Privacy Policy - English

 Privacy protection of any party who access and/or use (“User”) any mobile application whether Android or iOS, website, feature, technology, content and digital product (“Platform”) owned by or operated by PT Sahabat Medis (“Sahabat Medis”) is important for Sahabat Medis. Therefore, Sahabat Medis are committed to protect and respect the privacy of User.

Through this Privacy Policy (“Policy”), Sahabat Medis will explain to the User how Sahabat Medis obtain, collect, use, display, announce, disclose, open access, store, send, give, transfer, process, manage, destroy and protect (“Utilization”) personal information and data obtained through the provision of services by Sahabat Medis to the User and/or that the User provide to Sahabat Medis ("Personal Data"). This Policy is applicable for all Users of the Platform, unless stated differently. We encourage the User to read this Policy before accessing and/or using the Platform.

PLEASE READ THE FOLLOWING POLICY CAREFULLY. BY CLICKING ON THE 'I ACCEPT' BUTTON AT THE END OF THIS PAGE, DOWNLOADING, INSTALLING, ACCESSING OR USING THIS PLATFORM, THE USER AGREES TO BE BOUND BY THIS POLICY. IF THE USER DOES NOT AGREE TO BE BOUND BY THIS POLICY, PLEASE DO NOT ACCESS OR USE THE PLATFORM.

This Policy may be amended or updated by Sahabat Medis without prior notice to the User. In the event of amendment or update of the Policy, the applicable privacy policy for every User is the one that published by Sahabat Medis in the Platform. The continuity of access and use of the Platform by the User shall be deemed as acceptance to be bound to the amended Policy.

This Policy is a part of Sahabat Medis’ Terms and Conditions. The terms defined and used in the Sahabat Medis’ Terms and Conditions is adopted into this Policy, unless for the terms stated otherwise in this Policy.

This Policy explains the following matters:

1.                   Scope of the Personal Data

In this Policy, “Personal Data” is any information and data related to the User, including but not limited to:

a.                   Data and information related to the User namely name, address, identity card number, email address, phone number, financial information and credit card, personal description, photo, video and other data;

b.                   Health data and information provided and uploaded by the User to the Platform with respect the use of any Services in the Platform;

c.                   Medical records of the User as a result of health care made by and/or uploaded by the Service Provider to the Platform for the necessary of the User, including but not limited to the medical records made by the doctor and laboratory and radiology test results made and/or uploaded to the Platform;

d.                   Electronic prescription and referral provided by the doctor to the User in the Platform; and

e.                   History of doctor visits, history of laboratory and radiology service orders, and history of drug purchases made by Users through the Platform.

2.                   Personal Data Collection

We may collect Personal Data of the User with the following methods:

a.                   Personal Data that the User provide to Sahabat Medis

The User may provide the Personal Data through electronic form in the Platform or by corresponding through phone, email, and others. This Personal Data including the information that provided by the User when registering on the Platform, subscribing the services, searching for product, participating on online discussion or other social media feature on the Platform, joining the competition, promotion or survey as well as when the User reporting any problem with the Platform. Sahabat Medis may request the User to verify the information that has been given to Sahabat Medis, to ensure the accuracy of such information.

The User may also provide the Personal Data when use the Services available in the Platform. Such Personal Data may be directly provided by the User or Personal Data that is created and/or uploaded by the Service Provider on the Platform for the benefit of the User.

b.                  Personal Data that Sahabat Medis collect

Every time the User access and/or use the Platform, Sahabat Medis may automatically collect the following data and information:

Technical information, which includes IP address used to connect the User’s computer to the interne, log in information of the User, type and version of the browser used, time zone setting, type and version of the browser plug-in, and operating system;

Information on the User’s visit, which includes, a complete list of uniform resource locator (URL) which leads to, or visited through and from our Platform (including date and time of visit); the product that you look for or search for; page response time, download issues, duration of visit to certain pages, information on the interaction on the page (e.g., scrolls, click, and mouse movements), methods used to leave the Platform, and the phone number used to contact customer service of Sahabat Medis.

