SENATE RULES COMMITTEE PROCEDURES 2025
The following procedures have been established to allow for efficiency and due diligence in regard to how the Rules Committee will be conducted and how bills and confirmations will be heard. These procedures may be updated so individuals coming before SRC are encouraged to check them throughout the legislative session.
1. Start time and Subcommittee: SRC begins at 9am unless otherwise announced by the Chair. If a quorum is not present at the start time, SRC will hear the matters on the agenda as a Subcommittee, and official action will be taken once a quorum is present.
2. Lengthy Amendments and Committee Substitutes: To give SRC members and analysts sufficient time to review legislation, bill sponsors shall submit lengthy amendments and proposed committee substitute bills to SRC at least 24 hours in advance of a hearing. Lengthy amendments and proposed committee substitute bills should be emailed to SRC.comm1@nmlegis.gov.
Public Comment and Rules for Debate
To best manage the presentation and debate of legislation and conferees, including by remote and video conferencing, the following procedures are adopted for SRC except as otherwise modified.
1. Emailed Public Comments: To ensure everyone has a full opportunity to express an opinion on legislation and conferees under consideration, we have an established SRC mailbox, where written comments of up to 300 words may be emailed in advance of an SRC meeting. Comments should be emailed to SRC.zoom@nmlegis.gov. Committee members will be provided with these comments prior to committee hearings.
2. Sponsor and Proponent Advocacy: Bill sponsors, and their experts or proponents, shall have a total of 20 minutes to present the bill. Sponsors are encouraged to use 10 minutes to present the bill and 10 minutes for organized support or public comment as coordinated by the sponsor. However, sponsors have the option to use their total of 20 minutes as they choose. Sponsors shall organize their presentation with as many experts or speakers as they wish. Sponsors shall identify their speakers and the order of speaking in writing to the SRC Committee Secretary at least 1 hour in advance of the scheduled hearing by sending an email to SRC.zoom@nmlegis.gov.
Persons wishing to speak in support of legislation shall coordinate with the sponsors. The sponsors shall designate those who will speak and shall limit or interrupt their own speakers as necessary to meet time constraints. Sponsors may also reserve any part of their time for a rebuttal after any opposition.
3. Organized Opposition: SRC recommends opponents of legislation organize and designate a spokesperson to coordinate one or more speakers in opposition. A coordinated opposition shall have up to 15 minutes for opposition with or without experts. The names and order of persons to be recognized for an organized opposition, and any exhibits or proposed amendments, shall be submitted to the SRC Committee Secretary at least 1 hour in advance of the scheduled hearing by sending an email to SRC.zoom@nmlegis.gov.
If no opposition presentation is organized or coordinated behind a designated spokesperson, then up to 10 minutes of opposition may be heard with each speaker limited to 1 minute each. Persons wishing to speak in opposition shall sign-in to do so with the SRC Committee Secretary at least 1 hour before the scheduled committee meeting.
4. Additional Comment: Individuals intending to comment on a bill that are not part of organized support by sponsors or organized opposition will be permitted to speak if time allows. Those wishing to give additional comment are highly encouraged to sign up at least 24 hours in advance by sending an email SRC.zoom@nmlegis.gov that includes the individual’s name, the matter they wish to speak on, whether they will appear in person or remotely, and whether they wish to speak in support or opposition. Individuals who sign up in advance will have priority to speak within allotted time, if time permits.
5. Recognition of supporting/opposing organizations: Any organization or lobbyist may ask to have the name of their organization or client associated with either support or opposition to a bill. The sign-in for this input shall be received up to 1 hour before SRC scheduled start time at SRC.zoom@nmlegis.gov. The names of organizations, lobbyists, and their support or opposition will be read during the committee hearing

The following procedures have been established to allow for efficiency and due diligence in regard to how the Senate Tax, Business & Transportation Committee will be conducted and how bills and confirmations will be heard. These procedures may be updated so individuals coming before STBTC are encouraged to check them throughout the legislative session.
1. Start time and Subcommittee: STBTC begins at 1:30 p.m. or 30 minutes after adjournment of the floor session. The Chair will reaffirm the start time of the meeting during Committee announcements during the floor session. If a quorum is not present at the start time, STBTC will hear the matters on the agenda as a Subcommittee, and official action will be taken once a quorum is present.
2. Lengthy Amendments and Committee Substitutes: In order to give STBTC members and analysts sufficient time to review legislation, bill sponsors shall submit lengthy amendments and proposed committee substitute bills to STBTC at least 24 hours in advance of a hearing in order to allow time for thorough analysis by staff and committee members. This requirement is nonnegotiable.
3. Double Dropped Bills: If both the House and Senate introduce identical bills during the same session, STBTC may only hear one of the two bills to best manage time and prevent repetitive agendas. Sponsors of double-dropped bills are encouraged to inform STBTC of which bill they would like heard.

