Pelagic Blue Privacy Policy (updated as of August 2025)

This Privacy Policy describes how Pelagic Blue collects, uses, and shares your personal information and the choices you may have regarding our use of your personal information. Pelagic Blue may update and make changes to this policy, so Pelagic Blue encourages you to review it periodically.

1. Personal Information Pelagic Blue Collects

In the twelve (12) months prior to the “last updated” date of this Privacy Policy, Pelagic Blue has collected the following categories of personal information:

a)      Identifiers such as real name, email address, IP address, and personal information contained in uploaded identification documents (e.g., driver’s license, passport).

b)     Personal information as defined in California Customer Records law such as name, signature, address, telephone number, passport number or driver license, credit or debit card number, and health insurance information.

c)      Characteristics of protected classifications under California or federal law such as gender identity and age.

d)     Commercial Information such as purchase or transaction history.

e)      Internet and electronic network activity information such as browsing history, search history, and information regarding a consumer’s interaction with an internet website application or advertisement.

f)        Geolocation data such as data about the location of your device.

g)      Sensitive personal information such as driver’s license, passport, credit or debit card number in combination with any required security or access code, criminal record, health information, and precise geolocation.

2. How Your Personal Information is Collected

a)      Information you provide in person, by telephone, text, email, and through our website during transactions and contacting Pelagic Blue.

b)     Pelagic Blue’s website monitoring through cookies on Pelagic Blue’s website and IT systems monitoring.

3. Why Pelagic Blue Collects Your Information

Pelagic Blue collects and uses consumer personal information for the following purposes:

a)      For the performance of our contract with you or to take steps at your request before entering into a contract to provide services to you;

b)     Performing services on behalf of the business, including providing customer service, verifying customer information, and processing payments;

c)      Conducting business analysis such as projections;

d)     Helping to ensure security and integrity and prevent fraud;

e)      Help Pelagic Blue update, expand, and analyze its records to identify new customers;

f)        Analyze Pelagic Blue’s performance and marketing activities;

g)      Create aggregated statistical data and other aggregated information to improve Pelagic Blue’s website and services; and

h)      To comply with Pelagic Blue’s legal and regulatory obligations.

4. NO Sale or Sharing of Information for Cross-Context Behavior Advertising

Pelagic Blue has not, in the last twelve (12) months, sold or shared consumers’ personal information for the purposes of cross-context behavior advertising (advertising that is targeted to you based on personal information obtained from your activity across businesses, distinctly branded internet websites, applications, or services).

5. Who Your Personal Information is Shared With

Pelagic Blue routinely shares your personal information with the following:

a)      Payment service providers;

b)     Software providers (e.g., Jotform);

c)      Website hosts;

d)     Marketing agencies; and

e)      Third parties you have approved.

7. Use or Disclosure of Sensitive Personal Information

Pelagic Blue does not use or disclose your sensitive personal information for purposes other than those listed below:

a)      To perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.

b)     To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted personal information.

c)      To resist malicious, deceptive, fraudulent, or illegal actions directed at the business and to prosecute those responsible for those actions.

d)     To ensure the physical safety of natural persons (e.g., disclosing a consumer’s geolocation to law enforcement to investigate an alleged kidnapping).

e)      For short-term, transient use, including, but not limited to, non-personalized advertising shown as part of a consumer's current interaction with the business, provided that the personal information is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer's experience outside the current interaction with the business.

f)        To perform services on behalf of the business.

g)      To verify or maintain the quality or safety of a product, service, or device that is owned, manufactured, manufactured for, or controlled by the business, and to improve, upgrade, or enhance the service or device that is owned, manufactured by, manufactured for, or controlled by the business.

h)      To collect or process sensitive personal information where the collection or processing is not for the purpose of inferring characteristics about a consumer.

8. Your Rights

Under various state laws, you may have the right to request access to, and deletion of the personal information Pelagic Blue collects about you, as well as to request that Pelagic Blue disclose how it collects, uses, and shares your personal information.