c.                   Personal Data that Sahabat Medis receive from other sources

Sahabat Medis may obtain the Personal Data should the User use other sites that Sahabar Medis operate or other services that Sahabat Medis provide. Sahabat Medis also collaborate with the third party (including, but not limited to the Service Provider, insurance, business partner, sub-contractor on the technical services, payment and delivery services, advertising network, website analytical service providers and search engine providers) (“Our Partners”) and may obtain the information from them. Sahabat Medis shall take reasonable steps to verify information that Sahabat Medis obtain from other sources pursuant to the prevailing laws and regulations.

3.                   Use of the Personal Data

3.1.             Sahabat Medis may use the Personal Data of the User for the following matters:

a.                   Personal Data that the User provides to Sahabat Medis, may be used for the following purposes:

i.                     Conducting obligations of Sahabat Medis in providing the User with the information, products and services;

ii.                   Providing information related to the products and other services that Sahabat Medis offer; to provide to the User, or authorizing the third party to provide to the User, information on the products and services that Sahabat Medis deemed to be interest to the User. Sahabat Medis or Our Partners may electronically or otherwise contact the User to provide the information on the products and services of Sahabat Medis;

iii.                 Informing the User regarding the change of services of Sahabat Medis;

iv.                 Ensuring that the contents of the Platform are presented in the most effective ways for the User;

v.                   Providing information to the User and the Service Provider pursuant to the request of the User with respect to the Service. Sahabat Medis may provide health information of the User to the doctor or other healthcare service provider that will be providing the Service to the User through the Platform; and/or

vi.                 Using or disclosing the health information of the User and prescription based on the operation of the Platform.

b.                  Personal Data that Sahabat Medis collect, may be used for the following purposes:

i.                     Managing the Platform and internal operation of Sahabat Medis, including troubleshooting, data analysis, test, research as well as other statistical and survey purposes;

ii.                   Improving the Platform so that the contents are ensured to be presented in the most effective way for the User;

iii.                 Enabling the User to participate in the interactive features of our services in the form of exchanges or delivery of information to create a comprehensive understanding in relation to the product, service, verification, complaint, etc;

iv.                 As the part of the effort of Sahabat Medis to ensure the safety and security of our Platform;

v.                   Measuring and understanding the effectiveness of advertising that Sahabat Medis do to the User and other parties, as well as presenting the advertisement of the relevant products and services for the User including newsletters, marketing or promotional material, and other information on services and products offered by Sahabat Medis or Our Partner;

vi.                 Conducting personalization to the User’s experience;

vii.                Processing the User’s payment transaction on the Platform and support settlement of payment activities in the Platform or by third party as appointed by Sahabat Medis; and/or

viii.              Providing input and recommendation to the User on the Platform concerning the product and services that may attract the interest of the User.

c.                   Personal Data that Sahabat Medis receive from other sources, may be used for the following purposes:

Sahabat Medis may combine the information that Sahabat Medis receive from other sources with the information provided by the User and the information that Sahabat Medis collect. Sahabat Medis may use this information or the combined information for the above purposes.

3.2.             Sahabat Medis will use the Personal Data gathered for statistical data processing, which the results shall be used for various medical and commercial application. This statistical data processing in general shall not disclose the Personal Data, but it is also possible that there will be a disclosure of the Personal Data in the tracing of the result of statistical data processing. By using the Platform, the User considered to have understood and agreed such use of data.

3.3.             Health information of the User shall only be used with respect to the service of the Platform and pursuant to the matters contained and approved by the User in this Policy and Sahabat Medis shall only collect the information required to perform the service in the Platform.

3.4.             Sahabat Medis may analyse the information that made anonymous and gathered through the Platform, to evaluate the usage, profiling, marketing and to measure the effectivity of the Services and other content. Such information made anonymous and gathered shall not be deemed as Personal Data.

