HIRNA TRICYCLE DRIVER & OPERATOR TERMS OF USE
Acceptance of Terms
By registering and using the Hirna platform as a Tricycle Driver or Operator, you agree to be bound by these Terms of Use and all policies, guidelines, and operational procedures issued by Hirna Mobility Solutions Inc. ("Hirna").
Eligibility
Drivers and Operators must maintain valid and current:
* Driver's License
* Tricycle franchise, permit, or authorization issued by the appropriate government agency or local government unit, when applicable
* Vehicle registration
* Other documents required by Hirna or applicable regulations
Drivers and Operators shall immediately inform Hirna of any suspension, expiration, or cancellation of required permits or licenses.
Independent Contractor Relationship
Drivers and Operators acknowledge that they are independent contractors and not employees, agents, or representatives of Hirna.
Nothing in these Terms shall create an employer-employee relationship between the parties.
Driver and Operator Responsibilities
Drivers and Operators agree to:
* Provide safe, reliable, and professional transportation services.
* Maintain their vehicle in good operating condition.
* Follow all applicable traffic laws, local ordinances, and regulatory requirements.
* Observe courtesy and professionalism when dealing with passengers.
* Keep account information and documents updated.
Passenger Safety
Drivers shall prioritize passenger safety at all times.
Drivers shall not:
* Operate while under the influence of alcohol or prohibited substances.
* Engage in reckless or dangerous driving.
* Harass, threaten, discriminate against, or abuse passengers.
* Carry passengers beyond the legally permitted capacity of the vehicle.
Booking and Platform Use
Drivers and Operators agree to:
* Accept bookings only when available to provide the service.
* Complete accepted bookings in good faith.
* Use the Hirna platform only for legitimate transactions.
The following are prohibited:
* Fake bookings.
* Self-booking or booking manipulation.
* Use of another person's account.
* Falsification of documents or information.
* Any fraudulent or dishonest activity.
Fares, Fees, and Payments
Drivers and Operators acknowledge that:
* Hirna may charge booking fees, commissions, transaction fees, or other charges as communicated by the Company.
* Hirna may revise fees and charges upon prior notice.
* Earnings shall be released according to the Company's payout schedule.
Customer Complaints and Investigations
Hirna may investigate complaints relating to:
* Passenger safety
* Service quality
* Misconduct
* Fraudulent activities
* Violations of Company policies
Drivers and Operators agree to cooperate fully during investigations.
Account Suspension and Deactivation
Hirna may suspend or deactivate a Driver or Operator account for:
* Violation of these Terms
* Fraudulent activity
* Repeated customer complaints
* Unsafe conduct
* Failure to maintain required documents
* Violations of applicable laws or regulations
Set-Off Rights
Drivers and Operators authorize Hirna to deduct from future earnings any amounts owed to the Company, including but not limited to:
* Customer refunds
* Outstanding balances
* Chargebacks
* Unpaid fees
* Advances or reimbursements
Limitation of Liability
Drivers and Operators remain solely responsible for their actions, vehicles, permits, and compliance with applicable laws.
Except as required by law, Hirna shall not be liable for indirect, incidental, or consequential damages arising from the use of the platform.
Data Privacy
Drivers and Operators consent to the collection, storage, and processing of personal information necessary for operational, regulatory, safety, and customer support purposes in accordance with Hirna's Privacy Policy.
Amendments
Hirna reserves the right to amend these Terms at any time. Continued use of the platform constitutes acceptance of any revised Terms.
Governing Law
These Terms shall be governed by the laws of the Republic of the Philippines.
