNR’s Somekinda Puppy.

B. Buyer will take all measures to maintain the health and well being of the puppy for as long as the Buyer retains ownership.   Veterinarian visits on a regular basis, following all recommended immunization, heartworm, and flea control.     The Buyer will provide a good home which includes warm and dry bedding with good protection from the weather and the elements, regular exercise, affection, proper nutrition and health care for the puppy.    The weight will be maintained at a normal amount for the size of the dog.    Overweight is not good and should not be tolerated.     If the buyer does not provide these items, the seller may require the return of the puppy.

C. If for any reason the puppy is to be sold or transferred by the buyer to someone else notification and approval by Seller must be made prior to the placement . This pup is not to be offered for sale through any pet shop, or auction, or any other method.    IF this portion of agreement is not kept a penalty of full purchase price of pup will be required and if necessary an attorney will be contacted.

D. If for any reason the puppy is returned to us for placement in a new home,  the registration papers (signed over to us), all proof of vaccines given with all veterinary records MUST be returned at the time the pup is brought back to us.   When the pup is placed in a new home we will return to the previous owner the amount received for the pup,  less our expenses,  no set amount of refund is offered or implied.       At no time will a full refund be given.

E. IF the puppy is required to be returned to us under paragraph B under the Buyer Agrees section, the registration papers (signed over to us), all proof of vaccines given with all veterinary records MUST be returned at the time the pup is brought back to us. At no time will any refund be given.

The following are only in effect if the pup is purchased for breeding.       If the pup is to be used for breeding this must be indicated at the time of purchase.

                    1. The puppy will not be bred until it has OFA Certification of the hip and elbow, the CERF examination, Cardiac examination, genetic testing for PRA/PRCD,  CMN, DLocus   and EIC with Certification done and the Limited Registration designation on papers has been removed.

OFA hip and elbow must be to the extent as to be certified acceptable by the Orthopedic Foundation For Animals. Such certification to be obtained at the expense of the Buyer at two (2) years of age.

Eye certification must be done prior to the age of six months, and genetic testing for PRA/PRCD if puppy is going to be used for breeding purposes.

Cardiac, CMN, D Locus and EIC (EXERCISE INDUCED COLLAPSE) testing and certification must be done after the age of one year. This is required due to the increase in this problem in Labradors.

2. The dog will only be bred to dogs which meet the requirement stated above.

3. Puppies from any breeding of this dog shall never be sold or given for auction, raffle or prize, or sold or given to a third party agent, pet shop, pet broker, commercial dealer, health organization for the purposes of experimentation, or laboratory. If this happens we will takes steps in the court to remove our dog from your possession.

4. The seller has the right, if they so desire to lease the bitch for one litter, or require a puppy back the sellers choice, in case of a male, the Seller shall have the right to breed the dog to bitches owned or leased by them, if they so desire for one litter.

        It cannot be stressed enough that this pup should NOT be overweight. Also, the necessity of regular Exercise. These two things are essential for proper development of the growing pup.

    IF THE PUPPY IS BRED PRIOR TO HAVING OBTAINED CERTIFICATION OF THE HIPS/ELBOWS, EYES, CARDIAC, EIC, PRA/PRCD AND THE LIMITED REGISTRATION REMOVED THIS AGREEMENT WILL BECOME NULL AND VOID.      IF PUPPY IS OVERWEIGHT, OR HAS BEEN KEPT ON CEMENT FOR EXTENDED PERIODS AGREEMENT WILL BECOME NULL AND VOID.

        We put all of the conditions, requirements in our agreement to protect our puppies under all the circumstances we have encountered over the years. We prefer to spell it all out  in order to Help you the buyer know our stance on situations that have come up. Only blatant disregard for the contract or the pup (or neglect, or abuse) would a pup be required to be returned.   No other conditions, guarantees, or obligations concerning the sale of this puppy applies (this is also a UCC waiver) The agreement may be modified or amended only in writing and signed by all the parties.

BY SIGNING BELOW, WE AGREE THAT WE HAVE READ, UNDERSTOOD, AND WILL ABIDE BY ALL THE TERMS OF THIS AGREEMENT
