1.1 ICDL Asia เป็นบริษัทที่จัดตั้งขึ้นในประเทศสิงคโปร์ เลขทะเบียนบริษัทคือ 201114405D และมีที่ตั้งสำนักงานจดทะเบียนอยู่ที่ เลขที่ 50 แรฟเฟิลส์ เพลส ชั้น 19 สิงคโปร์แลนด์ทาวเวอร์ ประเทศสิงคโปร์ 048623 (“เรา” หรือ “ของเรา”) เราเป็นผู้ควบคุมข้อมูล และมีความรับผิดชอบในข้อมูลส่วนบุคคลของท่านที่ถูกเก็บรวบรวมมาจากการดำเนินการที่ถือเป็นส่วนหนึ่งในการดำเนินการเพื่อการเพื่อให้การรับรอง

1.3 เรามีความยึดมั่นในการให้ความเคารพต่อความเป็นส่วนตัว และการปฏิบัติตามบรรดากฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคล และกฎหมายข้อมูลส่วนบุคคลที่เกี่ยวข้อง
2.1 เราประมวลผลข้อมูลส่วนบุคคลของท่านเท่าที่จำเป็น (ก) เพื่อการดำเนินการตาม “เป้าหมาย” ที่ระบุไว้ในตอนต้น และ (ข) ตามกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้อง ฐานกฎหมายที่เราใช้ในการประมวลผลในกรณีต่าง ๆ ที่ได้ระบุไว้อย่างเฉพาะเจาะจงได้แก่ฐานในกรณีต่อไปนี้
2.1.1 ฐานผลประโยชน์อันชอบธรรม (Legitimate Interest) เราประมวลผลข้อมูลส่วนบุคคลเมื่อมีความจำเป็นเพื่อประโยชน์อันชอบธรรมของเราในฐานะผู้ให้บริการตาม “เป้าหมาย” ซึ่งรวมถึงกิจกรรมต่าง ๆ ที่เกี่ยวกับการเรียนรู้ การฝึกอบรม การทดสอบ การควบคุมการสอบ และการให้การรับรอบ ในลักษณะเดียวกันกับการดำเนินธุรกิจตามปกติ เช่น การบริหารงานทั่วไป เช่น การแก้ปัญหา การวิเคราะห์ข้อมูล และการรักษาความปลอดภัยของข้อมูล
2.1.2 ฐานหน้าที่ตามกฎหมาย (Legal Obligation) เราอาจประมวลผลข้อมูลส่วนบุคคลของท่านเมื่อจำเป็นต้องปฏิบัติตามหน้าที่ตามกฎหมาย เป็นไปตามหน้าที่ในการปฏิบัติตามกฎเกณฑ์ และข้อบังคับต่าง ๆ รวมถึงในเรื่องเกี่ยวกับการบันทึก และเฝ้าติดตามการติดต่อสื่อสารต่าง ๆ และหน่วยงานกำกับดูแล หรือทางการ และการสอบสวนเหตุที่เกี่ยวกับความมั่นคงปลอดภัย และการป้องกันอาชญากรรม
2.1.3 ฐานความยินยอม(Consent) ในบางกรณีที่มีกฎหมายกำหนดไว้ เราประมวลผลข้อมูลส่วนบุคคลของท่านโดยเป็นไปตามฐานความยินยอมโดยเฉพาะเจาะจงและโดยได้รับข้อมูลของท่าน ตัวอย่างเช่น เราอาจใช้ข้อมูลของท่านเพื่อการส่งข่าว และจดหมายข่าวต่าง ๆ เกี่ยวกับ ICDL ติดต่อท่านในเรื่องเกี่ยวกับ ICDL หรือส่งข้อมูลตามที่ท่านได้ร้องขอให้แก่ท่าน
2.2 เราประมวลผลข้อมูลส่วนบุคคลของท่านตามประกาศเกี่ยวกับความเป็นส่วนตัวนี้ และกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้องเท่านั้น
2.3 เราอาจประมวลผลข้อมูลส่วนบุคคลของท่านโดยอาศัยฐานอันชอบด้วยกฎหมายเกินกว่าเพียงฐานใดฐานหนึ่ง โดยขึ้นอยู่กับวัตถุประสงค์เฉพาะเรื่องที่เรามีการใช้ข้อมูลนั้น ๆ
