TEMPORARY CONSERVATORSHIP LAW
Conservatorship Law: In California, a Conservatorship is a legal case where relative or a friend can obtain the legal right to make personal, medical, financial, or legal decisions for another adult, by obtaining a court order from a probate judge. This establishes the conservator as a fiduciary for the conservatee (ill adult). Conservatorships can be temporary conservatorships, but may also lead to a permanent conservatorship.
A Conservator can generally:
a. Make medical decisions
b. Decide where the conservatee lives.
c. Communicate with banks, and doctors.
d. Pay the bills of the Conservatee.
e. Protect the assets of the conservatee.
This is how California protects the disabled or persons who lack capacity. As a protective process, Conservatorships are court supervised under California law. A bond is usually required to insure that the money of the conservatee is used just for him or her. Actions of the Conservator have to be approved by the Court during an accounting or status hearing.
Each county in California has various safeguards and method of protecting the conservatee's interest by appointing counsel for the conservatee once a conservatorship is initiated.
Judges in Los Angeles County require the appointment of a PVP attorney to report to the court about whether or not a conservator should be appointed in addition to the court's probate investigator.
In Orange County and Ventura County, the Court appoints the public defender to represent the conservatee's interest.
