As the educational landscape continues to evolve, it is critical for immigrant families to be equipped with accurate information about their rights and resources.
Every child, regardless of immigration status, has the right to the quality education and support needed to succeed. This guide provides information about education, legal protections, and community resources available to these families. Please share the following resources with any educators or student support staff who may encounter a young immigrant in need of a caring, knowledgeable adult.
Your Rights in the U.S.
• Education Access: Children are entitled to free public education regardless of immigration status. Schools cannot deny enrollment based on immigration status or request proof of citizenship based upon the Supreme Court case Plyler vs Doe. • Privacy and Participation: As outlined in FERPA, parents have a right to attend parent teacher conferences, school events, and be involved in their child’s education. Schools are required to keep families’ immigration status private. More information can be found about FERPA here.
• During Immigration Encounters: Learn your rights, such as the ability to remain silent and request a lawyer. Carry “Know Your Rights” resources in your preferred language. See your school social worker to obtain a card.
Legal Updates
• Stay Informed: Immigration policies can change. Monitor updates from trusted government sources like USCIS.gov or bipartisan organizations such as the National Immigration Forum.
• Document Renewals: Keep visas, work permits, and green cards up to date. Begin renewals early to avoid delays.