2.4 เราจะใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ต่าง ๆ ตามที่เรามีการเก็บข้อมูลมาเท่านั้น เว้นแต่ในกรณีที่เราเชื่อว่าจำเป็นต้องใช้ข้อมูลส่วนบุคคลของท่านเพื่อเหตุผลอื่นซึ่งเป็นไปตามวัตถุประสงค์ตั้งแต่แรกเริ่ม หากเราจงใจใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ที่ไม่เกี่ยวข้องกับที่ได้แจ้งไว้ ก่อนการประมวลผลข้อมูลครั้งนั้น ๆ เราจะอธิบายให้ท่านทราบถึงฐานกฎหมายที่ให้สิทธิเราในการดำเนินการดังกล่าว
3.1 เราจะไม่เปิดเผยข้อมูลส่วนบุคคลของท่านต่อบุคคลภายนอก เว้นแต่กรณีที่มีกฎหมายกำหนด หรือตามที่ได้ระบุไว้ในประกาศนี้
3.2 ในกรณีที่มีความจำเป็น เราอาจนำข้อมูลส่วนบุคคลของท่านที่เกี่ยวกับการเรียนรู้ หรือการดำเนินการเพื่อการให้การรับรองต่าง ๆ ของท่านไปใช้ร่วมกับบุคคลภายนอกที่เกี่ยวข้อง รวมถึง มูลนิธิ ICDL (ซึ่งเป็นเจ้าของ ICDL) พันธมิตรของสำนักงาน ICDL ในแต่ละเมือง หน่วยงานกำกับดูแล ศูนย์อบรม และทดสอบ และผู้ว่าจ้างต่าง ๆ
3.3 เราอาจนำข้อมูลส่วนบุคคลของท่านไปใช้ร่วมกับบริษัทอื่น ๆ ภายใต้การกำกับดูแลโดยตรงของมูลนิธิ ICDL ซึ่ง ICDL Asia ฐานะเป็นบริษัทลูกโดยการถือหุ้นทั้งหมด เพื่อวัตถุประสงค์ในการให้บริการระหว่างกันของบริษัทในกลุ่ม การให้บริการหรือการทำหน้าที่เกี่ยวกับการยื่นรายงานต่าง ๆ หรือการให้บริการด้านการบริหารงาน และบริการที่เกี่ยวข้องกับการบริหารงานต่าง ๆ กับเรา
3.4 นอกจากนี้ บริษัทยังอาจนำข้อมูลของท่านไปใช้ร่วมกับผู้ให้บริการที่เป็นบุคคลภายนอกซึ่งเป็นผู้ให้บริการแก่เรา ลักษณะผู้ให้บริการต่าง ๆ ดังกล่าวรวมถึงผู้ให้บริการเกี่ยวกับการจัดสอบอัตโนมัติ ผู้ให้บริการเนื้อหาในการเรียนรู้ ผู้ให้บริการลูกค้าสัมพันธ์ ผู้ให้บริการในการวิเคราะห์ข้อมูล ผู้ให้บริการโฮสติ้งข้อมูล ผู้ให้บริการเข็มสัญลักษณะ และการให้การรับรองดิจิทัล บริษัทที่ให้บริการเก็บรักษาข้อมูล และผู้ให้บริการทางวิชาชีพด้านไอที
4.1 ข้อมูลส่วนบุคคลของท่านอาจถูกส่งไปยัง และเก็บรักษาไว้ในสถานที่ที่อยู่นอกเหนือจากที่ ICDL Asia เป็นผู้บริหารงานซึ่งมีมาตรฐานในการคุ้มครองส่วนบุคคลที่แตกต่างกัน เราจะดำเนินการตามความเหมาะสมเพื่อทำให้แน่ใจได้ว่าการส่งข้อมูลส่วนบุคคลเป็นไปตามกฎหมายที่เกี่ยวข้อง และได้รับการจัดการด้วยความระมัดระวังเพื่อคุ้มครองสิทธิต่าง ๆ ในข้อมูลส่วนบุคคลของท่าน เพื่อใช้ในการอ้างอิง ICDL Asia ปฏิบัติตามข้อกำหนดของเขตเศรษฐกิจยุโรป (European Economic Area) (General Data Protection Regulation 2016/679). หากข้อมูลส่วนบุคคลของท่านถูกเก็บ และประมวลผลในเขตเศรษฐกิจยุโรป และถูกส่งไปนอกเขตดังกล่าว เราจะทำให้แน่ใจว่าข้อมูลส่วนบุคคลของท่านได้รับการคุ้มครองในระดับที่เหมาะสมโดยการใช้มาตรการป้องกันประการใดประการหนึ่งดังต่อไปนี้เป็นอย่างน้อย
4.1.1 เราจะส่งข้อมูลส่วนบุคคลของท่านไปยังประเทศที่ถือได้ว่าได้มีมาตรการในระดับที่เพียงพอในการคุ้มครองข้อมูลส่วนบุคคลตามมาตรฐานของคณะกรรมาธิการยุโรป (European Commission) เท่านั้น; or
