1. Agreement
This End User License Agreement ("Agreement") is between you (the "User") and PushP Solutions ("Company"). By installing or using the VIBZ application ("Software"), you agree to be bound by the terms of this Agreement. If you do not agree with these terms, do not install or use the Software.
2. License Grant
PushP Solutions grants you a limited, non-exclusive, non-transferable license to use the Software for personal use in accordance with this Agreement.
3. Restrictions
You shall not:
Copy, modify, or distribute the Software.
Reverse engineer, decompile, or disassemble the Software.
Rent, lease, or sublicense the Software.
Use the Software for any illegal or unauthorized purpose.
4. Ownership
The Software is licensed, not sold. PushP Solutions retains all rights, title, and interest in and to the Software, including all intellectual property rights.
5. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any terms. Upon termination, you must cease all use of the Software and destroy all copies.
6. Disclaimer of Warranties
The Software is provided "as is" without warranty of any kind. PushP Solutions disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
In no event shall PushP Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Software.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Maryland,USA, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Maryland,USA to resolve any dispute arising out of these terms or the use of the Software.
9. Third-Party Services
The Software may incorporate, or provide access to, third-party services and content (such as MongoDB for database services and Firebase Storage for file storage). PushP Solutions is not responsible for the practices or policies of these third parties, and you acknowledge that your use of such third-party services will be governed by their respective terms and privacy policies. By using the Software, you agree to abide by these third-party terms.
10. Indemnification
You agree to indemnify, defend, and hold harmless PushP Solutions, its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Software, your violation of this Agreement, or your violation of any rights of another.
11. Updates and Changes
PushP Solutions reserves the right to modify or discontinue, temporarily or permanently, the Software (or any part thereof) with or without notice. PushP Solutions shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Software.
