TERMS AND CONDITIONS FOR CONCERTTRACKR

ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the ConcertTrackr mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ConcertTrackr ("we," "us," or "our").

ELIGIBILITY

Age Requirements:

• You must be at least 13 years old to use this App

• If you are under 18, you must have permission from a parent or legal guardian

• By using the App, you represent that you meet these age requirements

Account Requirements:

• You may use the App in Guest Mode with limited features

• To access social features, you must create an account with a valid email address

• You are responsible for maintaining the confidentiality of your account credentials

• You are responsible for all activities that occur under your account

ACCOUNT REGISTRATION AND SECURITY

Creating an Account:

• You must provide accurate and complete information when creating an account

• You must keep your account information up to date

• You may register using email/password, Google Sign-In, or Apple Sign-In

Account Security:

• You are solely responsible for maintaining the security of your account

• You must not share your password with others

• You must notify us immediately of any unauthorized access to your account

• We are not liable for any loss or damage arising from your failure to protect your account

One Account Per User:

• Each user may maintain only one account

• Creating multiple accounts to circumvent restrictions is prohibited

Account Deletion:

• You may delete your account at any time from Settings → Account & Privacy

• For security purposes, you may be required to re-authenticate (sign in again) before deleting your account

• Account deletion is permanent and irreversible

• When you delete your account, we immediately and permanently delete:

  • Your user profile and all personal information

  • All events you created

  • All friend connections and friend requests

  • Your activity feed and social data

  • Your Firebase authentication account

• You can export all your data before deletion using the "Export My Data" feature

• Once deleted, your account and data cannot be recovered

• Deleting your account does not affect events that other users have created independently

ACCEPTABLE USE

You Agree To:

• Use the App only for lawful purposes

• Provide accurate information about events, venues, and dates

• Respect other users' privacy and rights

• Comply with all applicable local, state, national, and international laws

• Use the App in accordance with these Terms and our Privacy Policy

You Agree NOT To:

• Use the App for any illegal or unauthorized purpose

• Impersonate any person or entity

• Harass, abuse, threaten, or intimidate other users

• Upload or transmit viruses, malware, or any harmful code

• Attempt to gain unauthorized access to the App, servers, or networks

• Use automated scripts, bots, or crawlers to access the App

• Reverse engineer, decompile, or disassemble any part of the App

• Remove or modify any copyright, trademark, or proprietary notices

• Share false, misleading, or inaccurate event information

• Spam other users with friend requests or messages

• Use the App to send unsolicited commercial communications

• Scrape, harvest, or collect user data without permission

• Create accounts using fake or stolen identities

• Interfere with or disrupt the App's functionality or servers

USER CONTENT

Your Content:

• You retain all rights to the content you create, upload, or share in the App ("User Content")

• User Content includes: event details, event photos, notes, profile information, and any other content you submit

• You are solely responsible for your User Content

License Grant:

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your content within the App

• Sync your content across your devices

• Enable sharing features with friends you've connected with

• Backup and maintain your data for service reliability

• This license ends when you delete your content or account

Content Standards:

Your User Content must not:

• Violate any laws or regulations

• Infringe on intellectual property rights of others

• Contain offensive, harmful, or inappropriate material

• Include personal information of others without their consent

• Contain spam, advertising, or commercial solicitation

• Be false, misleading, or deceptive

We reserve the right to remove User Content that violates these Terms.

INTELLECTUAL PROPERTY

App Ownership:

• The App and all its content (excluding User Content) are owned by ConcertTrackr

• This includes: software code, design, graphics, logos, interface, features, and functionality

• These are protected by copyright, trademark, and other intellectual property laws

Trademarks:

• "ConcertTrackr" and our logo are trademarks owned by us

• You may not use our trademarks without our prior written permission

Limited License:

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the App

• This license is for personal, non-commercial use only

• You may not sublicense, sell, or distribute the App

SOCIAL FEATURES

Friend Connections:

• You may connect with other users through friend requests

• Friend connections are voluntary and can be terminated at any time

• You control what events you share with friends through privacy settings

Friend Discovery:

• You may grant access to your contacts to find friends who use the App

• Contact information is used only for friend matching and is not stored long-term

• You can revoke contact access at any time in iOS Settings

Shared Events:

• Events marked as "Friends" are visible to your connected friends

• Events marked as "Only Me" are private and visible only to you

• You are responsible for setting appropriate privacy levels for your events

Friend Requests:

• You may send friend requests to other users

• Users may accept or decline your requests

• Repeatedly sending unwanted friend requests may result in account restrictions

SMS Invitations:

• You may invite contacts to join ConcertTrackr via SMS

• Do not send invitations to people who have not consented

• Excessive or unwanted invitations may violate telecommunications laws

THIRD-PARTY SERVICES

Integration Services:

The App integrates with third-party services, including:

• Firebase (Google): Authentication, database, cloud messaging, and cloud functions

• Google Sign-In: Optional authentication method

• Apple Sign-In: Optional authentication method

• MapKit (Apple): Map display and location services

• EventKit (Apple): Calendar integration (with your permission)

