Background location notice: RoadsTrak collects your device’s precise location in the background, including when the app is closed or not in use and when no load is assigned to you, for as long as you allow location access. Your location is shown to shipment participants only while a load assigned to you is in progress. You can stop location collection at any time in your device settings. See Section 5.
Roadsmax Inc. (“Roadsmax,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect Personal Information in connection with the RoadsTrak driver mobile application, load-assignment and verification text messages, shareable load-tracking links, and related shipment-visibility services (collectively, the “Services”).
This policy covers information processed to deliver load assignments to drivers, verify driver access, collect driver location, record load and location status updates and late reports, and provide shipment visibility to Roadsmax and authorized shipment participants. It does not describe unrelated carrier onboarding, payment processing, or other Roadsmax services.
Carriers, brokers, shippers, and other business partners that receive information through the Services handle it under their own privacy policies. This policy does not govern their practices.
Depending on your use of the Services, we collect or receive:
Cellphone number: used to deliver load assignments, verify access to the app, and send service text messages. Access to your loads is tied to this number.
Name: your name, as provided with a load assignment.
Verification information: information used to validate the one-time verification code and record whether phone verification succeeded.
Load information: load identifiers, the pick-up and drop-off locations associated with a load, load and location statuses, and related timestamps.
Precise location and timestamps: location information from your mobile device and the times it was recorded, collected in the foreground and background while location permission is granted, including when no load is assigned to you.
Status updates and late reports: status updates you submit for a load or its pick-up and drop-off locations, late flags you raise or clear, and the reason you select (Traffic jam, Breakdown, Unscheduled Stop, or Other).
Device information: push notification token, device model, operating system and version, app version, and related technical identifiers.
Diagnostics and usage information: crash reports, error logs, performance data, and in-app usage events collected through our analytics and crash-reporting providers.
Communications: information you provide when contacting us about the Services.
We associate location, status, and late-report information with the applicable load and its pick-up and drop-off locations. The Services do not require you to create an account or password, or to submit a commercial driver’s license, insurance documents, employment history, payment details, or digital signatures.
Directly from you: when you verify your phone number, submit status updates, raise or clear late flags, or contact us.
Automatically from your device: precise location and timestamps (subject to your device permissions), device information, push notification tokens, and diagnostics and usage information.
From others: we receive your cellphone number, name, and load details from Roadsmax personnel, or from the carrier, broker, shipper, or other authorized business partner that assigns a load to you, including through our application programming interface (API).
When a load is assigned to you, you receive a text message with the load details and a link that opens RoadsTrak, or directs you to the app store if the app is not installed. The first time you use the app, you complete a one-time verification using a code sent by text message. Later loads assigned to the same cellphone number open directly in the app without further verification.
No one can view or update a load in the app without the cellphone number it was assigned to. There is no separate tracking-acceptance step: location collection begins once you grant location permission on your device, and you may decline or later revoke that permission (see Section 5).
We send text messages only for verification and service purposes, such as load assignments and verification codes. We do not send marketing text messages. Message frequency varies with your loads. Message and data rates may apply. Reply STOP to opt out or HELP for help. If you opt out, you may not receive load assignments by text message.
We do not sell, rent, or share your mobile number, text-message opt-in data, or consent with third parties or affiliates for their marketing or promotional purposes.
When you allow RoadsTrak to access your location, the app collects your device’s precise location whenever it is open or running in the background, including when you are not actively using it. Collection is not limited to active loads: it continues between loads, during rest periods, overnight stops, and off-duty time, for as long as location permission is granted and the app remains installed.
Location updates depend on connectivity, device settings, permissions, and other technical conditions. They may be delayed, interrupted, or unavailable.
While a load assigned to you is in progress, we use your location to:
Display your position to authorized Roadsmax personnel on our live map.
Provide your position to the business partner associated with the load, including through an embedded map it may show to its own users.
Display your position on the load’s shareable tracking link.
