offers postal services concerning both domestic and international mailings, under the following conditions:
LUCAN TRANSPORT LTD. accepts mail items presented by the sender, properly packaged, with an opaque outer cover that does not allow the content to be seen, and that has complete identification details of the recipient.
The responsibility of packing mail items, as well as writing the data on the postal item, belongs to the sender.
Mail items that contain fragile goods must be appropriately packed by the sender, using sawdust, shock-absorbing polystyrene or another material that dampens the mechanical shock, and should be labeled "Fragile". LUCAN TRANSPORT LTD. undertakes to acknowledge and respect the inscriptions/labels applied by the sender and to pay special attention in handling and storing the postal items in question.
LUCAN TRANSPORT LTD. is not responsible for any alterations to the postal item by means or causes electromagnetic (for example, demagnetization, X-ray scanning as part of security/customs procedures etc.).
The maximum accepted dimensions of the postal item:
210 mm X 297 mm (A4 format) for envelopes;
50 cm X 70 cm X 120 cm for parcels.

LUCAN TRANSPORT LTD. does not accept postal items whose packaging bears inscriptions that contravene public order or good morals, as well as postal items consisting of goods that contravene public order or good morals, if they are submitted unpacked or in transparent packaging. Also, goods whose transport is prohibited by legal provisions, even on a portion of the journey (for example, but not limited to: explosive, toxic, flammable, psychotropic substances, drugs, weapons or parts thereof, ammunition etc) cannot be the subject of postal items.
The sender has the obligation not to introduce into the postal network postal items whose object is prohibited by legal provisions.
LUCAN TRANSPORT LTD. ensures the secrecy of postal items - the retention, opening or disclosure of the content of postal items is allowed only under the conditions and with the procedure provided by law.
In the case of international postal items, both parties will additionally comply with the legal provisions incident in the customs field, as well as the legislation of the states on whose territory postal service operations are performed and those transited by the postal item..
LUCAN TRANSPORT LTD. does not provide postal services for items with declared value.
Delivery of postal items is made to the address indicated by the sender, as the case may be, to the recipient's post office box or personally to the recipient or to a person authorized to receive the postal item.
In case of impossibility to deliver the postal items to the recipient (or authorized person), LUCAN TRANSPORT LTD will notify the recipient through a notice announcing the arrival of the postal item and will keep the postal item that could not be delivered to him, for delivery at the contact point, for a period of 5 days from the date of its notice.
LUCAN TRANSPORT LTD.will return the postal item that could not be delivered to the recipient for one of the reasons provided by law, to the sender's address, at the sender's expense (according to the rates indicated in the commercial offer), within 15 working days for domestic postal items, or within 17 working days for international postal items, the period being calculated, as the case may be, from the date of expiration of the storage period or attempted delivery.
In case of non-compliance with delivery times and return terms, as established in this document, for all postal services, LUCAN TRANSPORT LTD will respond to the user by refunding 15% of the tariff collected for the respective service.
In the case of postal items that could not be delivered to the recipient and were not returned to the sender, LUCAN TRANSPORT LTD. will keep these postal items available for 3 months from the date of their submission. After the expiration of this period, unclaimed postal items pass from the property of the sender to the property of LUCAN TRANSPORT LTD.
LUCAN TRANSPORT LTD has the right to refuse delivery to the recipient of the postal item when, after taking over the postal item, it is undoubtedly found that it contains goods forbidden for transport or which do not comply with the special conditions of transport established according to the legislation in force, or the legislation of the countries on the territory of which delivery is planned or which are to be transited, or when, after taking over the postal item, it has caused or can imminently cause damage to people, the environment, used facilities or other postal items.
LUCAN TRANSPORT LTD, is liable, in case of loss, theft or total destruction, for domestic postal items, with a sum representing 5 times the service tariff.
In case of loss, theft or total destruction, in addition to the compensations mentioned above, the tariffs collected at the deposit of the postal item are also refunded.
In case of partial loss or destruction or damage, LUCAN TRANSPORT LTD is liable for domestic postal items with a sum representing 5 times the service tariff.
To the amounts mentioned above is added the legal penalizing interest that runs from the moment of the introduction of the preliminary claim or, as the case may be, of the introduction of the request for summoning to court, regardless of which of these moments comes first.
