Definitions DACA: Deferred Action for Childhood Arrival (DACA)
On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of 2 years, subject to renewal. They are also eligible to request work authorization. Deferred action is an exercise of prosecutorial discretion to defer removal action against an individual for a certain period of time. Deferred action does not provide lawful status. On Aug. 30, 2022, DHS published the DACA Final Rule, with the intent to preserve and fortify the DACA policy. This rule, which puts into effect regulations at 8 CFR 236.21 236.25, rescinds and replaces the DACA guidance set forth in the 2012 Memorandum issued by Secretary Napolitano.
Consideration of Deferred Action for Childhood Arrivals (DACA)
The USCIS DACA Program offers two years of protection for undocumented individuals who arrived in the U.S. as young people. DACA beneficiaries can renew their status before it expires.
DREAMers: Development Relief and Education for Alien Minors (DREAM)
In the last few years, the term “DREAMer” has been used to describe young undocumented immigrants who were brought to the United States as children, who have lived and gone to school here, and who in many cases identify as American. The term DREAMer originally took its name from the bill in Congress, but it has a double meaning about the undocumented youth who have big hopes and dreams for a better future.
Is a term used to define individuals who do not currently hold legal status, either by way of unauthorized entry to the U.S. or overstaying the terms of their authorized period of legal status.