Detect when you are near a pick-up or drop-off location and remind you to update its status.
Detect when the app has stopped sending location and remind you to reopen it.
When no load assigned to you is in progress, we store your location but do not display it on the live map, tracking links, or embedded maps, and do not make it available to business partners. Access is limited to authorized Roadsmax personnel for support, troubleshooting, security, fraud prevention, dispute resolution, and legal compliance. We will not use location collected outside an in-progress load for a new purpose without first updating this policy and providing notice, and obtaining consent where required by law.
Each load is either In Progress or Completed. Each pick-up and drop-off location is Pending, Arrived, or Completed. You or Roadsmax personnel update these statuses manually; the Services do not change them automatically.
You can raise a late flag for any location on your load, with a reason from a fixed list, and clear it when it no longer applies. Late flags and reasons are shared with Roadsmax and the business partner associated with the load, and may be emailed to the load’s client when late notifications are enabled for that load.
RoadsTrak sends push notifications to remind you to reopen the app when it stops sending location during an in-progress load, and to remind you to update a location’s status when you are nearby. You can turn off push notifications in your device settings; if you do, these reminders will not be delivered.
You can stop location collection at any time by setting RoadsTrak’s location permission to “Never” or “Don’t Allow” in your device settings, or by uninstalling the app. Choosing “While Using the App” limits collection to when the app is open on screen.
Limiting or disabling location access interrupts location-based shipment visibility for your loads. You may need to coordinate another way to provide shipment updates with Roadsmax or the applicable carrier.
When a load is completed, its tracking link becomes inactive and the load is removed from the live map. Completing a load, revoking permission, or uninstalling the app does not delete previously collected information, which remains subject to Section 9.
We use information to:
Deliver load assignments, verification codes, and service text messages.
Verify access to the app and to your assigned loads.
Collect, display, and share location as described in Section 5.
Record and display load and location status updates and late reports.
Send push notifications, and send status and late-report notifications to Roadsmax, business partners, and clients as configured for each load.
Coordinate shipment operations and respond to shipment-related questions or disputes.
Provide support, diagnose crashes and errors, monitor performance, and maintain and improve the app.
Maintain security and prevent fraud, unauthorized access, and misuse.
Comply with legal obligations and establish, exercise, or defend legal claims.
Evaluate or complete a merger, acquisition, restructuring, or other business transaction involving the Services.
We use information only as reasonably necessary and proportionate to the purposes described in this policy, or for another purpose disclosed to you with consent where required.
We may disclose information:
To authorized Roadsmax personnel supporting your loads or the Services.
To the carrier, broker, shipper, or other authorized business partner that created or is associated with your load, including through our API, webhooks, and embedded maps. This may include your name, cellphone number, load details, status updates, late reports and reasons, and your live location while that load is in progress.
To a load’s client or other shipment participants, through the load’s tracking link and email notifications, as configured for that load.
To hosting, text-messaging, email-delivery, mapping, push-notification, analytics, crash-reporting, and other technology service providers that process information on our behalf to support the Services.
To comply with applicable law, lawful requests, court orders, or other legal processes.
To prevent fraud, investigate misuse, maintain security, enforce agreements, or protect rights and safety.
In connection with a merger, acquisition, restructuring, sale of assets, or similar business transaction.
At your direction or with your consent.
Each load has a tracking link that requires no login. It shows your current position on a map with basic load information and, if enabled by whoever created the load, driver information (such as your name and contact number) and late reports. Anyone who has a valid link can view the information it shows. The link becomes inactive automatically when the load is completed. Recipients should share links only with intended shipment participants.
We do not sell Personal Information or share it for cross-context behavioral advertising, as those terms are defined under applicable California law. We do not use location information for advertising.
Precise geolocation may qualify as Sensitive Personal Information under applicable law.
We use and disclose precise location information to provide shipment visibility for your loads, support related shipment operations, send location-based reminders, maintain security, resolve shipment-related disputes, and fulfill legal obligations, as permitted by applicable law. We do not use it to infer characteristics about you.