4.1.2 เราอาจใข้ข้อสัญญาที่ได้รับความเห็นชอบจากคณะกรรมาธิการยุโรปโดยเฉพาะเจาะจงซึ่งให้ความคุ้มครองแก่ข้อมูลส่วนบุคคลในลักษณะเดียวกับที่ให้ความคุ้มครองในทวีปยุโรป
4.2 ท่านสามารถติดต่อเราได้ หากต้องการข้อมูลเพิ่มเติมเกี่ยวกับกลไกที่เราใช้ในการส่งข้อมูลส่วนบุคคลของท่านเป็นการเฉพาะ
5.1 เราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านเท่าที่มีความจำเป็นตามสมควรในการดำเนินการให้เป็นไปตามวัตถุประสงค์ในการใช้ข้อมูลที่ได้ให้ไว้เท่านั้น เราอาจเก็บข้อมูลส่วนบุคคลของท่านไว้เป็นเวลานานขึ้นในกรณีที่มีข้อร้องเรียน หรือหากเรามีเหตุผลให้เชื่อได้ว่าจะมีการติดต่อสื่อสาร หรือโต้ตอบกับท่านต่อไป
5.2 ในการกำหนดระยะเวลาที่เหมาะสมในการเก็บรักษาข้อมูลส่วนบุคคล เราพิจารณาปริมาณ ลักษณะ และความอ่อนไหวของข้อมูลส่วนบุคคล ความเสี่ยงที่อาจเกิดขึ้นจากการคุกคามจากการใช้หรือเปิดเผยข้อมูลส่วนบุคคลของท่านโดยไม่ได้รับอนุญาต วัตถุประสงค์ที่เรามีการประมวลผลข้อมูลส่วนบุคคลของท่าน ไม่ว่าเราจะสามารถบรรลุวัตถุประสงค์เหล่านั้นด้วยวิธีการอื่น ๆ ได้ และข้อกำหนดของกฎหมาย กฎเกณฑ์ หรือเการเก็บรักษาข้อมูลอื่น ๆ ที่เกี่ยวข้อง
5.3 ท่านมีสิทธิในการขอให้มีการลบข้อมูลส่วนบุคคลของท่าน โดยสามารถศึกษาข้อมูลในหัวข้อ“สิทธิต่าง ๆ ของท่านตามกฎหมาย” ในตอนล่างเพื่อเป็นข้อมูลเพิ่มเติม
6.1 หากท่านมีที่อยู่อาศัยอยู่ในสหภาพยุโรป (European Union) ท่านจะมีสิทธิต่าง ๆ ดังต่อไปนี้ในฐานที่ท่านเป็นเจ้าของข้อมูลส่วนบุคคลภายใต้กฎหมายคุ้มครองข้อมูลส่วนบุคคลของยุโรป
6.1.1 สิทธิในการเข้าถึงข้อมูล
6.1.2 สิทธิในการแก้ไขข้อมูลให้ถูกต้อง
6.1.3 สิทธิในการลบข้อมูล
6.1.4 สิทธิในการจำกัดการประมวลผล หรือคัดค้านการประมวลผลข้อมูล
6.1.5 สิทธิในการโอนย้ายข้อมูลไปยังบุคคลอื่น และ
6.1.6 สิทธิในการเพิกถอนความยินยอมของท่าน
6.2 ถึงแม้สิทธิต่าง ๆ เหล่านี้บางส่วนจะสามารถนำมาบังคับใช้ได้เป็นการทั่วไป แต่สิทธิบางอย่างจะสามารถนำมาบังคับใช้ได้เฉพาะในกรณีเฉพาะเท่านั้น และยังต้องเป็นไปตามข้อยกเว้นที่กำหนดไว้ภายใต้กฎหมายคุ้มครองข้อมูลส่วนบุคคลที่ใช้บังคับอีกด้วย
6.3 เราจะพยายามดำเนินการตามการร้องขอใด ๆ ในเรื่องข้อมูลส่วนบุคคลของท่านในทันที แต่ท่านก็ยังอาจติดต่อหน่วยงานกำกับดูแลที่เกี่ยวข้องได้เช่นกัน

1. About ICDL Asia and This Privacy Notice
1.1 ICDL Asia is a company incorporated in Singapore with registration number 201114405D and its registered office located at 50 Raffles Place, Level 19, Singapore Land Tower, Singapore 048623 (“we” or “our”). We are the data controller and are responsible for the personal data collected from you as part of the certification process.
