CDA-P1 - Qualifications, Duties and Responsibilities of the Superintendent(s)
Section C: General Division Administration
Members of the Superintendent’s department are jointly and severally responsible, under the Board policies, for all instructional segments of the Division. They have the authority to delegate to other personnel the exercise of some powers and the discharge of some duties. The delegation of such powers or duties, however, shall not relieve the Superintendent(s) of responsibility for the action taken under such delegation.
The Board is charged by law with setting up and administering schools according to the provisions of the Public Schools Act as well as other provincial and federal legislation and regulation.
To this end, the Superintendent is responsible for the development of administrative procedures which will serve to further clarify and define Board policy.
The implementation of Board policies and administrative procedures in the schools is the responsibility of the Principals.
Qualifications
The Superintendent must:
Possess at least a university academic degree and a professional degree, preferably at the graduate level;
Possess training and experience in education administration and hold a Manitoba Level 2 Principal’s Certificate, or equivalent;
Possess demonstrated administrative skills, including the evaluation of professional staff members and programs;
Exhibit strong interpersonal, communication, facilitation, problem-solving, and community relations skills;
Have a good knowledge of current curriculum and instructional methodology;
Have a good knowledge of technology and resource-based learning; and
Display expertise in effective and efficient planning for, and implementation of personnel, financial, and material resources; and,
Satisfy all the requirements of procedure GAB regarding the hiring of professional staff, including criminal record and abuse registry check;
Must have a valid Manitoba Class 5 Driver's License.
Powers and Duties
“A school board may by resolution delegate to the superintendent
Power to employ, within the establishment and budgetary limits set by the school board, necessary staff except senior officers and employees holding administrative or supervisory positions; or
Except in respect of positions mentioned in clause (a), power to accept resignations and power to grant within policy and budgetary limits established by the school board, exchange leave for Teachers and to cancel or alter that leave; or
Power to appoint attendance officers; or
Power to promote non-teaching staff into established positions, except in respect of positions mentioned in clause (a); or
Power to select Teachers for schools operated by the Department of National Defence, to grant leave for service with the Department of External Affairs and to select Teachers for similar service; or
Power to request municipal councils to make improvements in roads and sidewalks adjacent to school sites and power to enter into agreements on behalf of the school board with respect thereto within policy and budgetary limits established by the school board; or
Power to approve payment under final certificates for payments in respect of routine contracts awarded by the school board other than for new buildings, where the contracts have been completed to his satisfaction; or
Any one or more of the powers mentioned in clauses (a) or (g).” [PSA 52(1)]
Responsibilities
The responsibilities of the Superintendent’s department are listed below.
In cooperation with the Secretary-Treasurer’s department and the Chair, assist with the preparation of detailed agendas for regular and special meetings of the Board of Trustees.
To attend all meetings of the Board, and committee meetings as appropriate. The Superintendent may be excluded when his/her contract, salary, efficiency, or conduct is under discussion.
To assist the Board in the development of short term and long term plans designed to facilitate the implementation of divisional goals and objectives, in accordance with Board policy.
To keep the Board informed of developments in the field of education, as they affect the schools of the Division, and to make recommendations to promote school programs to meet the objectives of the Division.
To keep the Board informed on the progress and condition of the schools and all aspects of the educational programs within the Division, such as:
Teacher effectiveness;
Student progress;
Administrative practices in the schools;
Student and Teacher welfare; and,
Program, facilities, and equipment needs.
To ensure adherence to Board policies and all provisions of laws, rules and regulations of the Province of Manitoba.
To act as the Board’s agent or designate in disciplining divisional employees.
To act as Attendance Officer for the Division; to deal with problems concerning school attendance and report decisions to the Board.
To work with the Secretary-Treasurer and other administrative personnel, in the preparation and management of the budget.
To develop appropriate administrative procedures and instructions as may be necessary to complement Board policy.
To organize, coordinate, and direct the activities and operation of all instructional departments.
To select, engage, assign, and/or transfer, in consultation with the School Principals, all instructional personnel. To submit recommendations for promotions, suspensions, and dismissals of divisional employees. In case of emergency, to suspend any employee, with such suspension to be reported to the Board at its next meeting.
To delegate and assign specific duties, when such assignments are for the purpose of increasing or improving the efficiency of the divisional operation.
To arrange for a pool of Substitute Teachers as required.
To meet regularly with the Administrative Council to discuss, plan, and recommend on matters affecting the operation and management of the Division and the schools.
To actively promote the development of a positive climate/morale within the Division.
To approve at his/her discretion, a Principal’s suspension of any pupil, or suspend any pupil, subject to the regulations made under the Education Administration Act [M.R. 468/88 (40.3 - 40.7)]
To ensure the maintenance of personnel records and pupil records as required by law and by Board policy.
To approve the annual in-service program for professional staff.
To oversee, at the Division level, a system of supervision and evaluation of professional staff and instructional support staff.
To review and recommend programs, coordinate the implementation of approved programs, review performance in relation to plans, and obtain explanations of significant variances.
To be actively involved in the support of education through membership in professional organizations.
To consult and cooperate with Manitoba Education and the Faculties of Education and other associations concerned with education.
To maintain effective public relations by representing the Division at meetings, conferences, and public gatherings.
To cooperate with provincial Health and Safety departments to promote such safety and health standards as are possible and feasible.
To represent the Board in its dealings with external agencies, subject to Board policy and reporting to the Board.
To deal with complaints and requests from employees and the public, within their areas of jurisdiction; and to outline the resulting course of action.
To perform other related duties as assigned or requested by the Board.
