An Alaska Limited Liability Company With the purchase or participation in any course, training, or event provided by Prepper’s Pack LLC, dba IPTS (hereinafter “IPTS” or “Released Parties”), the individual hereinafter referred to as “Participant” enters this Liability Waiver and Covenant Not to Sue (“Waiver”) effective on the date of course purchase or course attendance.
1. Consideration In consideration for the Released Parties permitting Participant to enter, access, or use any training area, facility, off-site location, equipment, or online platform for participation in any IPTS course(s), Participant agrees to the following terms.
2. WAIVER OF NEGLIGENCE
BY ACCEPTING THIS AGREEMENT, PARTICIPANT AGREES TO WAIVE ANY AND ALL CLAIMS FOR NEGLIGENCE AGAINST THE RELEASED PARTIES ARISING OUT OF OR RELATED TO PARTICIPATION IN ANY IPTS COURSE(S), INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH, WHETHER SUCH LOSS OCCURS DURING OR AFTER THE COURSE(S).
3. ASSUMPTION OF RISK Participant acknowledges that firearms training, defensive tactics, combative, physical fitness, scenario-based training, and related activities are INHERENTLY DANGEROUS and may result in SEVERE INJURY OR DEATH. Participant voluntarily assumes all risks, including but not limited to:
· Live-fire shooting; ricochets; catastrophic firearm malfunction; impact from bullets, fragments, or debris.
· Use of Non-Lethal Training Ammunition (“NLTA”), including intentional and unintentional impacts causing bruising, lacerations, fractures, vision loss, punctures, paralysis, or death.
· Use of vehicles, aircraft, or mechanical equipment in operational or non-operational condition, including collisions or rollovers.
· Training in low-light/no-light conditions, adverse weather, uneven terrain, or structures including shoot houses or temporary constructions which may collapse or conceal hazards.
· Combative, grappling, self-defense drills, and physical contact with instructors or other participants that may cause sprains, concussions, broken bones, airway restriction, or other injuries.
· Physical fitness activities including weight training, running, sprinting, calisthenics, or endurance drills.
· Simulated medical care including chest seals, tourniquets, simulated blood, gloves, lifting/carrying, and risks associated with being dropped or carrying others.
· Exposure to breaching charges, explosive devices, flash-bangs, chemical agents (CS, OC), tasers, bean-bag rounds, or other less-lethal devices.
· Participation in K-9 training including risk of dog bites, mauling, infection, and related injuries.
· Being struck by objects thrown or unintentionally projected by others.
· Participant acknowledges that risks may be unknown, unpredictable, and unavoidable.
4. RELEASE OF LIABILITY Participant hereby RELEASES the Released Parties from any and all liability, including liability for property damage, personal injury, illness, paralysis, or death, arising from Participant’s entry onto any training location or participation in activities associated with IPTS.
5. COVENANT NOT TO SUE Participant agrees never to initiate, join, or maintain any lawsuit or claim against the Released Parties for any damages arising from participation in IPTS activities, whether occurring on IPTS property, off-site locations, or online instruction. “Released Parties” includes IPTS and all owners, officers, members, managers, employees, volunteers, instructors, independent contractors, representatives, insurers, successors, and assigns.
6. OFF-SITE & ONLINE TRAINING This Waiver applies equally to all instruction conducted:
· On IPTS-controlled property
· On third-party property
· At rented/designated training locations
· Online or virtual environments
· Released Parties are not liable for any injuries or damage occurring during travel to or from any training location or while participating in online activities.
7. BINDING EFFECT This Waiver is binding on Participant and Participant’s heirs, family members, agents, assigns, estate, and legal representatives.
8. CONDITION OF PREMISES Participant accepts all training locations “AS IS.”
Released Parties have no duty to warn of hazards including but not limited to uneven terrain, debris, structures, wildlife, animals, machinery, environmental conditions, or hidden dangers.
9. CONDUCT & USE OF PROPERTY Participant agrees to:
· Treat all training areas with respect
· Avoid damaging property
· Refrain from leaving trash
· Conduct themselves courteously toward staff, instructors, residents, and other participants
10. RESTRICTED ACCESS Participant’s access is limited to designated training areas and only during the dates and times of the course(s).
11. FIREARMS USE Participant may only discharge firearms under direct supervision of IPTS staff and only in designated areas. Discharging firearms in any unsafe direction or outside approved areas is prohibited.
12. INDEMNIFICATION Participant agrees to INDEMNIFY AND HOLD HARMLESS the Released Parties from any claim, lawsuit, or cost—including attorney’s fees—resulting from:
· Participant’s participation
· Participant’s negligence or intentional acts
· Injuries to third parties
· Damage to property
· This applies even if claims allege negligence or gross negligence by the Released Parties.
13. PHOTO & VIDEO RELEASE Participant consents to the use of Participant’s image or likeness in photos, video, or livestreams for IPTS business, training, or promotional purposes and waives any rights to compensation or royalties.
14. PARTICIPANT MEDIA USE Participant may photograph or record portions of training for personal use only.
Posting, distributing, or publishing such content without written approval from IPTS is prohibited.
15. PROHIBITED USE OF COURSE MATERIAL All IPTS course content is proprietary. Participant agrees:
· Not to reproduce, instruct, resell, teach, or use IPTS curriculum for financial gain.
· Unauthorized use constitutes a material breach of this Agreement.
· IPTS may recover damages, profits earned, and attorney’s fees.
· All intellectual property rights remain with IPTS and its contracted instructors.
16. GOVERNING LAW & VENUE This Waiver is governed by the laws of the State of Alaska.
Exclusive venue for any dispute shall be the State of Alaska, Third Judicial District, regardless of where training occurred.
17. ACKNOWLEDGMENT AND AGREEMENT By purchasing, enrolling in, or participating in any IPTS course, Participant acknowledges and agrees that they have read, understand, and voluntarily accept all terms, conditions, waivers, releases, assumptions of risk, indemnifications, restrictions, and obligations contained in this Agreement.
Participant’s purchase or enrollment constitutes full and binding acceptance of this Waiver as if physically signed.