4.                   Disclosure of the Personal Data

4.1.             Sahabat Medis own the database rights in the collected Personal Data. Sahabat Medis may in providing services and operating business of Sahabat Medis, allow affiliate of Sahabat Medis or Our Partners to access the Personal Data subject to the prevailing laws and regulation.

4.2.             In addition, subject to the prevailing laws and regulation, Sahabat Medis may disclose the Personal Data with the third parties where:

a.                   The User has provided written consent to Sahabat Medis for disclosing the Personal Data in this way:

b.                   Sahabat Medis sell or acquire the company and/or assets, we may disclose the data to the prospective acquirer or seller of such company or assets;

c.                   Sahabat Medis or affiliates of Sahabat Medis or its substantial assets are acquired by the third party, then the Personal Data of the User shall be one of the assets to be transferred;

d.                   Sahabat Medis under the responsibility to disclose or share the data to comply with the obligation of law and other agreements; or to protect the rights, assets or the security of Sahabat Medis, the User and others. This also includes the exchange of information with the company and other organisation for the purposes of protection from the fraud and credit risk reduction;

e.                   Sahabat Medis provide anonymous statistical information regarding the user of the Platform and related usage information to reputable third parties, including analytics and search engine providers; or

f.                    Sahabat Medis use a third party service provider to provide services that involves data processing, for example archival, auditing, reference checking, professional advisory (including legal, accounting, financial and business consulting), mailing house, delivery, technology, website, research, banking, payment, client contact, data processing, insurance, forensic, litigation support, marketing and security services.

4.3.             Some of the third parties with whom Sahabat Medis share Personal Data may be located outside Indonesia. While such third parties be subject to the privacy and confidentiality obligation, in the event such obligation is subject to a certain law, the User acknowledge that such obligation may be different and be less stringent than the prevailing laws and regulations in Indonesia. In those cases, Sahabat Medis are not responsible for imposing the Indonesian laws and regulations and the User may not be able seek redress under those laws.

5.                   Storage of Personal Data

5.1.             All Personal Data provided by the User to Sahabat Medis is stored in the secured electronic media storage. By delivering the Personal Data to the Platform, the User approving the transfer, storage, and processing that occurs on the Platform. Sahabat Medis will take reasonable steps to ensure that the Personal Data is treated securely and pursuant to the Policy as well as the prevailing laws and regulations.

5.2.             All Personal Data that Users provide will be stored by Sahabat Medis: (i) as long as the User is still a user of the Platform and (ii) at least 5 (five) years from the date on which the User is no longer using the Platform or a longer period of time as determined by applicable laws and regulations; or (iii) in accordance with the initial purpose of collecting such Personal Data.

5.3.             Any information that a User allows to be shared with a Service Provider through the Platform will be retained by the Service Provider until their agreement with the Sahabat Medis ends. Non-personal information can be stored indefinitely for analysis purposes.

5.4.             Sahabat Medis is committed to ensuring that the information provided by the User to Sahabat Medis is safe and cannot be used by irresponsible parties. By using the Platform, the User hereby authorizes Sahabat Medis to take all actions deemed necessary by Sahabat Medis to protect the Personal Data and to prevent unauthorized access. However, please note that Sahabat Medis cannot fully guarantee the security and is not responsible for any loss, including but not limited to the data loss incurred from the incidents beyond the control of Sahabat Medis. Therefore, Sahabat Medis strongly recommend the User to always update your Platform and software and not disclose your password to any party.

5.5.             The obligation to maintain the confidentiality of Personal Data will not or no longer apply to Personal Data that:

a.                   has been made known to the public at the time of disclosure, or has been known to the public afterwards by means other than through the actions or negligence of Sahabat Medis;

b.                   has been known by Sahabat Medis before Personal Data is disclosed;

c.                   Sahabat Medis obtain appropriately from third parties without any obligation to maintain the confidentiality of Personal Data;

d.                   the disclosure has been permitted by the User; and

e.                   must be disclosed based on the provisions of the applicable laws and regulations, court rulings, or other governmental authorities, in any country that has jurisdiction.