8.1. Right to Know

You have a right to know what personal information Pelagic Blue has collected about you, including:

a)  The categories of personal information Pelagic Blue has collected;

b) The categories of sources from which the personal information is collected;

c)  The business or commercial purpose for collecting, selling, or sharing personal information;

d) The categories of third parties to whom Pelagic Blue discloses personal information; and

e)  The specific pieces of personal information Pelagic Blue has collected about you.

8.2. Right to Delete

You have a right to delete personal information Pelagic Blue has collected from you with certain exceptions, including where the information is necessary to complete our transaction with you. Subject to the exceptions set out in Section 8.3, on receipt of a verifiable request from you, Pelagic Blue shall:

a)  Delete your personal information from Pelagic Blue’s records;

b) Direct any service providers or contractors to delete your personal information from their records; and

c)  Direct third parties to whom the business has sold or shared your personal information to delete your personal information unless this proves impossible or involves disproportionate effort.

8.3. Exceptions to Right to Delete

Please note that Pelagic Blue may not delete your personal information if it is necessary to:

a)      Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and Pelagic Blue;

b)     Help to ensure security and integrity to the extent the use of the consumer's personal information is reasonably necessary and proportionate for those purposes;

c)      Debug to identify and repair errors that impair existing intended functionality;

d)     Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law;

e)      Comply with the California Electronic Communications Privacy Act or any other applicable state law;

f)        Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when Pelagic Blue’s deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided Pelagic Blue has obtained your informed consent;

g)      Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with Pelagic Blue;

h)      Comply with an existing legal obligation; or

i)        Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

8.4. Right to Correct Inaccurate Personal Information

Upon receipt of a verifiable request from you, Pelagic Blue shall use commercially reasonable efforts to correct the inaccurate personal information.

8.5. Right not to Receive Discriminatory Treatment

You have a right not to receive discriminatory treatment for exercising any of these rights listed in this Section 8. This means Pelagic Blue cannot, among other things:

a)      Deny goods or services to you;

b)     Charge different prices or rates for goods or services, including using discounts or other benefits or imposing penalties;

c)      Provide a different level or quality of goods or services to you; or

d)     Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that Pelagic Blue may charge a different price or rate or provide a different level or quality of services to you, if that difference is reasonably related to the value provided to Pelagic Blue’s business by your personal information.

9. Exercising Your Rights

You can submit a request to exercise your rights to access, correct, or delete your personal information by sending an email to connect@pelagicbluecruising.com and providing Pelagic Blue with your name, address, phone number, and email.

Pelagic Blue will need your contact information, including your name, address, phone number, and email, to verify your identity for access, correction, or deletion requests. Pelagic Blue’s verification process may also include asking you to answer a few questions about yourself to help Pelagic Blue verify your identity. Pelagic Blue is not obligated to make a data access or data portability disclosure if Pelagic Blue cannot verify that the person making the request is the person about whom Pelagic Blue collected information or is someone authorized to act on such person's behalf. Any personal information Pelagic Blue collects from you to verify your identity in connection with your request will be used solely for the purposes of verification.

If you are an authorized agent, then you will be required to submit your contact information and a certification form as well as provide information about the consumer for whom you are making a request.

10. Security

Pelagic Blue has implemented security measures designed to protect your personal information.

Regardless of Pelagic Blue’s measures and efforts, Pelagic Blue cannot and does not guarantee the absolute protection and security of your personal information or any other information you upload, publish, or otherwise share with Pelagic Blue or anyone else. Pelagic Blue encourages you to avoid providing Pelagic Blue or anyone with any sensitive personal information which Pelagic Blue does not require.

11. Updates to this Policy

Pelagic Blue may update this Privacy Policy as required by applicable law and to reflect changes to Pelagic Blue’s practices regarding the collection, storage, and usage of personal information.
