MUSICAL INSTRUMENT RENTAL AGREEMENT

This Musical Instrument Rental Agreement (“Agreement”) is entered into as of __________________ (“Effective Date”) by and between:

1. PURPOSE

The purpose of this Agreement is to permit the Renter to rent and allow the above-named student to use a school-owned musical instrument for educational purposes.

2. INSTRUMENT DESCRIPTION

The School District agrees to rent the following instrument (“Instrument”):

3. TERM OF RENTAL

The rental period shall begin on __________________ and end on __________________, unless terminated earlier in accordance with this Agreement.

4. RENTAL FEE

The Renter agrees to pay a rental fee in the amount of $__________, as established by the Dallas Center – Grimes Community School District’s Board of Education. Fees will be assigned in the Student Portal and shall be paid within 30 days of signature of this contract.

Failure to pay fees may result in termination of this Agreement and retrieval of the Instrument.

5. USE OF INSTRUMENT

The Instrument shall:

• Be used solely by the student named above

• Be used for school-related music instruction, performances and contests, and practice

• Not be loaned, transferred, or subleased to any other individual

6. CARE AND MAINTENANCE

The Renter agrees to ensure that the Instrument:

• Is properly maintained and handled with reasonable care

• Receives routine maintenance as recommended by the School District

• Is stored in a safe and appropriate environment

The School District may provide guidelines for proper care, which the Renter agrees to follow.

7. DAMAGE, LOSS, OR THEFT

The Renter assumes full responsibility for the Instrument during the rental period and agrees to:

• Pay for any damage beyond normal wear and tear

• Pay for repair or replacement in the event of loss or theft

• Report any damage, loss, or theft to the School District immediately

“Normal wear and tear” shall be determined solely by the School District.

8. INSURANCE (OPTIONAL)

The Renter is encouraged, but not required, to obtain insurance coverage for the Instrument. The School District is not responsible for loss or damage under any circumstances.

9. RETURN OF INSTRUMENT

Upon termination of this Agreement, the Renter agrees to return the Instrument to the assigned music instructor or school principal:

• In the same condition as received, excluding normal wear and tear

Failure to return the Instrument may result in additional charges, including full replacement cost.

10. TERMINATION

This Agreement may be terminated:

• By the School District at any time for nonpayment, misuse, or any other purpose determined by the District

• By the Renter upon written notice and return of the Instrument

No refunds shall be issued unless otherwise approved by the School District.

11. LIABILITY

The School District shall not be liable for any injury or damage arising from the use of the Instrument.

12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Iowa.

13. ENTIRE AGREEMENT

This document constitutes the entire Agreement between the parties and supersedes all prior agreements or understandings.

14. SIGNATURES
