At Clay Local Schools, protecting the privacy and security of student educational data is a priority. Ohio law (Ohio Revised Code § 3319.326, enacted by SB 29 of the 135th General Assembly and updated in late 2024) sets clear rules for how districts and their technology providers handle student data.
Any third-party technology provider that creates, receives, maintains, or shares student educational records for Clay Local must follow Ohio’s data protection rules as if it were the district. Educational records handled by a provider remain the property of the district. Providers must collect and use only what is needed, protect the data, and may not use it for commercial purposes.
By August 1 of each school year, Clay Local will notify families—by website posting, email, or other direct communication—about any curriculum, testing, or assessment technology provider contracts that allow access to student educational records. Clay Local also sends reminder communications throughout the year. The notice will include:
A list of each provider
A description of the specific records shared
How parents and students can inspect the contracts
Who to contact at the district with questions or concerns

These measures help ensure every educational technology provider we use manages student data responsibly and lawfully. If a provider will not meet Ohio’s requirements or sign a required DPA, we cannot allow its use in classrooms.
