Bill Info: This bill will be amended in the Senate. We are comfortable the amendments address the following concerns and have withdrawn our opposition.
Concerns: Expands protections for someone accused of misusing pesticides. By eliminating “faulty” and “careless” this legislation makes it more difficult to prove an individual or company misused pesticides. Striking these from the statute would expose workers and the public to greater harm. There are greater legal hurdles to demonstrate negligence.
We are concerned these changes will unreasonably limit the authority of Idaho State Department of Agriculture (ISDA) to respond to incidents such as in Parma, ID in May 2019 when an aerial applicator was suspected of flying low and applying chemicals in the area at the time farm workers started exhibiting symptoms of chemical exposure.[1]
Makes new requirements for rulemakings related to enforceable restrictions and penalties for pesticide users in the state. In the face of the recent chemical exposure of over one-dozen workers near the Idaho Legislature should be strengthening the laws and regulations regarding pesticide use/drift. If the pilots are better, the aviation technology is better, and the chemicals are better, shouldn’t we insist on a better regulatory and legal structure as well?

Bill Info: Creates yet another special interest sales tax exemption by adding agricultural, livestock, and wildlife conservation aircraft and parts to the list of tax-exempt commercial aircraft. Estimated impact to the general fund $100,000-$125,000. Impacts state revenue making us one step further from addressing the grocery tax.