1.2 We provide certifications in various forms that allow candidates to demonstrate knowledge and competence across different areas. Such certifications may include learning content, diagnostic assessments, and examinations leading to certification. Your progress and participation in ICDL programmes are administered by ICDL Asia and/or its affiliates. Upon successfully completing certification tests, you will receive a certification officially confirming your achievement of the ICDL training programme (“the Purpose”).
1.3 We are committed to respecting your privacy and complying with all applicable personal data protection laws and related regulations.
2. Legal Bases
2.1 We process your personal data only as necessary (a) to fulfil the “Purpose” outlined above, and (b) in accordance with applicable personal data protection laws. The specific legal bases we rely on include:
2.1.1 Legitimate Interest – We process personal data where necessary for our legitimate interests as a certification provider. This includes activities related to learning, training, testing, invigilation, and certification, as well as normal business operations such as administration, troubleshooting, data analysis, and information security.
2.1.2 Legal Obligation – We may process your personal data where required to comply with legal obligations, including recordkeeping, monitoring communications, regulatory compliance, investigations, security matters, and crime prevention.
2.1.3 Consent – In certain cases as required by law, we will process your personal data based on your explicit, informed consent. For example, we may use your data to send you ICDL news and newsletters, contact you regarding ICDL, or provide information you have specifically requested.
2.2 We process your personal data strictly in accordance with this Privacy Notice and applicable personal data protection laws.
2.3 We may process your personal data under more than one lawful basis depending on the specific purposes for which the data is used.
2.4 We will only use your personal data for the purposes for which it was collected unless we reasonably consider that we need to use it for another reason compatible with the original purpose. If we intend to process your personal data for a new unrelated purpose, we will explain the legal basis that permits us to do so before such processing.
3. Disclosure of Personal Data
3.1 We will not disclose your personal data to third parties except as required by law or as described in this Privacy Notice.
3.2 Where necessary, we may share your personal data related to learning or certification activities with relevant third parties, including the ICDL Foundation (the owner of ICDL), ICDL office partners in different locations, regulators, training and testing centres, and employers.
3.3 We may also share your personal data with other companies directly controlled by the ICDL Foundation, of which ICDL Asia is a wholly owned subsidiary, for the purposes of inter-company services, reporting, administration, and related support functions.
3.4 Additionally, we may share your data with third-party service providers engaged by us. Such providers may include automated testing providers, learning content providers, customer support providers, data analytics providers, hosting providers, digital credential providers, data storage companies, and professional IT service providers.
4. International Data Transfers
4.1 Your personal data may be transferred to and stored outside the jurisdiction where ICDL Asia operates, in countries with different data protection standards. We will take appropriate measures to ensure such transfers comply with applicable laws and that your personal data is handled with care to protect your rights. For reference, ICDL Asia complies with the European Economic Area’s General Data Protection Regulation (GDPR) (2016/679). Where your personal data is collected and processed in the EEA and transferred outside of it, we ensure adequate protection through one of the following safeguards:
4.1.1 Transferring data only to countries deemed to provide an adequate level of data protection by the European Commission; or
4.1.2 Using specific contractual clauses approved by the European Commission to ensure protection equivalent to that in Europe.

5.1 We retain your personal data only for as long as reasonably necessary to fulfil the purposes for which it was collected. We may retain your data longer if a complaint is raised or if we reasonably believe further communication or engagement may occur.
