TERMS AND CONDITIONS
1. CONTRACT EFFECTIVITY - This Form represents the agreement between the Parties and shall become effective once signed by all the Parties.
2. DAILY RENTAL FEE - The rental fee is between FIVE HUNDRED PESOS to ONE THOUSAND FIVE HUNDRED PESOS per 4 square meters per 12-hours/day (PHP 500.00 - PHP 1,500.00/4sqm/day), depending on the proposed location and foot traffic. This is exclusive of actual utility consumption and other fees to be computed by the Business Management Division (BMD), if applicable.
3. For areas/locations without electrical provision, the client is required to provide their own generator set at their own expense, should they need a power supply.
The electricity rate is Php 15.00/kWh.
4. CHANGE OF SCHEDULE OR LOCATION AND/OR POSTPONEMENT - In case of transfer of schedule or location and/or postponement, the client is required to submit a signed letter personally or through email. The letter must be submitted not later than five (5) days before the actual date of the pop-up activity with complete details, such as the reason for rescheduling and the new date of the pop-up, etc.
5. OPERATING HOURS - The CLIENT shall operate strictly within the prescribed hours, unless otherwise approved in writing by IA. Failure to comply shall constitute a material breach of this agreement.
6. PRESCRIBED UNIFORM - Clients should be properly dressed, and at no instance will they be allowed to work in kamiseta or sando, shorts, slippers, or other similar forms of improper attire. They should at all times wear their IDs and uniforms during the function.
7. COURTESY AND COOPERATION - CLIENT shall at all times be courteous and cooperative in dealing with the maintenance crew of the Intramuros Administration, who will be assigned to the vending/common areas.
8. ORGANIZER’S UNDERTAKING. Organizer/s of vending, pop-up, and/or bazaar activities undertake/s to charge only reasonable fees to their respective vendors/merchants for participating in IA bazaars/pop-ups and other IA-managed concession activities consistent with applicable IA policy. Exorbitant fees shall be considered as a material violation of this undertaking and shall be a ground for blacklisting/disqualification from future IA bazaars/pop-ups and other IA-managed concession activities consistent with applicable IA policy.
9. LIABILITY/DAMAGE - CLIENT shall be held responsible for any damage caused by the client, its employees, agents, merchants, concessionaires, and representatives, to the facilities of the Intramuros Administration, as well as the protection of the general public. Nailing or mounting of props or any materials to walls and ceilings is not allowed.
10. DRONE USAGE - Use of drone cameras and/or fireworks is subject to the approval of IA and subject to the presentation of separate permits issued by the government agencies concerned. Application is through the IA-Urban Planning and Community Development Division. Copies of the permits shall be emailed to the Business Management Division at (business@intramuros.gov.ph) one (1) day before the scheduled pop-up; otherwise, the use of fireworks and/or drone cameras shall not be allowed.
11. CLEANLINESS, MAINTENANCE, WASTE MANAGEMENT, and SAFETY - CLIENT shall, at its sole expense, maintain the Leased Premises in a clean and sanitary condition, free from noxious odors, disturbing noises, hazardous defects, and inflammable materials.
Washing of dishes and utensils will only be allowed in the designated area/s.
The use of small LPG tanks (2.7 kg) or SuperKalan units is allowed only when accompanied by a readily accessible, functional fire extinguisher.
Any damage caused to the Leased Premises shall be on the sole account of the CLIENT.
Clients shall also be held responsible for keeping the place clean and free of equipment, furniture, and props after the pop-up activity. Clients shall provide sufficient garbage bags for waste materials and food waste for disposal. Garbage shall be disposed of at the following prescribed garbage collection points and schedule:

* Garbage collection time that will not be covered on the collection schedule shall be advised to
maintain the responsibility and management of the clients, considering the Waste Management
Rules and Regulations of the Intramuros Administration (IA).
*IA-provided garbage receptacles may also be utilized, still considering the proper waste management
and garbage disposal regulation.
