Limits to Confidentiality
Please remember that we have a duty to report child abuse & endangerment
School counselors recognize their primary obligation regarding confidentiality is to the student but balance that obligation with an understanding of the family or guardians’ legal and inherent rights to be the guiding voice in their children’s lives (ASCA, 2016).
We might not be able to protect confidentiality if subpoenaed by a court of law.
If the student participates in small group we are not able to guarantee confidentiality from other participants.
We will disclose if substance use and treatment are concerns (CFR 42, Part 2; 2017).