1. Zoom Public Comments: To ensure everyone has a full opportunity to express an opinion on legislation under consideration, we have an established a STBTC Zoom protocol. Once you send an email to STBTC.zoom@nmlegis.gov to register for public comment in advance of an STBTC meeting, you will receive instructions on the Chair’s preferred guidelines for participation.
2. Recommendations from the Chair on Bill Presentation: Bill sponsors, and their experts or proponents, shall have a total of 20 minutes to present the bill. Sponsors are encouraged to use 10 minutes to present the bill and 10 minutes to organize support or public comment as coordinated by the sponsor. However, sponsors have the option to use their total of 20 minutes as they choose. Sponsors may organize their presentation with as many experts or speakers as they wish. The Committee ViceChair will give you a 5-minute warning as you near the end of your time limit.
IF there are any experts that will be participating in a bill debate via zoom, please inform the secretary by NOON of the day your bill is to be presented in committee. You can email the name(s) to: STBTC.comm1@nmlegis.gov. The Committee Secretary will provide the Zoom link to you for your expert.
It is helpful for you as a bill sponsor to work with your experts. An expert who rambles and doesn’t directly answer the question may, in fact, hurt your bill defense. Share with your expert that the best approach is to answer the questions as concisely as possible. This also will help you stay within the time limit for your bill presentation.
Following ALL public Testimony, the Chair will give the bill sponsor a chance to address any issues brought up by the public. You will have 5 minutes to address those concerns.
3. Public Testimony: The Chair will include public testimony in support and in opposition to your bill. IF there is a large number of the public in support or opposition of the legislation, the chair will choose a number of individuals to speak for both sides. The Chair will also apply this to individuals testifying on Zoom. For example, if there are 15 people for support and 10 for opposition, the number will be noted and the Chair will select 8 people to testify from both sides. (That number is random and only used as part of this example.)
The sponsor should coordinate with their supporters before the committee about who would be the most effective to speak. This also applies to those in opposition.
Depending on the number of individuals who wish to publicly testify, the Chair may impose a time limit on individual testimonies for both support and opposition.

The following procedures have been established to allow for efficiency and due diligence in regard to how the Senate Tax, Business & Transportation Committee will be conducted and how bills and confirmations will be heard. These procedures may be updated so individuals coming before STBTC are encouraged to check them throughout the legislative session.
1. Start time and Subcommittee: STBTC begins at 1:30 p.m. or 30 minutes after adjournment of the floor session. The Chair will reaffirm the start time of the meeting during Committee announcements during the floor session. If a quorum is not present at the start time, STBTC will hear the matters on the agenda as a Subcommittee, and official action will be taken once a quorum is present.
2. Lengthy Amendments and Committee Substitutes: In order to give STBTC members and analysts sufficient time to review legislation, bill sponsors shall submit lengthy amendments and proposed committee substitute bills to STBTC at least 24 hours in advance of a hearing in order to allow time for thorough analysis by staff and committee members. This requirement is nonnegotiable.
3. Double Dropped Bills: If both the House and Senate introduce identical bills during the same session, STBTC may only hear one of the two bills to best manage time and prevent repetitive agendas. Sponsors of double-dropped bills are encouraged to inform STBTC of which bill they would like heard.
Public Comment and Rules for Debate
To best manage the presentation and debate of legislation, including by Zoom, the following procedures are adopted for STBTC except as otherwise modified.
1. Zoom Public Comments: To ensure everyone has a full opportunity to express an opinion on legislation under consideration, we have an established a STBTC Zoom protocol. Once you send an email to STBTC.zoom@nmlegis.gov to register for public comment in advance of an STBTC meeting, you will receive instructions on the Chair’s preferred guidelines for participation.
2. Recommendations from the Chair on Bill Presentation: Bill sponsors, and their experts or proponents, shall have a total of 20 minutes to present the bill. Sponsors are encouraged to use 10 minutes to present the bill and 10 minutes to organize support or public comment as coordinated by the sponsor. However, sponsors have the option to use their total of 20 minutes as they choose. Sponsors may organize their presentation with as many experts or speakers as they wish. The Committee ViceChair will give you a 5-minute warning as you near the end of your time limit.
IF there are any experts that will be participating in a bill debate via zoom, please inform the secretary by NOON of the day your bill is to be presented in committee. You can email the name(s) to: STBTC.comm1@nmlegis.gov. The Committee Secretary will provide the Zoom link to you for your expert.
It is helpful for you as a bill sponsor to work with your experts. An expert who rambles and doesn’t directly answer the question may, in fact, hurt your bill defense. Share with your expert that the best approach is to answer the questions as concisely as possible. This also will help you stay within the time limit for your bill presentation.
Following ALL public Testimony, the Chair will give the bill sponsor a chance to address any issues brought up by the public. You will have 5 minutes to address those concerns.
3. Public Testimony: The Chair will include public testimony in support and in opposition to your bill. IF there is a large number of the public in support or opposition of the legislation, the chair will choose a number of individuals to speak for both sides. The Chair will also apply this to individuals testifying on Zoom. For example, if there are 15 people for support and 10 for opposition, the number will be noted and the Chair will select 8 people to testify from both sides. (That number is random and only used as part of this example.)
The sponsor should coordinate with their supporters before the committee about who would be the most effective to speak. This also applies to those in opposition.
Depending on the number of individuals who wish to publicly testify, the Chair may impose a time limit on individual testimonies for both support and opposition.