5.6.             The User agrees that Sahabat Medis will not be responsible for any security breaches related to messages, information or documents sent by the user through the internet.

5.7.             In the event of a failure to protect Personal Data on the Platform, Sahabat Medis will notify the User in writing whether through electronic or other media.

6.                   Rights of the User

6.1.             Unless stated otherwise by the prevailing laws and regulations, the User, either while becoming the user of the Platform or after no longer becoming the user of the Platform, hereby agree waive all its rights to require or instruct Sahabat Medis to delete any data and/or information including Personal Data uploaded or stored by the User in the Platform.

6.2.             The Users may access and/or correct the Personal Data of the Users in the Platform, by using the features in the Platform or by contacting Sahabat Medis in the details provided in this Policy.

6.3.             The Platform may, from time to time, contain links to and from sites belonging to Our Partner networks, advertisers, and other affiliates. If the user follows a link to one of these sites, please note that these sites have their own Privacy Policy and Sahabat Medis is not responsible or have any liability for those policies. Please check these policies before the User submits any information to these sites.

7.                   Cookies Policy

7.1.             When the User use the Platform, Sahabat Medis may place a number of cookies in your browser. Cookies are small digital files containing letters and numbers that we store on your computer's browser or hard drive with your consent. Cookies contain information that is transferred to your computer's hard disk.

7.2.             Cookies can be used for the following purposes: (i) activate certain functions, (ii) provide analysis, (iii) save your preferences; and (iv) allows the delivery of advertising and advertising based on behaviour. Some of these cookies will only be used if the User use certain features, or choose certain preferences, while some other cookies will always be used.

8.                   Acknowledgment and Approval

8.1.             By agreeing to the Policy, the User acknowledge that the User have read and understood this Policy and agree to all its terms. Specifically, the User agree and give Sahabat Medis consent to collect, use, share, disclose, store, transfer, or process your Personal Information in accordance with this Policy.

8.2.             The User is allowed to provide and store Personal Data about others, including children, elderly, disabilities, people under guardianship or legal custody, and/or people who has legal or family relationship with the User. The User is fully responsible for the giving, use and delivery of information with respect to the children, elderly, disabilities, people under guardianship or legal custody, and/or people who has legal or family relationship with the User.

9.                   Data Ownership

Subject to the provision of this Policy, no title, license, copyright or any other rights, regardless whether or not covered by intellectual and/or industrial property rights, are granted expressly or impliedly. All data relating to the User’s personal data that the User post, submit, transmit, upload or otherwise make available during the utilization of the Platform would still belong to the User, including medical records documents shall always entitled to the doctor as the Service Provider.

10.               Marketing Material

Sahabat Medis and Our Partners can send the User and/or the parents or guardians of the User direct marketing, advertising, and promotional communications through the push-notification application, messaging through the application, post, telephone call, short message service, email and/or other messaging application ("Marketing Material") if the User have agreed to subscribe to our mailing list, and/or agree to receive marketing and promotional material from Sahabat Medis. The User may choose not to receive marketing communications at any time by contacting Sahabat Medis through the contact details listed in this Policy. Please note that if the User choose to leave, Sahabat Medis may still send the User non-promotional messages, such as receipts or information about the account of the User.

11.               Changes to the Privacy Policy

Any changes that we make to the Policy of Sahabat Medis in the future will be published through this page and, when needed, notified to the User by electronic mail and/or by the notification available in the Platform. Please revisit this page from time to time to see any updates or changes to the Policy of Sahabat Medis.

13.               Governing Law

This Policy are governed by the laws of Republic of Indonesia. Any and all disputes arising from and in relation to the use of the Platform are subject to the exclusive jurisdiction of the District Court of Jakarta Utara.

14.               Language

This Policy is made in Indonesian language and English language. In the event of any inconsistency or different interpretation between the Indonesian language version and the English language version, the User agree that the Indonesian language version will prevail to the extent of such inconsistency or conflict, and the relevant English language version is deemed to be automatically amended to be consistent with the relevant part of the Indonesian language version.