Total loss of content is equivalent to the loss of the postal item.
In the situation of non-performance of services that constitute additional features of postal services, nominated by the sender through special indications, only the tariffs additionally collected compared to the applicable tariff for the standard postal service are refunded.
LUCAN TRANSPORT LTD is responsible for international postal items in accordance with the provisions of the national legislation applicable to domestic postal items.
LUCAN TRANSPORT LTD is exempt from liability in the following situations:
the damage occurred as a result of the sender's or recipient's act;
the user does not have a postal box installed that allows the delivery of postal items or it does not ensure the security of postal items or, as the case may be, does not have a service designed for receiving postal items;
the shipment was received without objections by the recipient, except for complaints related to the loss, theft, damage or total or partial destruction of the content of the postal item;
the damage occurred as a result of a force majeure event or fortuitous case; in this case, the sender has the right to reimbursement of the tariffs paid.
Complaint resolution mechanism received from users
LUCAN TRANSPORT LTD has established a complaint resolution mechanism, especially regarding the loss, theft, partial or total destruction, or damage of postal items, as well as non-compliance with the quality conditions of the services (delivery terms, return, etc.).
The sender or recipient unsatisfied with the service offered can make a complaint within 6 months from the date of posting.
The complaint of the user who considers himself wronged/unsatisfied will need to be made in writing and transmitted to the supplier by one of the following methods: by deposit, personally, at the headquarters or at the access through a postal service (recommended, with receipt confirmation) to the addres 251 the oaks Newbridge Co Kildare,, or by e-mail, at lucan@lucantransport.com.
LUCAN TRANSPORT LTD. will register the complaint received in the Complaints Register and will confirm to the petitioner the receipt thereof by the same method used for transmission by the user or by the method requested by this in the content of the complaint, for example: by handing over the registration number, in case the complaint was personally filed, by signing the receipt confirmation in case of receiving the complaint through a postal service with receipt confirmation, by written address in the situation of receiving the complaint through a postal service without receipt confirmation or by communicating the registration number by e-mail to the e-mail address from which the complaint was received.
In order to resolve the complaint, the complaining user will need to describe in the content of the complaint which he submits the event (facts, deeds and causes) related to the complaint, to formulate his claims, the chosen method of payment in case of compensation and the necessary information for transmitting the compensations (in the situation in which the complaint will prove to be founded), to attach to the complaint relevant evidence for carrying out our correct and complete analysis, appropriate to the complained event (such as, depending on the case, a copy of the document attesting the payment of the postal service, the invoice issued by the supplier, photos, the packaging of the postal item, the destroyed/damaged good that is the object of the postal item, a copy of the minutes of the findings etc.) and to provide any other information that might be useful to resolve the complaint.
LUCAN TRANSPORT LTD. representatives will analyze the received complaint taking into account both the evidence submitted by the petitioner, but also the relevant information/evidence provided by their own employees or third parties involved, being able, when the case, to request even an expertise.
The complaint will be resolved (implying, complaint analysis, response communication and compensation award) by LUCAN TRANSPORT LTD.within 3 months from the date of its introduction.
In case of complaints favorably resolved, LUCAN TRANSPORT LTD will compensate the user within 30 days from the date of completing the complaint analysis, without, however, exceeding the 3-month term mentioned above, the payment of the amounts due to the user being granted, depending on the request of the injured person, by postal order, by bank transfer .
In case the complaint addressed to the postal services provider LUCAN TRANSPORT LTD was not resolved satisfactorily or it was not responded to it within the term provided in these general conditions regarding the provision of postal services, the user in cause can submit, within a year from the date of posting, a complaint to the regulatory authority accompanied by evidence of fulfilling the preliminary complaint procedure or a summons to court. The summons to court can be filed regardless of whether a complaint with the same object has been submitted or not to the regulatory authority.
This document is an integral part of LUCAN TRANSPORT LTD, commercial offer, representing the general clauses of the individual contract that will be considered concluded between the sender and LUCAN TRANSPORT LTD. at the time of acceptance of the postal item in the postal network. The individual contract is concluded by accepting the supplier's offer by the sender, without a written document being necessary.