Employees are hard to recruit & retain across the board due to noncompetitive pay; understaffing & lack of capacity is a near universal experience; agencies generally state they are asked to do more without accompanying funding increases
Attorney General could better recruit & retain, increase number of attorneys, & generally be more effective/efficient if permitted to utilize Consumer Settlement Fund as an Enterprise Model.
~1/3 of all court staff qualify for means-tested assistance (Medicaid, etc.), many have 2nd/3rd jobs, & turnover is very high; court security is a major concern; courts need automated transcription of proceedings that accurately identifies speakers; courts need to be able to pay jurors minimum wage
Treasurer needs to be able to hire Constitutionally mandated positions
The Secretary of State saw an unexpected increase in election costs
State Auditor's State Audit Fund has succeeded in helping smaller agencies w/o capacity to do their own audits get audits done. This has allowed these agencies to meet Executive Order requirement of current audit for receipt of Capital Outlay funds
Public Defender (PD) still significantly lacks attorneys (need 3X more attorney hours); have a 5 year plan to get there but will need the funding & decriminalization of low level crimes. PD still does not pay contract attorneys, who generally cover all of rural NM, on an hourly basis. (Wow, I did not know this.). Vacancy rate = ~9%. Atty vacancy rate = 13.9%. Rep. Herndon asked for an attorney staffing comparison w/ DA's Offices. Chair stated that PD Comm'n is much better.
Corrections (NMCD): Executive recommended ~$1.3M increase in Inmate Management & Control (IMAC), while LFC recommendation is ~$1.1M below the Executive recommendation. Executive recommended $1.7M increase in Reentry, while LFC recommended a Reentry reduction of more than $550K. The Executive recommended a flat Community Offender Management (Probation & Parole) budget while LFC would reduce that budget by $1M reduction (I think this is what was said?). NMCD has asked for a $7M Supplemental to cover shortages in behavioral health & medical svcs, & IMAC staff salary & benefits. Part of their ask, in addition to severe austerity & cost savings, is to permit Corrections Industries to take over commissary operations w/ add'l $5M.
Number of UNM Office of Medical Investigator (OMI) autopsies should be at ~250 per pathologist, but cases are now at ~400 per pathologist, so likely need ~$1.25M more in funding

(2) Bill also expunges evictions for other than nonpayment of rent
(3) Purported inability to enforce judgments after 5 years when they have 14 years to enforce an eviction monetary judgment

Duty of the prevailing party to hold onto the judgment & can still enforce
Prevailing party will have waited more than 5 years to recover unpaid rent/damages
Several committee members, including Chair Chandler, seemed very concerned that LLDs have 14 years to enforce an eviction monetary judgment
Towards the end of the hearing, Speaker Martinez asked what percentage of evictions are because people just had something happen in their lives that caused them to be short on rent
Rep. Anyanonu did not immediately have that answer, but said that she believed that NMCHL might and would try to get that data
I think that number is at or above 90% of evictions are for nonpayment of rent

Hall raised the boogeyman spectre of a small LLD being sued for doing what a LLD traditionally has done to figure out how much to charge for a unit, which is not targeted by this bill
This ignores the fact that there is no capacity to sue on behalf of tenants in NM
Legal Aid is not taking any cases and purportedly has not taken a housing case since summer 2024
No other legal service provider has capacity
Rep. Romero pointed out this bill is about housing market manipulation (and price-fixing)
Chair Chandler explained that this situation is like "dynamic pricing," using airline tickets as an example

Said that the law "may" interfere with federal fair housing law
My counter: No, and he likely knows that. HUD does not like landlords who discriminate against renters with a voucher and has reported on it for decades.
Moreover, NM does not have, and no NM locality has, a housing anti-discrimination law that is legally "substantially similar" to the federal Fair Housing Act, so there is no federal fair housing dollars that flow into the state for federal compliance, investigation, or enforcement
Finally, said interferes w/ private property rights
My counter: maybe a little, but vouchers=cash, just like any other money.
Rep. Lord sorta demonstrated the discriminatory tendencies in her hypothetical questions by assuming that folks with vouchers would be worse tenants than someone making $80k/year that works with the Labs
She also admitted in a Saturday 2/22/25 hearing that she is a landlord
A few people spoke in support in real life, including a woman who lived in a place with a voucher in Santa Fe for 30 years when the place was sold. She said she almost became homeless because no one would take her voucher.
Kat Sanchez of Bold Futures spoke how someone with a HOPWA voucher in Las Cruces almost met the same fate
I also spoke in support, pointing out that refusal to take vouchers can lead to homelessness and that NM landlords have the 6th worst voucher uptake in the nation

LLD can block access if payment late as little as 5 days
Cuts time when LLD can sell tenant property in half from 90 days to 45 days
So, if late 30 days, property can be sold at 45 days
This includes vehicles, boats, trailers, etc.