• Contacts (Apple): Friend discovery (with your permission)

• MessageUI (Apple): SMS invitations (with your permission)

Third-Party Terms:

• Your use of third-party services is subject to their respective terms and privacy policies

• We are not responsible for the practices or content of third-party services

• You should review the terms and privacy policies of any third-party services you use

Third-Party Links:

• The App may contain links to third-party websites or services (e.g., venue websites)

• We do not endorse or control third-party content

• We are not responsible for the availability, accuracy, or content of third-party sites

DATA AND PRIVACY

Your Privacy:

• Your use of the App is also governed by our Privacy Policy

• Please review our Privacy Policy to understand our data practices

• By using the App, you consent to the collection and use of information as described in our Privacy Policy

Data Storage:

• Your data is stored on Firebase (Google Cloud) servers

• Data is synced across all devices where you're signed in

• We implement industry-standard security measures to protect your data

Data Portability:

• You can export all your data as JSON from Settings → Account & Privacy

• Exported data includes: events, friends, friend requests, activity, and settings

Data Retention:

• We retain your data as long as your account is active

• When you delete your account, all data is permanently deleted within seconds via Cloud Functions

• Some data may be retained for legal compliance or security purposes as described in our Privacy Policy

NOTIFICATIONS

Push Notifications:

We may send you push notifications for:

• Upcoming event reminders

• Friend requests

• Friend activity (when friends add events you might be interested in)

• System updates and important announcements

Notification Control:

• You can disable push notifications in iOS Settings

• You can disable specific notification types in the App settings

• Disabling notifications may limit some App functionality

Local Notifications:

• The App may send local (on-device) reminders for upcoming events

• These are controlled in the App's notification settings

CALENDAR INTEGRATION

Permission Required:

• Calendar access requires your explicit permission

• You can grant or revoke calendar access in iOS Settings

Calendar Data:

• When granted permission, the App can add events to your device calendar

• The App does not read or access other calendar events

• You control which events are added to your calendar

EVENT DATA AND ACCURACY

Event Information:

• You are responsible for the accuracy of event information you enter

• We do not verify the accuracy of user-submitted event data

• Event details (dates, times, venues) should be verified with official sources

No Ticket Sales:

• ConcertTrackr is NOT a ticket sales platform

• We do not sell tickets, make reservations, or facilitate transactions

• You are responsible for purchasing tickets through authorized sellers

Venue Information:

• Venue locations are displayed using Apple Maps

• Location accuracy depends on the address provided and Apple's mapping data

• We are not responsible for mapping errors or inaccurate location data

DISCLAIMERS AND WARRANTIES

AS-IS BASIS:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability

• Fitness for a particular purpose

• Non-infringement

• Accuracy, reliability, or availability

• Uninterrupted or error-free operation

• Freedom from viruses or harmful components

No Guarantees:

• We do not guarantee that the App will meet your requirements

• We do not guarantee that the App will be available at all times

• We do not guarantee the accuracy or completeness of any content

• We do not guarantee compatibility with all devices or operating systems

Third-Party Content:

• We are not responsible for the accuracy of venue information, event details, or other third-party content

• Users should verify critical information with official sources

LIMITATION OF LIABILITY

To the Maximum Extent Permitted by Law:

WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of profits, revenue, data, or use

• Loss of or damage to User Content

• Missed events due to inaccurate data or app malfunction

• Costs of purchasing tickets or travel related to events

• Issues arising from third-party services

• Damages resulting from unauthorized access to your account

• Any damages arising from use or inability to use the App

MAXIMUM LIABILITY:

• Our total liability to you for all claims shall not exceed the amount you paid to use the App in the past 12 months

• Since the App is currently free, this amount is $0 USD

Some Jurisdictions:

• Some jurisdictions do not allow exclusion of certain warranties or limitation of liability

• In such cases, our liability will be limited to the greatest extent permitted by law

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ConcertTrackr, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App

• Your violation of these Terms

• Your violation of any rights of another person or entity

• Your User Content

• Your breach of any representations or warranties

• Any activity occurring under your account

TERMINATION

Termination by You:

• You may stop using the App at any time

• You may delete your account from Settings → Account & Privacy

• Upon account deletion, all your data is permanently deleted

Termination by Us:

We may suspend or terminate your access to the App, with or without notice, for:

• Violation of these Terms

• Fraudulent, abusive, or illegal activity

• Extended periods of inactivity

• At our discretion for any reason

Effect of Termination:

• Upon termination, your right to use the App ceases immediately

• Provisions that should survive termination will remain in effect (e.g., disclaimers, limitations of liability, indemnification)

• You may lose access to your User Content unless you export it before termination

MODIFICATIONS TO THE APP AND TERMS

App Modifications:

• We reserve the right to modify, suspend, or discontinue the App at any time

• We may add, change, or remove features without notice

• We are not liable for any modifications, suspensions, or discontinuations

Terms Modifications:

