The U.S. Department of Education's Office for Civil Rights (OCR) enforces, among other statues, Title IX of the Education Amendments of 1972. Title IX protect people from discrimination based on sex in education programs or activities that receive Federal financial assistance.
Title IX states: No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Is the unwelcome conduct determined by a reasonable person to be so severe, pervasive and objectively offensive that it effectively denies a person equal access to the school’s education program or activity.
The Final Rule expands the definition of "education program or activity" to include "locations, events, or circumstances over which the school exercised substantial control over both the respondent and the context in which the sexual harassment occurs."
