Welcome to Blushy! These Terms and Conditions ("Terms") govern your use of the Blushy mobile application ("Application"), provided by Blushy, Inc. ("we", "us", or "our"). By downloading, accessing, or using our Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

1. Acceptance of Terms

By creating an account and using the Application, you agree to comply with and be legally bound by these Terms.

2. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.

3. Privacy Policy

Your access to and use of the Application is also governed by the Privacy Policy of Blushy, Inc. This policy outlines our practices regarding the collection, use, and disclosure of personal information we receive from users of the Application. By using the Application, you agree to the collection and use of information in accordance with this policy.

Information Collection and Use:

Instagram Data: We access and retrieve your Instagram ID, username, and publicly available photos to provide our services, including identifying cloth types and suggesting similar products.

AI Image Processing: Our AI analyzes photographs to extract information such as patterns, colors, and styles, which is used to enhance filter and search options within the Application.

No Sensitive Data: We do not collect sensitive information like credit card details.

4. Account Registration, Deletion, and Deactivation

Registration: To use the Application, you must register and log in using your Instagram account.

Account Deletion/Deactivation: Users may delete or disable their account at any time. All associated photos will be immediately deleted. Users forfeit any right to unpaid commissions upon account deletion or deactivation.

Photo Permission: By registering, you grant permission to use your Instagram photos within the Application.

5. Intellectual Property Rights

The Application and its contents are owned by Blushy, Inc., and are protected by international copyright and trademark laws.

6. User Content, Sharing, and Monetization

Content License: Users grant Blushy, Inc. a license to use, store, and display content posted on the Application.

Sharing: Users can share any profile and photos through the Application.

Earnings: Users earn commissions on sales linked to their Instagram photos. Earnings over 100 USD will be paid out by Blushy, Inc. Users cannot request payment for earnings under 100 USD.

7. Photo Permissions

Users control whether their photos are listed or unlisted in the Application.

8. Third-Party Links and Products

We are not responsible for the content or practices of third-party sites or products linked in the Application.

9. In-App Purchases

In-app purchases are subject to Apple's standard policies and guidelines.

10. User-Generated Content and Moderation

We reserve the right to remove content that violates our policies or is deemed inappropriate.

11. Disclaimer of Warranties

The Application is provided "AS IS" and "AS AVAILABLE", without warranties of any kind.

12. Limitation of Liability

Blushy, Inc. is not liable for indirect, incidental, punitive, or consequential damages.

13. Governing Law

These Terms are governed by the laws of the United Kingdom and subject to the exclusive jurisdiction of its courts.