• We may update these Terms from time to time

• We will notify you of material changes by updating the "Last Updated" date

• Continued use of the App after changes constitutes acceptance of the new Terms

• If you do not agree to modified Terms, you must stop using the App

GEOGRAPHIC RESTRICTIONS

Access:

• The App is operated from the United States

• We make no representation that the App is appropriate or available for use in all locations

• Access to the App may not be legal in some jurisdictions

• If you access the App from outside the United States, you do so at your own risk

DISPUTE RESOLUTION

Informal Resolution:

• Before filing a claim, you agree to contact us to attempt to resolve the dispute informally

• Contact us at: support@concerttrackr.com

• We will attempt to resolve the dispute within 30 days

Governing Law:

• These Terms are governed by the laws of New York, United States, without regard to conflict of law principles

• Any legal action must be brought in the courts located in New York County, New York

GENERAL PROVISIONS

Entire Agreement:

• These Terms, together with our Privacy Policy, constitute the entire agreement between you and ConcertTrackr

• They supersede any prior agreements or understandings

Severability:

• If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect

• Unenforceable provisions will be modified to reflect the parties' intent as closely as possible

Waiver:

• Our failure to enforce any right or provision of these Terms does not constitute a waiver

• Any waiver must be in writing and signed by us

Assignment:

• You may not assign or transfer these Terms without our written consent

• We may assign these Terms without restriction

Force Majeure:

• We are not liable for any failure or delay due to circumstances beyond our reasonable control

• This includes: natural disasters, war, terrorism, riots, government actions, internet failures, etc.

Headings:

• Section headings are for convenience only and do not affect interpretation

BETA FEATURES

• Some features may be labeled as "beta" or experimental

• Beta features are provided as-is and may be unstable

• We may change or remove beta features without notice

• Beta features may have additional terms or limitations

SPECIAL PROVISIONS FOR APPLE APP STORE

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and ConcertTrackr, not Apple

• Apple has no obligation to provide support or maintenance

• Apple is not responsible for the App or its content

• Apple is not liable for any claims related to the App

• In case of third-party intellectual property infringement claims, ConcertTrackr is solely responsible

• Apple and its subsidiaries are third-party beneficiaries of these Terms

• Upon acceptance of these Terms, Apple has the right to enforce them against you

Apple Requirements:

• You represent that you are not located in a country subject to a U.S. Government embargo

• You are not listed on any U.S. Government list of prohibited or restricted parties

• You will comply with applicable third-party terms when using the App

ACKNOWLEDGMENT

By using ConcertTrackr, you acknowledge that:

• You have read and understood these Terms

• You agree to be bound by these Terms

• You understand that your use of the App is at your own risk

• You are solely responsible for your User Content and account security

• You will use the App in compliance with all applicable laws

• You have read and understood our Privacy Policy

• You consent to the collection and use of your information as described in our Privacy Policy

USER RESPONSIBILITIES SUMMARY

As a ConcertTrackr user, you are responsible for:

✓ Maintaining accurate account information

✓ Keeping your password secure

✓ Verifying event details with official sources

✓ Respecting other users' privacy

✓ Following all applicable laws and regulations

✓ Setting appropriate privacy levels for your events

✓ Backing up important event information

✓ Monitoring your account for unauthorized access

✓ Purchasing your own tickets through authorized sellers

✓ Complying with venue policies and event terms

FEATURE-SPECIFIC TERMS

Guest Mode:

• Limited features available without an account

• Data stored only on your device

• No cloud sync or friend features

• Data may be lost if app is deleted

Email Import (Coming Soon):

• You authorize us to process forwarded confirmation emails

• Emails are processed to extract event details only

• Original emails are deleted within 24 hours

• We do not access your email inbox

• You forward emails manually; we do not access your email account

Export Data:

• You can export your data as JSON at any time

• Exported data is your responsibility to secure

• We are not responsible for data breaches of exported files

Calendar Integration:

• Requires iOS calendar permission

• Events added to your calendar are subject to Apple's terms

• We are not responsible for calendar sync issues

CHILDREN'S PRIVACY

• The App is not intended for children under 13

• We do not knowingly collect information from children under 13

• If we discover we have collected information from a child under 13, we will delete it immediately

• Parents/guardians should monitor their children's online activities

INTERNATIONAL USERS

• The App is designed for users in the United States

• If you use the App from outside the U.S., you are responsible for compliance with local laws

• By using the App, you consent to the transfer and processing of data in the United States

FEEDBACK AND SUGGESTIONS

• We welcome your feedback and suggestions about the App

• Any feedback you provide becomes our property

• We may use your feedback without compensation or attribution to you

• You waive any rights to feedback you provide

NO PROFESSIONAL ADVICE

• The App is for informational and organizational purposes only

• We do not provide professional advice (legal, financial, medical, etc.)

• Do not rely on the App for critical decisions

• Consult appropriate professionals for professional advice

SURVIVAL

The following provisions survive termination of these Terms:

• User Content license grant (for content not deleted)

• Intellectual Property

• Disclaimers and Warranties

• Limitation of Liability

• Indemnification

• Dispute Resolution

• General Provisions
