BACKGROUND

The law of evolution has always been that the strongest and the fittest survive. However, this is not true with regards to human beings. Since many years, an attempt has been made to develop laws which protect the weakest and the most vulnerable in the society. One such body of law which has developed as a result of this endeavour is the Human Rights Law. Human rights are rights that we have simply because we exist as human beings - they are not granted by any state. These universal rights are inherent to us all, regardless of nationality, sex, national or ethnic origin, colour, religion, language, or any other status. The origins of Human Rights are ideally pinpointed to the year 539 BC. The Magna Carta promulgated in 1215 is considered as a cornerstone in Human Rights history as it outlined specific constitutional and civil rights. Another noteworthy development in the field of Human Rights Law was the adoption of Universal Declaration of Human Rights (UDHR) in 1948. The UDHR comprehensively provides the basic Human Rights guaranteed to every human being and declares that these rights are indivisible, inalienable and applied equally to all.

Over the period of time, multiple other facets of Human Rights such as Womens' Rights, Rights of Children and Rights of indigenous people came to fore. The United Nations Organization along with other regional organizations has contributed immensely towards providing a forum for the countries to discuss and debate on Human Rights issues and ensure that these rights are guaranteed and promised to all. The development of Human Rights Law is ongoing and multiple international instruments have been concluded amongst countries to ensure that all facets of Human Rights are recognized and secured. Another field of law which deserves a mention while discussing about Human Rights Law is the International Humanitarian Law which lays down rules of war and ensures that even in adverse situations, the interest of innocent human beings caught up in the turmoil is secured.

This course aims to equip the participants with the necessary ammunition to comprehensively understand various aspects of Human Rights Law and develop an ability to critically analyse various issues through the lens of Human Rights.
