AI Image Generator: Photo AI

This privacy policy applies to the AI Image Generator: Photo AI app (hereby referred to as "Application") for mobile devices, created by Innovativlab LTD (hereby referred to as "Service Provider") as a commercial service. This service is intended for use "AS IS".
1. Information Collection and Use
The Application collects information when you download and use it. This information may include:
Your device's Internet Protocol address (e.g., IP address)
The pages of the Application that you visit, the time and date of your visit, the time spent on those pages
The time spent on the Application
The operating system you use on your mobile device
The Application does not gather precise information about the location of your mobile device.
For a better experience, while using the Application, the Service Provider may require you to provide certain personally identifiable information, including but not limited to Email, userId, and Gender. This information will be retained and used as described in this privacy policy.
The Service Provider may use the information you provided to contact you from time to time to provide you with important information, required notices, and marketing promotions.
2. Artificial Intelligence Features and Data Processing
The Application uses Artificial Intelligence (AI) technologies to enhance user experience and provide photo editing and image generation features. The AI components process user-provided images and inputs to deliver personalized content and automated functionalities. All AI processing is performed in accordance with this privacy policy and applicable laws.
When you use the AI-powered features of the Application, you may submit photos or images for processing. These are processed to generate or edit images as requested. The AI processing of your images is performed to deliver the service you have requested.
If the Application sends user data to a third-party AI service, the following applies:
Users are notified within the app before their data is sent to any third-party AI service.
The Application identifies what data will be sent and to whom.
The Application obtains your permission before sharing your personal data with any third-party AI service.

3. Face Data
3.1 Collection of Face Data
The Application includes AI-powered photo editing features that may process images containing human faces. When you submit a photo for editing or enhancement, the Application may process facial features within that image solely to perform the requested photo editing or generation task.
3.2 Use of Face Data
Face data processed by the Application is used exclusively for the following purpose:
To perform the specific AI photo editing or image generation task requested by the user at the time of submission.
3.3 Retention of Face Data
The Application does not retain face data. Face data contained in user-submitted images is processed in real time solely to fulfill the requested task and is not stored on the Service Provider's servers after the task is completed. Face data is not stored indefinitely.
3.4 Sharing of Face Data with Third Parties
The Application does not share face data with third parties for independent use, advertising, or any purpose other than fulfilling the requested image processing task.
If the Application uses a third-party AI service to process images (including those containing faces), the following applies:
Face data is transmitted only to the extent necessary to perform the requested task.
Third-party AI service providers used by the Application are required to process face data solely to fulfill the requested task and are prohibited from storing, sharing, or using face data for any other purpose.
These third-party providers do not retain face data after the task is complete.
The Service Provider takes reasonable steps to ensure that any third-party AI service provider used for image processing maintains privacy practices consistent with this policy.
3.5 User Consent for Face Data
By submitting an image that contains a face for processing within the Application, you consent to the processing of face data as described in this section. You will be informed within the Application before your image is processed or transmitted to any third-party AI service.
4. Third Party Access
Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways described in this privacy statement.
The Application utilizes third-party services that have their own Privacy Policies about handling data. Below are links to the Privacy Policy of the third-party service providers used by the Application:
The Service Provider may disclose User Provided and Automatically Collected Information:
As required by law, such as to comply with a subpoena or similar legal process
When they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request
With their trusted service providers who work on their behalf, do not have an independent use of the information disclosed to them, and have agreed to adhere to the rules set forth in this privacy statement
5. Account Registration and Guest Access
The Application does not require users to register or create an account to access core AI photo editing features. Users may freely access the main features of the Application without providing personal information.
Account registration may be required for account-based features such as saving preferences, accessing purchase history, or managing subscriptions. Registration is optional and only required where directly relevant to account-based functionality.
6. In-App Purchases and Subscriptions
The Application may offer In-App Purchases, including subscriptions and lifetime access options. All In-App Purchases are processed securely through Apple's App Store. The Service Provider does not collect or store payment information directly.
Upon completing a purchase, your subscription or purchased features will be activated and available within the Application. If you experience any issues with your purchase not being reflected in the Application, please contact the Service Provider at tech@innovativlab.com.
7. Opt-Out Rights
You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network.
8. Data Retention Policy
The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. Face data is not retained after the completion of the requested task.
If you would like the Service Provider to delete User Provided Data that you have provided via the Application, please contact them at tech@innovativlab.com and they will respond in a reasonable time.
9. Children
The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13. The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age.
In the case the Service Provider discovers that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider at tech@innovativlab.com so that they will be able to take the necessary actions.
10. Security
The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains.
11. Changes to This Privacy Policy
This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
12. Your Consent
By using the Application, you are consenting to the processing of your information as set forth in this Privacy Policy now and as amended by the Service Provider.
