Proposed Subdivision of Land Formerly owned by Ausgrid: 30 Trevenar St, Ashbury
The land known as 30 Trevenar Street Ashbury is a rectangular land holding, being 6,688 sq metres and is zoned R2 Residential. It sits at the bottom south-west section of Peace Park adjacent to the dog park. It also has an entrance from King Street, Ashbury.
Raine & Horne, Potts Point sold the land via an auction held on or about 13 May 2021 (during the height of COVID) for Ausgrid to Trevenar Pty Ltd for approximately $6.6M.
The applicant, identified as Trevenar Pty Ltd, has a current Development Application for the subdivision of the land into seven (7) lots. This application is the subject of an appeal by the Applicant to the Land & Environment Court.
The Mayor of Canterbury Bankstown Council proposed to commence the rezoning process via the Mayoral Minute to rezone the land to RE1 Public Recreation on 25 May 2021.
We understand that prior to this Mayoral Minute, there is correspondence dated 10 May 2021 from the Mayor to the selling agent, Mr James Nixon at Raine & Horne Projects, putting them on notice of the impending rezoning. We further understand that the response from the selling agent (on behalf of their client Ausgrid) was somewhat belligerent and did not indicate as to whether they would warn any prospective purchasers of the impending rezoning as outlined in the Mayoral correspondence dated 10 May 2022.
Gateway for the planning proposal to rezone the land to RE1 recreation was obtained from the Department of Planning in January 2022. The exhibition of this planning proposal has commenced and will finish on 22 April 2022.
We understand that the new owner will require compensation and the monies involved will be a matter for the relevant Minister for Planning and the Environment. Council clearly placed the selling agent on notice prior to the auction.