CONTROVERSIAL BILL
The Counties and their Assessors are strongly opposed
I don't quite understand how the Counties would lose substantial funding, but that seems to be the primary concern
Wirth will bring Floor Amendments in attempt to address
The draft voted on had not been shared w/ the Counties/Assessors
(Tax is not my area, but trying my best to convey what I thought I understood):
Apartment complexes are supposed to file an affidavit of property value with the Assessor each time it is sold/transferred
NMEPD knows a ton of complexes have been sold in the last few years as out-of-state owners take over more and more complexes
Industry has refused to file these for the last 30 years
Apartment complexes are considered "residential," so they are subject to the 3% max increase in property taxes each year
Got a little lost here-seems like complexes could soon be subject to a huge property tax increase because property value has not been updated for that 30 years (lightning tax?)--maybe??
So it seems like this could be a MASSIVE tax break of some sort, [my opinion--which is not necessarily a bad thing if they share the wealth somehow]
Got a little lost here, too-Sen. Muñoz quickly explained something about when the state gives tax breaks, the Counties do not pass on that reduction & instead keep that reduction as an addition to County taxes--maybe??
I know this happens when the State reduces GRT
CONCERNS ABOUT PRESENTATION
Industry would not admit that rent increases were not purely supply based even though members of both Parties questioned them about this (think RealPage price-fixing)
I think Sen. Muñoz said something like that the rent increases in his district were (all?) attributable to utility increases, 30% of which was water. Particular to Mobile Home Parks??
It seemed like the experts said that if they didn't get the tax break, they would just:
(1) Absolutely not build in New Mexico OR
(2) Increase existing rents by $250/month for each unit
It seemed like the idea of passing some of the savings on to renters from the tax break is/was just impossible--maybe because business can only focus on profit, so reducing profit is just never an option??
The experts estimated the unit shortage at 30,000 instead of the ~45,000 we know about
MOST OF THAT ~45,000 UNIT SHORTAGE IS FOR HUD-DEFINED EXTREMELY LOW INCOME (30% OF AREA MEDIAN INCOME)
It also didn't seem like building/development of multi-family complexes arising from this tax break would be "affordable"
There seems to be different classes of units, A, B, C, & D, I think. I'm not sure if A or D is the lowest priced.
But the experts seemed smart if not completely honest

Sen. Ramos stated fees are not an issue in rural NM
(This is likely because large developers generally will not build in our rural areas, though we need them to)

Comments & messaging (including mine) probably confused the committee into thinking that this bill tackles all irrational (tenancy) fees but actually only tackles those at the entry/application stage -- aka ACCESS to housing
Industry repeatedly states that NM's housing issues are only a matter of short supply
Industry states that the bill is unclear
This year, Industry seems to be attacking the bills by indirect opposition and perhaps muddying the waters/confusing the legislators.
The Apartment Associaiton stated that they had nothing to do (or words similar to that) w/ the failure of the Uniform Owner Resident Relations Act (UORRA) deal that Industry had worked out w/ housing advocates for Session 2023. That's only possible if one of the other Industry groups blocked the deal.
We know that Industry pulled out of that deal because of the passage of Source of Income Discrimination in the City of ABQ. (As part of negotiations, the advocates had agreed to remove Statewide Source of Income Discrimination from the proposed UORRA bill.).
For 2024 Session, the Executive had given strict instruction that no bill that touched UORRA should go and would not make it. Other Legislative leadership told advocates they must be more organized.
The Apartment Association appeared to indicate that they now thought that a UORRA redo was the better answer when compared to the various legislation put forward this year.
Later in the process, Sen. O'Malley repeatedly stated that she did not want to kill the bill
Sen. Sharer attempted to separate the fees that landlords charge from any housing problem that leads to homelessness or public safety issues.
Sen. Sharer also raised the "boogeyman" spectre of a landlord being sued.
There is no capacity to sue any/all of these landlords in NM, which should be a market force for consumer protection compliance.
Legal Aid is currently taking no new cases and has reportedly taken no housing case since ~June 2024.
Sen. Figueroa perfectly understood the bill as a consumer protection matter
