Segway Terms of Use

1) DELIVERY AND CHECK – Segway is delivered to the Customer by the company “City Guided Tour srl VAT number IT09318240968” (hereinafter City Guided Tour srl) in good repair and good working order, and with the Reduced Speed Modality inserted; while being delivered City Guided Tour srl will check the state of repair and working order of the Segway, demonstrating it to the Customer. The Customer must test the Segway and must verify its state, before using it on public areas. If the Customer finds vices, defects, breakdowns or malfunctions, he must warn immediately the personnel in charge of City Guided Tour srl.

2) USE OF SEGWAY – When using the Segway, the Customer has an obligation to guard it, in accordance with the article n. 2051 of the Italian Civil Code, to preserve it with care, and to use it with great diligence, in compliance with the laws in force, and the followings rules: a) Use of Segway is forbidden: by customers under 16 years old; by customers aged 16 and 17 years old without dirving licence and not accompanied by their legal guardian; by customers whose weight is under 45 kilos (100 pounds) or over 113 kilos (250 pounds); by customers who are under the influence of alcohol, drugs, narcotics, medicines or others chemicals which could alter or reduce consciousness or sense perception; by customers whose physical or mental state is unsuitable for driving; by other person than the Customer; to carry persons or goods, to push or to tow vehicles; b) Use of Segway is mandatory done in compliance with the Italian Code of the Rules of the Road, and with the customs regulations, as well as with the others local laws, or rules, in force. c) The Customer is obliged to use the anti-theft devices which equip the Segway, whenever it’s parked, even if it’s left in watched areas. The Customer will be held responsible for consequences deriving from the breach of the aforesaid terms.

3) TRAINING – The Customer decalres to have received, with its group, a full and complete explanation with access to the Segway Manual, demonstration, and individual training about the Segway use, according to the following Segway Product Orientation & Training Checklist: a) Wear an helmet. b) Start the Segway with the Infokey. c) Change from Power Assist mode to Auto Balance mode, and back, understanding how the Segway detects a person on the platform, and keeping both feet on the platform. d) Checking the display to ensure that Segway is in Auto Balance mode, step on the Segway, remaining central with the body weight; remain stationary on the Segway e) Move forward and brake, move backwards and brake. f) Turn in place. g) Execute a controlled stop. h) Execute smooth, controlled, leaning turns around, and far from obstacles. i) Recognize the Speed Limiter, inserted by speed limit, or bumpy/slippery terrain, or by lifting one foot from the platform, and respond by reducing the speed. l) Recognize the stick Shake Warning, and respond by reducing the speed m) Recognize the stick Alarm Sound & Shake Warning, and responding by stopping, and stepping off from the Segway. n) Anticipate and avoid slips, trips and tips. o) Adapt the speed, the manouvering, and the overall use of the Segway to the external conditions such as rain, wind, or wet terrain, or sandy terrain, or bumpy terrain. p) Step off the Segway, holding it, while keeping Platform levelled. q) Always mantain the necessary safety distance from other Segways, people, objects or obstacles.

4) VEHICLE THEFT/FIRELOSS/DAMAGES/FINES– The Customer will be held responsible in case of damage, theft, loss or accidental fire of all or part of the vehicle, caused by Customer’s fraud or negligence. Any damage, including the replacement of the all vehicle, or any other fees, including the additional administrative expenses, upon written notice of the amounts, will be notified to the Customer by e-mail. The Customer is entirely liable for any fines imposed while driving the Segway. The company City Guided Tour srl is obliged by the Law to give all Customers’ details if the Police Authority will require it.

5) CUSTOMER’S HARM – The Customer will use the Segway at his risk and peril. Signing this contract, the Customer releases the company City Guided Tour srl of liability for possible bodily injury or damage that he could inflict on himself or to his goods, using the Segway.

6) LIABILITY TOWARD THIRD PARTIES – The Customer is entirely responsible for death or bodily injury to third parties or for damage to people, animals and property, deriving from the use of the Segway by him or by others persons with his permission, and the Customers releases the company City Guided Tour srl of liability for possible bodily injury or damage that he could cause to third parties. City Guided Tour has a third party Insurance that may intervene in case of accident.

7) ACCIDENTS - In case of accident, theft, loss, fire or damage, the Customer must: Call out the competent authority. Call an ambulance if required. Report all accidents to the police immediately. Warn the company City Guided Tour srl immediately. Customer must cooperate with City Guided Tour srl and its insurance Company in all inquiries or legal procedures which could follow the event and to take details of who was involved and what happened.

8) BREAKDOWNS AND SUBSTITUTION - In case of breakdowns which aren’t ascribable to the Customer, City Guided Tour srl will, given its organizational possibility, provide a replacement vehicle. Customer has to immediately report the trouble to the company City Guided Tour srl, and to carry out its indications.

9) RETURN OF VEHICLES – Customer must return the Segway in the same condition as it was picked up, except for normal wear and tear. If a vehicle is returned to a different location than where it was picked up without the written consent of City Guided Tour srl the Customer will be charged with the cost of recovering vehicle. City Guided Tour srl shall bear no liability for goods which will be left or forgotten on the Segway.

10) CUSTOMER’S DECLARATIONS - The Customer accepts that every charge or fee which he could be liable as a consequence of this contract will be sent for payment by e-mail. Customer declares to have tested the Segway that was given him and to have found it in good repair and in good working order, without vices, defects or evident malfunctions, and to mantain the Reduced Speed Modality inserted as covered by the clause 1) DELIVERY AND CHECK; Customer declares to be able to ride the Segway, and that we have none of the conditions which are covered by the clauses 2) TERMS OF USE paragraph a) cases in wich the use of Segway is forbidden. Customer also declares to have received a full and complete explanation, demonstration, and individual training as described by the clause 3) TRAINING, following the Segway Product Orientation & Training Checklist.