Where applicable law provides a right to limit particular uses or disclosures of Sensitive Personal Information, you may submit a request using the contact information in Section 16.
We retain information only for as long as reasonably necessary to provide the Services, verify shipment activity, resolve disputes, maintain security, and satisfy applicable legal obligations.
Retention periods vary by information category. We consider whether a load is in progress, whether information is needed for a claim or dispute, applicable legal requirements, and the sensitivity of the information.
Verification codes are used for access verification and are not kept as permanent records. Verification outcomes, cellphone numbers, names, load records, location history, status updates, late reports, device information, and diagnostics may have different retention periods according to their purposes.
We do not apply a blanket seven-year retention period to all precise location information. We retain location history, including location collected when no load is in progress, only for as long as reasonably necessary for the purposes described in this policy.
When information is no longer needed, we delete or de-identify it, subject to legal holds and applicable requirements. Copies in backups may remain until overwritten or deleted through the normal backup cycle.
We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, use, disclosure, alteration, and destruction.
No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
Do not share verification codes or forward load-assignment messages to unauthorized persons. Contact us if you believe someone has accessed your loads without authorization.
You may:
Decline, limit, or revoke location permission through your device settings.
Turn off push notifications through your device settings.
Reply STOP to opt out of text messages.
Uninstall the app to stop all further collection from your device.
Request access to, correction of, or deletion of your information, subject to applicable law.
If you decline or revoke location permission, location-based shipment visibility will not be available or will be interrupted. Coordinate any alternative shipment-reporting arrangements with Roadsmax or the applicable carrier.
RoadsTrak does not use accounts. To request deletion of your data, email support@roadsmax.com with the subject “RoadsTrak Data Deletion Request” and include the cellphone number used with the app. We may verify your request by sending a code to that number.
We will delete or de-identify your cellphone number, name, location history, status updates, late reports, device information, and diagnostics associated with that number, except information we must keep for an in-progress load, an open claim or dispute, security, or legal obligations. We will tell you what we retained and why. Uninstalling the app does not by itself delete your data.
To submit any other privacy request, email support@roadsmax.com or write to the address in Section 16. Describe your request and provide enough information for us to identify the relevant records. We may verify your identity before responding and will request only information reasonably necessary to do so.
Where applicable California privacy laws cover our processing, California residents may have the right to:
Know the categories and specific pieces of Personal Information collected about them.
Know the sources of that information, purposes of processing, and categories of recipients.
Request deletion, subject to applicable exceptions.
Correct inaccurate Personal Information.
Opt out of sale or sharing for cross-context behavioral advertising.
Limit certain uses and disclosures of Sensitive Personal Information.
Exercise privacy rights without unlawful discrimination.
As stated above, we do not sell Personal Information or share it for cross-context behavioral advertising.
You may submit requests using the contact information in Section 16. Authorized agents may submit requests on your behalf, subject to verification of their authority and any identity verification permitted by law.
We respond within the time required by applicable law. Where the California Consumer Privacy Act applies, we generally respond to requests to know, delete, or correct within 45 calendar days, subject to permitted extensions and required notice.
We may retain information where permitted or required by law, including to complete transactions, maintain security, fulfill legal obligations, or establish, exercise, or defend legal claims.
Roadsmax operates in the United States. Information may be processed in the United States and other locations where our service providers operate.
Privacy laws in those locations may differ from those in your jurisdiction. Where applicable law requires safeguards for international transfers, we implement the required measures.
The Services are designed for professional transportation activities and are not directed to children under 13.
We do not knowingly collect Personal Information from children under 13. If you believe a child under 13 has provided information to us, contact support@roadsmax.com so we can investigate and take appropriate action.
We may update this policy from time to time and will revise the “Last Updated” date when changes are made.
We provide notice of material changes through the app, by text message where appropriate, or by another method required by law. Where required, we obtain consent before implementing a new use of Personal Information.
