Simply Click - Terms of Service

These Terms of Service govern your use of the Simply Click mobile application provided by FischDesigns. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.
Acceptance of Terms:
By using the App, you represent that you have the legal capacity to enter into these Terms and agree to be bound by them. If you do not agree to these Terms, do not use the App.
Use of the App:
License: We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial entertainment purposes, subject to these Terms.
Account: You may not need to create an account to play Simply Click. However, if we implement account features in the future, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
Prohibited Conduct: You agree not to: > * Use the App for any illegal or unauthorized purpose. > * Attempt to interfere with or disrupt the operation of the App or the servers and networks connected to the App. > * Use any automated means or interface not provided by us to access the App or extract data. > * Engage in any conduct that could damage, disable, overburden, or impair the App. > * Attempt to gain unauthorized access to any portion of the App or any other user's information. > * Cheat or use exploits in the game to gain an unfair advantage on the leaderboard or in other game modes.
Intellectual Property:
The App and its original content, features, and functionality (including but not limited to graphics, code, design, and the "Simply Click" name and logo) are owned by FischDesigns and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based upon the App without our express written consent.
Termination:
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Disclaimer of Warranty:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FischDesigns, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT OF [Specify a nominal amount, e.g., $1.00].
Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Changes to These Terms:
We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new Terms within the App or on this page. You are advised to review these Terms periodically for any changes. Your continued use of the App after the posting of revised Terms means that you accept and agree to the changes.