11.1 Littering is strictly prohibited. Any person who commits acts of littering solid waste in any plazas, parks, sites, streets, or fortifications, including vacant lots or waterways, shall pay the following fines:
1st Offense: P500.00
2nd Offense: P1,000.00
3rd Offense: P3,000.00 per offense, without prejudice to the imposition of appropriate penalties under relevant laws and ordinances
11.2 Illegal Dumping - Anyone who dumps garbage at undesignated times and areas, such as plazas, parks, historical sites, roads, and fortifications, as well as in vacant lots and near waterways in Intramuros, is also strictly prohibited. Violations are as follows:
1st Offense : P2,000.00
2nd Offense: P4,000.00
3rd or More Offenses: P5,000.00 per offense, without prejudice to the imposition of appropriate penalties under relevant laws and ordinances.
11.3 Improper disposal of liquid substances - Any person who commits acts of Improper disposal of liquid substances such as used oil, gasoline, oil used in vehicles in any plaza, parks, sites, streets, fortifications, including esteros, canal and similar waterways within Intramuros, shall pay a fine not less than Eight hundred pesos (P800.00) but not more than Two Thousand Five Hundred pesos (P2,500.00) per offense, without prejudice to the imposition of appropriate penalties under relevant laws and ordinances.
11.4 Urinating, Spitting and Defecating in Historic Sites - Any person who commits acts of Urinating, Spitting and Defecating in any plaza, parks, sites, streets, fortifications, including vacant lots and waterways within Intramuros shall pay the following fines:
1st Offense: P500.00
2nd Offense: P1,000.00
3rd or More Offenses: P3,000.00 per offense, without prejudice to the imposition of appropriate penalties under relevant laws and ordinances.
11.5 Vandalism - Any person who commits any acts of vandalism within the Intramuros District shall, in addition to paying the expenses for restoration of the property vandalized, pay the following fines:
1st Offense: P5,000.00
2nd Offense: P8,000.00
3rd or More Offenses: P10,000.00 per offense, without prejudice to the imposition of appropriate penalties under relevant laws and ordinances.
11.6 Open Burning - Any person who commits acts of open burning of solid waste in any plaza, parks, fortifications, including vacant lots in Intramuros, shall pay the following fines:
1st Offense: P800.00
2nd Offense: P1,500.00
3rd or More Offenses: P3,000.00 per offense, without prejudice to the imposition of appropriate penalties under relevant laws and ordinances
12. CANCELLATION - In case of cancellation or non-usage of the area for any reason whatsoever, the client is required to notify the agency in writing to be submitted personally or through email, not later than five (5) days before the date of the pop-up.
13. REFUND - For a full refund of rental fees, cancellation must be made not less than five (5) days prior to the pop-up activity date. 50% refund - if cancellation is made less than five (5) days prior to the pop-up activity date. No refund will be given if cancellation is made within 24 hours prior to the pop-up activity date.
14. Bringing in pets is allowed as long as they are on a leash and subject to IA guidelines.
15. The Intramuros Administration will not be held liable for the unavailability of the premises because of fortuitous or manmade pop-up activity beyond the control of the Intramuros Administration. The Administration similarly reserves the right of cancellation upon notice to the undersigned/s and for any reason whatsoever.
16. In case of a brownout, the client shall provide their own generator at their own expense for all areas. Only minimal lighting and houselights will be provided by IA.
17. Engaging in any illegal activity, such as but not limited to any form of gambling, drug use, and/or sale, etc, is prohibited in the premises and will be dealt with in accordance with the law.
18. The Administration reserves the right at any time to change or rescind any or all the Terms and Conditions stipulated herein, or to make such other Terms and Conditions as in its sole judgment may from time to time be necessary for the management, safety, care and cleanliness of the Vending Premises/Area or Location, and for the preservation of good order herein, as well as for the convenience of the other clients and partners.
18. The client is allowed to enter the premises subject to the presentation of this ACCOMPLISHED AND APPROVED form signed by IA.
19. Any client found violating the foregoing guidelines will be banned by the Intramuros Administration.
20. WAIVER OF LIABILITY - The client and its listed merchants/vendors hereby RELEASE, WAIVE, DISCHARGE, AND AGREE NOT TO SUE THE INTRAMUROS ADMINISTRATION and its personnel for any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss or damage, personal injury, accident or illness (including death), and/or property loss, however, caused, arising from, or in any way related to, involvement of the person/s above during ingress/egress/pop-up activity proper, that may be sustained by me and the person/s stated above, or to any property belonging to the undersigned/s and the organization/entity he/she/they represent/s, while doing a transaction with the Administration.
